Conservation Commission Minutes
April 6, 2006, 7:00 P.M.

1.0     Preliminaries
1.1.    Vice Chairman Minot Wood opened the meeting at 7:00 PM.
1.2.    Roll Call:  Vice Chairman Minot Wood, David Esteves, Misty-Anne Marold and Joe Rodrigues.  Paul Byrne and Judy Sabourin arrived late.  Katrina Proctor Conservation Agent was also present.
1.3.    Additions or deletions to the agenda

2.0     Hearings and Appointments 7:00 P.M.

2.1     The Commission welcomed Mike Berry newly appointed Conservation Commission Member.    Mike needs to be sworn in by the Town Clerk before he can serve as a voting  member.

Chairman Paul Byrne arrived resumed the duties of chairman.

2.2     Continuance Request for Determination (HUD #318)
Applicant:  Bruce Lafreniere
Project Description:  (After-the-fact filing) A 12’ X 12’ shed was built on a cement pad and 10 trees were cut within 100 ft of Fort Meadow Reservoir without a permit. 

Mr. Lafreniere presented his own mitigation plan.  Plantings included arborvitaes and fruit trees.  The Commission expressed concern about the size of the beach and was not satisfied with the planting plan.  It was noted that the erosion controls were not installed as requested at the last meeting.  At the last meeting the Commission requested the applicant hire a landscape professional to assist with the plan.  Mr. Lafreniere stated at this meeting that he can not afford a landscape architect.  Mr. Lafreniere also had difficulty with the plan because he is waiting for house plans to be designed and approved by the Building Inspector.  Without the approved building permit Mr. Lafreniere is having a difficult time with the landscape design.

The Commission required that erosion controls/hay bales be installed now.
The Commission will hold a site visit on Wed. April 12th at 5:45 pm. to give Mr. Lafreniere guidance on what will be required for a mitigation plan.

2.3     Continuance Hearing - Notice of Intent (DEP 190-463)
Applicant:  David J. Quinn
Project Description:  construction of a gravel access driveway from Old North Road to the proposed building site of Lot #2, including work in the Buffer Zone and a “limited project” wetland crossing.

Proctor informed the Commission that the Planning Board’s consultant has completed their review and Jen Burke Town Planner believes everything to be in order at this time.  The Planning Board did not continue discussion on the Subdivision application this week because key members of the Board were not in attendance.

Paul Byrne made a motion to continue to hearing to 4/20/06, seconded by Minot Wood with all in favor.

2.4 Continuance Notice of Intent (DEP 190-472)
        Applicant:  Anthony Marques
        Location:  Cherry St.
        Project Description:  stormwater infiltration system @ Cherry St. ball field.

Proctor stated that the Commission is in receipt of the DEP number and advised that the hearing can be closed and the Commission may vote to issue the Order of Conditions.

Paul Byrne made a motion to close the hearing and issue the Order of Conditions with one special condition as follows:

1)      The applicant/owner will to plant three trees at the southern end of the parking area and three trees at the front of the property along Cherry St.  

        The motion was seconded by Minot Wood with all in favor.

2.6 Continuance of Notice of Intent (DEP 190-471)
Applicant:  Neil Fossile
Location:  Lots 1 & 2 Causeway St.

Proctor reported that Tom DiPersio Jr. phoned to request the meeting be continued to 4/20/06.  DiPersio will submit revised plans.

Paul Byrne made a motion to continue the hearing to 4/20/06, seconded by Minot Wood with all in favor.

        2.7 Lyman Associates - Discuss Amendment of the Order of Conditions – hydro-raking

Erica Bigelow presented a project request involving hydro raking a cove/channel within Lake Boone.  Lycott Environmental submitted a brief description and plan indicating the area in the Lakeside Ave. /Proctor Ave. cove.  The request is to accept this project as a modification under an Order of Conditions issued for a mitigating invasive plants by hand pulling and hand planting within Lake Boone.   The Commission felt that these projects are entirely different and required a Notice of Intent.

Bigelow presented pictures of the cove clearly showing turbidity and sediment within the pond.  The Commission asked the Agent to investigate the source during rain storm events.

2.8 Terrence Joyce – informed the Commission that Marty Moran called him looking for new members.  Mr. Joyce is interested in becoming a member.  Judy Sabourin was reappointed for 3 years and has previously expressed interest in stepping down when the Commission finds a new member.

3.0     Work Session
3.1     Discuss – River’s Edge Subdivision – gift of land
3.2     Discuss SEA Consulting. – FYI - Proctor
3.3     Minutes – Paul Byrne made a motion to approve the minutes 2/2/06, 2/16/06, 3/2/06 and 3/16/06, seconded by Judy Sabourin with all in favor.

3.4     Sign the Denial of the Order of Conditions (DEP 190-469) 2 Third St. – Signed.
3.5     Meridian Associates, Inc. letter dated 3/14/06 (DEP 190-468) – Details/plans provided as requested in the conditions. – Approved.
3.6     Discuss Fire Station, Cox St. – The topic was discussed per Judy Sabourin’s concern that the Fire Department has access to the riverfront area.   Sabourin recommended that the Commission require the Fire Department to install a fence around the training area.  There is a fence along the detention basin which is adjacent to the training area.  Proctor confirmed that the approved plans and Order of Conditions did not require a fence around the entire training area.  The training area is within the 100 ft-200 ft. RFA.  There is a natural berm sloping up from the training area to a pine stand and then sloping down toward the riverbank of the Assabet River.   Proctor reported that the Fire Chief indicated he would be happy to have a written agreement with the Countryside Towing, per the Commission’s recommendations i.e. no fluids in the vehicles.  Proctor stated that she only saw a few pieces of trash and recommended that the Commission remind the Chief to ask the fire personnel to keep the area clean.

The Commission decided that they would not require a fence and was not concerned with the operations at the Fire Station.

3.7     Larkin Lumber – Paul Byrne concerned about the wood chips being blown into the Assabet River.  Byrne will follow up.
3.8     Enforcement Order – Third Street – The Commission asked Proctor to write an Enforcement Order and ask the owners in to the meeting.  Judy Sabourin voiced concerns at the last meeting.  Dave Esteves and Paul Byrnes have been by the site to see it and are equally concerned.  
3.9     80 Fort Meadow Rd. – Judy Sabourin asked Proctor to call the owners at 80 Fort Meadow Rd. and require them to remove the chain from the tree.  The Commission approved tree cutting on the lot, however, one of the remaining trees on the waterfront is being choked by the chain, and overtime this will kill the tree.
4.0     Correspondence
4.1     Planning Board – Site Plan Review 400 & 404 Main St. – (RDA must be filed.)
4.2     EOEA – notice surplus land in Hudson. – (state land MassHwy salt shed.)
4.3     Wildlife Habitat – DEP Guidelines Received. – (Noted)
4.4     MACC letter informing the Commission that Proctor has completed the MACC Advanced Certificate training program and received a Certificate of Achievement. (Noted)
