Planning Board Minutes 04/19/05
Minutes of Meeting— April 19, 2005

The Hudson Planning Board met at the Town Hall, 78 Main Street, Hudson, Massachusetts.  
At 7:30 p.m., Chairman Robert D’Amelio called the meeting to order.
Present:        Robert D’Amelio, Rodney Frias, Dirk Underwood, and Tom Collins

Mr. Underwood removed himself from the Board.

Ms. Burke updated the Board with the status of the project.  All outstanding issues have been met.  She presented a list of proposed conditions.

A pre-construction conference will be held between the developer, the Town Planner, the DPW and other interested parties. If construction begins without this conference construction will cease immediately until the conference is held and the appropriate people are in attendance.

A copy of the SWPPP must be provided to the Town Planner and the DPW at the pre-construction conference.

Hours of operation will be Monday through Saturday 7:00 a.m. to 5:00 p.m.  No work or operation of machinery may happen before 7:00 a.m., in accordance with the town’s noise by-law or after 5:00 p.m.  Per the Massachusetts General Laws, work on Sundays and holidays need to be permitted on a case by case basis by the Chief of Police.
There will be a three- (3) year construction build out beginning the date of the pre-construction conference.
The Planning Board reserves the right to review the site and conditions every six months.

A shop drawing for the proposed slot drain shall be submitted to the DPW at the pre-construction conference for approval.

A Professional Engineer shall provide a yearly inspection report of the BMP’s of the proposed drainage system to the Town Planner, the DPW and the Conservation Commission to demonstrate that adequate maintenance is being provided for this drainage system.

The Planning Board’s erosion control plan as attached shall be adhered to and govern.  All erosion control shall be in place and approved before construction begins.  Weekly erosion control reports shall be submitted to the DPW and the Planning Department no later than noontime on Fridays.

No building permits will be issued until a grading plan is reviewed and approved by the DPW and the Town Planner and the final occupancy permit will be held until an as built plan of said lot grading and drainage system BMP’s has been accepted and approved by the Town Planner.

There will be a permanent no cut buffer zone along the Charter Oak Country Club property line.  The buffer will be 30 feet along the property line and a minimum of 105 feet around the community house.

No building permit will be issued until 100 12’-14’ white pines are planted along the no cut buffer zone.

Domestic fire sprinkler systems will be installed within each dwelling unit and the community meeting hall.  The systems will be designed and installed according to the NFPA Standard 13-R, 2002 edition.

No building permit will be issued until copies of a fully executed perpetual access easement and a fully executed easement for the recreational purposes between the developer and the Town of Hudson in accordance with the signed agreement dated March 2004 is provided to the Town Planner.

No building permit will be issued until the area designated for a playing field is rough graded and left in a condition acceptable to the Director of Public Works.

The developer will collect, screen and sell any surplus topsoil on the playing field site to the sole benefit of the Town less reimbursement for any costs incurred to carry out this provision.

The entrance off of Main Street will be limited to right turn out only.  The Town reserves the right to review and change allowable turning movements/traffic issues 6 months after 100% occupancy of units.

Ms. Burke noted that the developer had an opportunity to review the conditions and had two comments.

#11 - They won't be clearing the area to provide access to this location until Phase 2 of the project. This won't occur until sometime next year. They suggested no additional permits could be issued after the first 12 until the trees are planted.

The Board saw no issue with this.

#14 -They won't have the site graded, or the loam sold for sometime as the construction progresses. Since they want to get the most money for the loam, it would make sense to sell the loam at the best time at the highest price. They suggested holding the last 4 permits (worth $2,000,000 in completed buildings) until the grading is complete.

The Board wanted to tie the grading to a date and stated that all grading on the recreational field shall be complete by September 30, 2006.

The Board discussed adding a condition regarding the requirement of the 3-foot grass strip between the road and the sidewalk.

The Board also agreed to a four- (4) year build out instead of three (3).

Finally the developer agreed to forward a copy of the Conservation filing to the Planning Board.


Rodney Frias, seconded by Robert D’Amelio, moved to approve the plans entitled “Sauta Farm Condominiums Main & Brook Streets Hudson, Massachusetts 01749” dated February 18, 2005 last revised April 4, 2005 owned by Midland development, LLC of Bolton, MA as drawn by Aldrich Engineering of Winchendon, MA with the following conditions:
