Meeting Minutes
May 19, 2005
1.0 Preliminaries
1.1. Marty Moran opened the meeting at 6:40 p.m.
1.2. Roll Call: Chairman Marty Moran, Vice Chairman Paul Byrne, Secretary Judy Sabourin, David Esteves, Joe Rodrigues, Minot Wood. Absent: Misty-Anne Marold. Conservation Agent Katrina Proctor was also in attendance.

3.1 Continuance Notice of Intent
Applicant: Doris Freitas
Location: Lot 1 Princeton St.
Project Desc.: construction of a single family house on an existing lot, including driveway construction within an existing paper street, site grading, drainage and utilities.
Steve Poole of Consolidated Design represented the applicant. The revised plans were submitted this morning. Although the submittal of the new plans did not arrive in time according to the deadline 1 week in advance of the meeting, the Commission agreed to continue the meeting. Poole explained that the revisions were made as requested by the Commission and include the additional stretch of the brook and associated Riverfront Area, and the wetland flagging numbers and stone wall was added to the plan.
Poole explained some of the changes made to the plan per the Planning Board’s request. To address the abutter drainage concerns at 490 Main St., a French Drain was added to pick up the groundwater at the end of the foundation drain and direct it into a swale. The street name will change because there is a Princeton Road in Hudson. The Planning Board will meet next Tuesday evening. They have asked for a list of requested waivers needed if the road were to be built to the current subdivision road standards. The owner must submit a petition to the Zoning Board of Appeals, due to the fact, that the work falls within the Watershed Protection District. The owner must also go to Land Court.
The driveway is being proposed on a paper street called Princeton St. The town does not have any property rights to the street.
Marty Moran made a motion to close the hearing upon approval of the Agents verification of the wetland flagging, seconded by Joe Rodrigues with all in favor.
3.2 Abbreviated Notice of Resource Area Delineation (DEP 190-0443)

The applicant requested a continuance of the public hearing to June 2, 2005.

3.3 Notice of Intent (DEP 190-0448)
Applicant: John Sargent – Midland Development
Owner: Mary Sauta Realty Trust
Representative: EcoTec, Inc. – Scott Morrison
Location: Brook Street Map 45 Parcel 29)
Project Description: The proposed project consists of installing the drainage
structures and discharge from Sauta Farm Subdivision stormwater management system within Brook Street. Grading is proposed within the Buffer Zone to a BVW within the proposed Sauta Farm Subdivision.
John Sargent noted that the erosion control plans requested by the Commission for additional information was submitted in advance of the deadline.
Sargent explained these erosion control plans.
Phase one
Installation of the hay bales and silt fence along Main Street, Brook Street and along the westerly sideline.
Construct two temporary siltation control retention basins. One is the long basin and the other is an oversized basin at the road edge
Construct swales into the basins.
As roadways are excavated and brought to grade, utilize berms and swales to bring runoff along roadway to intercepting berms and swales connected to retention basins.
Disturbed areas to be stabilized as soon as possible.
A stone berm 2’ wide X 1.5’ high will be installed across the roadway before the weekends and when heavy rains are expected.
Phase 2
Roads have been cleared of trees and stumped, topsoil removed and brought to grade.
Catch basins, manholes and connecting pipes to be installed. The grates will be sealed until the base coat and berm is in place and slopes are stabilized against erosion.
When the subterranean detention basin, control outlet structure and outfall are functional the temporary pipe from manhole four may be disconnected and the system completed by connection to manhole three.
Temporary basin #2 to be removed and the final designed retention basin to be constructed to receive flow from the slotted drain. The slotted drain is the last to be installed prior to base coat, berms and slope stabilization.
Temporary basin #1 to cleaned of debris and filled to grade with clean material compacted in 12” lifts.
The final water quality swale is to be constructed and the flow allowed to enter the operational drainage system.
Sargent also noted that liners will be installed in the catch basins and remain until all disturbed areas are established with vegetation.
Phase 3
Roads are paved with base coat.
Slopes are stabilized against erosion.
Drainage system is operational.
Erosion control for each building site will be provided as it is developed. It will consist of staked hay bales and silt screen.
Weekly inspections of drainage structures will occur.
All major construction has been completed at this point.
Minot Wood noted that he had spent minimal time reviewing the watershed analysis and drainage calculations and found errors. He asked the drainage engineer, Steven Aldrich, what is the capacity of the retention basin. Aldrich stated that the basin was sized for a 2-year storm stating that this 3 inches of rain per hour for 24 hours equating to 75 inches of rain in a 24-hour period. Minot Wood voiced that this is an absurd calculation and that he though felt it must be 3” of rain over 2 over a 24 hour period. He asked how many cubic feet of water this is. Aldrich referred to the drainage calculations and stated 2.88-acre feet of storage in the retention basin.
Sargent noted that the Planning Board’s consultant Earth Tec went through 3 or 4 reviews of the drainage calculations and was ultimately satisfied.
Minot Wood asked if the project was designed as required in Standard #6. He noted that standard 6 of the watershed analysis states that the project does not contain critical areas with sensitive resources. The engineer stated that the volume to be treated is calculated as 1.0 inch of runoff times the total impervious area of the post-development project site. (Stormwater discharges to critical areas must utilize certain stormwater management BMPs approved for critical areas. This critical area on this project site is the recharge for public water supply.)
Standard #4 was discussed “80% total Suspended Solids (TSS) removal is required.

