Minutes
December 21, 2006, 7:00 P.M.

1.0     Preliminaries
1.1.    Paul Byrne opened the meeting at 7:07 P.M.
1.2.    Roll Call:  Chairman Paul Byrne, Vice-Chairman Minot Wood and members Dave Esteves and Joe Rodrigues.  Member Misty-Anne Marold and Terrence Joyce were absent as well as Conservation Agent Katrina Proctor.

4.1  Marty Moran to discuss Danforth Woods project.  (DEP 190-488)

Moran presented the plan to repair the pond edge at the Danforth Woods property.  Joe Rodrigues has approved fill material from DPW.  The Commission agreed to hire Alan Manta to operate his heavy equipment to repair the pond edge.

There was discussion about the Central Mass. Mosquito Control coming in to clear the debris from Danforth Brook.  A site visit will be scheduled in advance to review on the operation.

4.2  Continuance Hearing ANRAD (DEP #190-485)
        Applicant:  LPM Holding Company, Inc.
        Owner:       Watson Ventures LLC
        Location:       90 Cherry St.
        Project Description:  resource area delineation only

Minot Wood made a motion to accept the wetland delineation with historic mill complex riverfront area exemption, seconded by Joe Rodrigues with all in favor.

4.3  Notice of Intent (DEP #190-490)
        Applicant/Owner:  Alfred J. & Jean C. Zerega
        Location:  15 Lyman St./84 Lakeside Ave.
Project Description:  demolish existing single family structure, construction a new single family structure and remove of trees within the Buffer Zone.

DEP Comments:  FILING DID NOT INCLUDE PLANS. AS DIRECTED IN INSTRUCTIONS AND PER REGULATIONS AT 310 CMR 10.00, APPLICANT MUST PROVIDE PLANS SUFFICIENT TO EXPLAIN PROPOSED WORK. CONSERVATION COMMISSION SHOULD ALSO VERIFY IF SITE LIES WITHIN FLOODPLAIN.

Paul Byrne required the applicant to have Board of Health approve the septic system prior to Conservation Commission approval.  Members will perform site visits at their individual convenience.

Paul Byrne made a motion to continue the hearing January 4th, seconded by Minot Wood with all in favor.  

 4.4    Notice of Intent (DEP #190-489)
        Applicant:  Jose & Eugenia Matos
        Location:  1 Glendale Rd.
Project Description:  construction of an addition to an existing multi-family house, including two new dwelling units, expansion of the driveway and parking area and a new septic system within the Riverfront Area and within the Buffer Zone of Bordering Vegetated Wetlands.

The septic system plan has been submitted to the Board of Health.  The Commission will await Board of Health approval prior to Commission approval.

Paul Byrne made a motion to continue the hearing January 4th, seconded by Minot Wood with all in favor.  

        4.5  Continuance Notice of Intent (DEP #190-487)
        Applicant:  Dana Stenquist
        Location:    159 White Pond Rd.
Project Description:  Construction of new roadway and two single family house lots, and appurtenances.  Portions of stormwater management system and some lot grading is proposed within 100 ft. of Bordering Vegetated Wetlands.
        
Paul Byrne made a motion to continue the hearing January 4th, seconded by Minot Wood with all in favor.  

        4.6  Continuance Hearing Notice of Intent (DEP #190-486)
                Applicant:  Paul Davis
Location:  Lot 3 Chapin Rd.
Project Description:  the owner/applicant proposes to construct a home with grading, driveway, culvert installation over intermittent stream and landscaping.

There was discussion surrounding the intermittent stream and buffer zone.  The Commission told the engineer that this filing confirms that the detention basin constructed for the subdivision falls within the Buffer Zone and a filing is necessary.  DiPersio will discuss this with the Conservation Agent and his wetland scientist.  Tom DiPersio requested a continuance.

Dave Esteves made a motion to continue the hearing January 4th, seconded by Minot Wood with all in favor.  

4.7  Notice of Intent (DEP #190-   )  NO FILE NUMBER ISSUED YET
        Applicant:  Arthur Redding
        Location:     439 Main St.
Project Description:  Construction of a commercial building including site work & utilities, portions of which are within a Bordering Vegetated Wetland altering 2,623 sq. ft. and construction of a replication area 3,000 sq. ft.

Minot Wood made a motion to close the public hearing and issue an Order of Conditions with the following special condition:
·       Soils on- site must not be used for the replication area because of the presence of invasive species.
·       Hay bales are prohibited.
·       Wire reinforced silt fence must be used for erosion control.

The motion was seconded by Paul Byrne with all in favor.

4.8 Enforcement - Discussion – Lauren Heights – Mike O’Malley and David Burke

Joe Rodrigues made a motion to continue the matter on January 4, 2006, seconded by Minot Wood with all in favor.

5.0     Commentary
5.1     Budget Hearing Tuesday, January 9th at 8:00 PM

6.0     Adjournment – Dave Esteves made a motion to adjourn, seconded by Joe Rodrigues with all in favor.
