Planning Board Minutes 04/06/04
Minutes of Meeting— April 6, 2004

The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:30 p.m., Chairman Robert D’Amelio called the meeting to order.

Ms. Simpson read into record a Legal Opinion from Town Counsel, dated April 6, 2004, regarding the right of the Planning Board to intervene with regard to slope issues in the Danforth Woods subdivision.  Mr. D’Amelio has contacted EarthTech to find out if they are available for the meeting on April 20, 2004.  The Planning Board will furnish EarthTech with a copy of the Simpson Gumpertz Heger report and request a site visit.

Mr. Flood asked what residents should do in the meantime if landslides should occur.  Mr. Arthur Gordon requested the involvement of the Board of Health.  Residents asked if a meeting could be held sooner than April 20, 2004.  The Board will ask if EarthTech to be available on April 14 at 7:00 p.m.

Mr. Esteves reported that silt is overflowing into the detention basins and had entered the wetlands in small amounts from 56, 58, and 60 Laurel Drive.

Mr. Wood  thanked for the residents for their patience.  He stated that the Building Commissioner has no jurisdiction over slopes.  Mr. Wood stated his intention to work with all concerned boards, and would liked to be informed of all developments and meetings.

Ms. Simpson met with residents during a brief recess to establish a contact person for the residents.  Mr. Perry was designated the contact person.

7:30 Scenic Road Hearing:     Chestnut Hill Estates
Present:  Jonathan Markey, Foresite Engineering

Mr. Markey presented the plan to the Board.  Foresite Engineering plans to replace a stone wall along the ROW on the plan.  A total of 80- linear feet of existing stone wall will be rebuilt on property line.  The Town owns the stone walls.

Richard Gelpke, seconded by Joan Melillo, moved to close the public hearing.
Vote: 4-0-0, Unanimous.

Richard Gelpke, seconded by Peter de Bakker, moved to issue a permit to remove and rebuild the stone wall on the property line at Chestnut Hills Subdivision according to plans titled “Water Main Extension Plan, Chestnut Street & Murphy Road,” prepared for Paul and Sally Malloy, drawn by Foresite Engineering, stamped by Scott P. Hayes Civil No. 41017, and dated March 2, 2004.
Vote: 4-0-0, Unanimous.

7:00     ANR/Discussion:     235 and 239 Lincoln Street 
Present:     Chris Yates, atty. for applicant
                  
Mr. Yates explained that  Lot 1 on the plan is 235 and Lot 3 in front is 239.  The plan shows the proposed ANR plan, which shows the proposed lot lines.  There is insufficient frontage for an ANR.  The attorney for the prospective buyer  urged the Board to determine that the plan does not need approval.  Mr. Yates pointed out that approval would be of great benefit to his client, the seller; however, he does not feel that Board has the authority to do so.

Peter de Bakker, seconded by Richard Gelpke, moved to determine that the plan titled “Plan of Land in Hudson & Bolton” does require approval.
Vote: 3-1-0, D’Amelio opposed.

7:00      Informal Discussion:        Fred Malloy
Present:      Fred Malloy

Mr. Malloy would like his project to be considered now that the sewer moratorium has been lifted.  To what extent would his client need to construct Lower Road and Lakeshore Drive extension to allow him to get a building permit for his property.  The Board reviewed the conceptual plan and made suggestions for official submission.

7:15 ANR:                                  Pope Street
Present:       Dave Zanca

Mr. Zanca’s client hopes to subdivide the back lot from front lot, creating a lot with no frontage and a ROW out to the street.  The zone does not require frontage or a setback.  This will allow Mr. Zanca’s client to sell the back house.  Some easements are planned to allow neighbors to park their cars.  

The Board will require proof that all interested parties are in favor of the proposed plan.  Mr. De Bakker verified that all plan submittal requirements had been met.

Peter de Bakker, seconded by Richard  Gelpke, moved to determine that approval is not required for the plan titled “Plan of Land in Hudson, MA,” dated January 21, 2004, and drawn by Zanca Land Surveyors, and to authorize the agent to sign upon receipt of a letter from Chirstopher Martin Realty Trust indicating that the Trust is aware of, and approves of, the plan.
Vote: 4-0-0, Unanimous.

7:45 Site Plan Review:             10 Bonazzoli Avenue, Lots 5 and 6
Present:     Steve Poole,
                   Michael Saliga, applicant
                  Building Commissioner Jeff Wood

Prior to starting, Mr. Poole confirmed for the Board that all necessary information is on the plan.  Mr. Poole presented the project to the Board.  Saliga Machine has received a verbal approval from the Conservation Commission.

The Board questioned the use of the 1.5:1 slopes, and the building of the addition through the lot line.  The Board stated that there must be a 2:1 slope. Mr. Wood concurred.  Mr. Wood stated that two adjoining lots are technically one when owned by the same owner and will need to be merged officially before a building permit will be issued.

The Board requires a better detail map showing erosion control measures.  Said plan should show hay bales and a silt fence.  A complete detail of the retaining wall is necessary as well.

The pubilc hearing was continued until April 20, 2004 at 7pm.

7:45 Public Hearing:                 Zina Farms Subdivision


The Board requires a $5k deposit for EarthTech.   The hearing was continued until  May 18, 2004.

8:00 Site Plan Review:              Hillside Retirement

The hearing was continued until April 27, 2004 at 7pm.

Falls Brook Bond Reduction

The Board decided not to consider any bond reductions this evening.

Pheasant Trail Bond Reduction

The Board decided not to consider any bond reductions this evening.

Danforth Woods Subdivision

The Board decided not to consider any bond reductions this evening.
