Minutes of Meeting—May 20, 2003
A meeting of the Hudson Planning Board was held in the Hudson Town Hall, 78 Main Street, Hudson, Massachusetts.  At 7:30p.m., Robert D’Amelio, Chairman, called the meeting to order.
Present were:   Robert D’Amelio, Richard Gelpke, and Rodney Frias
Absent was:     Peter de Bakker and Joan Melillo
        
Minutes.

Richard Gelpke, seconded by Rodney Frias, made a motion to approve the Minutes of the May 6, 2003 meeting as corrected.
Vote:      3-0-0 unanimous

ANR/Old Stow Road & Zina Road.
Present was:         Tom Dipersio
                
Mr. DiPersio presented the site plan to the Board for Site Plan Review.  This plan allows for nine frontage lots.

The Board sees no issue with the plan.

Richard Gelpke, seconded by Rodney Frias, made a motion to accept the ANR Plan for Zina and Old Stow Roads entitled “Plan of Land in Hudson, MA” owned by Roman Catholic Archdiocese of Boston as drawn by Thomas Land Surveyors in Hudson, MA and dated May 13, 2003 and authorize the Agent to sign.
Vote:      3-0-0 unanimous
151-153 Washington Street.

Mr. Poole presented the plan to the Board.  The proposal is for one auto dealership with a show room, repair bays and a parts department.  The existing structure will be improved but not added onto.  There will be a vertical concrete retaining wall with a chain link fence in the rear to enable regrading for access around the building and parking.  They will be tying into the existing drainage.

A portion of the site is zoned residential and the activity will extend about 35 feet into the residential district.  Mr. D’Amelio asked if ZBA needed to approve this.  Mr. Poole will check with the building Commissioner to determine this.

Mr. D’Amelio questioned how much fill will leave the site.  Mr. Poole indicated that all the cut will be used as fill on the site and additional fill will be brought in.  The Board asked how many parking spaces are proposed on the site.  One hundred-sixty spaces are proposed.

The Board would like all drainage calculations, and data for Earth Tech to review.  The Board would like more detail on the wall design.

The Board will determine who will inspect the erosion control and roadways.  It will be someone other than the developer.  The Board will also need to keep an eye on the length of slopes.  The Board wants all erosion control installed  by the developer and approved by the Planning Board prior to any construction.  

 Mr. Gelpke asked what the area between the retaining wall and Maxwell Circle will look like.  Mr. Poole indicated that they hope to maintain 20 feet as natural vegetation and then plant lower vegetation.  The Board would like a planting plan.

The Board would like the plans amended to show the grades on the property lines and the Maxwell Circle houses shown on the plans.

Bonnie Hamelin, 13 Maxwell Circle, presented pictures to the Board.  She expressed many concerns.  She asked if Town Counsel will be involved in this project.  Mr. D’Amelio indicated that if the Board felt his presence was needed they would request it through the Executive Assistant’s Office.  She asked if all engineering reports would be available to the public.  She was told yes.  She asked if a construction company had been chosen yet.  Atty. Kuzinevich told her no.  She also asked if the license from the Selectmen should be acquired first.  The Board stated that the Selectmen needed an approved site plan for the license application.  Finally, she asked if the use was allowed.  She was told yes.

Joe Durant, 22 Harriman Road, asked if the 30 foot road in the rear of the building was a requirement of the Fire Chief or a request.  Mr. Poole indicated that it was a request.  Mr. Durant asked if 90 cars could be on the site without disturbing the rear of the property.  He was told no because 30 cars are needed for employee/customer parking.  He questioned whether the lot was a legal lot because the strip that is zoned Residential was under different ownership at one time and then combined.  Mr. Durant questioned whether the residential strip could be used as proposed.  He suggested that the Board get a definitive answer on this issue.

Richard Gelpke, seconded by Rodney Frias, made a motion to refer the issue of the lot legality to Town Counsel for review.
Vote:      3-0-0 unanimous
Barbara Maciarelli, 11 Maxwell Circle, expressed her concern regarding the project.  She would like to know how page 48 of the Zoning by-law relates to this project.  She stated that the hydrants and the wetlands are not shown on the plan.

Alison Hay, 11 Maxwell Circle, would like to know how lighting and noise will be addressed.  The Board indicated that they will wait to hear wait Counsel’s opinion before doing any more review.  She also said that she feels the developer has not addressed the concerns of the residents.

Len Daeke, 14 Maxwell Circle, questioned the residents’ legal recourse after the approval if not all conditions are followed.  The Board stated that their jurisdiction is limited, but property owners can hire their own attorneys.

Paul Masciarelli, 15 Maxwell Circle,  asked if a traffic study will be done on Washington Street.  He was told no.

The Board scheduled a site visit for Tuesday May 27, 2003 at 6:00 p.m.  They will meet at 15 Maxwell Circle.


Richard Gelpke, seconded by Rodney Frias, made a motion to continue the public hearing for 151-153 Washington Street until June 17, 2003 at 7:30 p.m.
Vote:      3-0-0 unanimous