Minot Wood expressed that he would like to see the catch basins with soil and oil hoods. Aldrich responded that hoods would be a hydrological impediment to the drainage system.
Sargent commented that the catch basins would control first flush of runoff with respect to oil products.
Minot stated that the rainfall data is incorrect as Worcester County data was used rather than Middlesex County data. He explained that Hudson is in the Middlesex County and that DEP requires rainfall data from the county the community is located in.
Joe Rodrigues asked why an 18” reinforced concrete pipe is used. Aldrich explained that the Planning Board required the pipe to be sized for a 100-year storm. Joe noted that the Highway jobs use 12” pipes on the large jobs.
Catch basins are deep sump catch basins made of pre-cast and will not be picking up any groundwater.
Phase III – Regrading. The drainage system will be complete. They are wrapping each unit with hay bales as they go along. The last thing that goes in just prior to paving is the slotted drain. Some of the perimeter drains tie into the drainage system; others are handled with overland flow.
The stockpiling area was discussed. The plan shows a 120’ X 120’ stockpile. John Sargent explained that there would be multiple piles. The Commission agreed to condition the stockpile area to require a row of double-staked hay bales and silt fence around the stockpiles.
Summary of updates needed:
Double-staked hay bales and silt fence around stockpiled areas.
Plan detail to include a notation that the stock piled areas will be closed off for weekends and heavy rains.
Include in the plans the proposal for riprap along riverbank.
The drainage of Brook Street was discussed. There will be two (2) double frame catch basins installed at the low point near the river. DPW and the neighbor approve the installation of the catch basins. They will grade to the existing driveways.
An abutter expressed concern for the Murphy Road drainage. The engineer explained that the catch basins will handle the runoff coming from Murphy Road and Brook St. John Sargent explained that the abutter has given permission to install rip rap a length of 24 ft. downstream along the bank, sized with heavy stone. The Commission required the riprap details to be shown on the plans. Joe required the slope to be at least 2:1. Jack stated that there would be no tree cutting necessary to get the equipment in there to re-grade and seed.

4-ft. diameter pipe discussed.
Sargent explained the additional submittal information provided regarding durability of the corrugated steel culvert pipe proposed for installation in the subterranean detention structure. Information was gathered from the National Corrugated Culvert Pipe Association and the Mass. Highway Department specs. The proposed pipe is expected to last 100 years. The water and salt aluminizes the pipe and prevents salt corrosion.
Marty Moran made a motion to close the hearing and issue a standard Order of Conditions contingent upon submittal of the revised plans, seconded by Paul Byrne with all in favor.
3.4 Continue discussion re: request for redline revision to DEP 190-412
Dale & Kathy Mikere, 310 Cox St.
Revision reduces the size of the proposed garage, and also reduces the proposed fill area in the floodplain and changes the location of the compensatory storage area.
Plans were revised to depict color-coded changes.
Marty Moran made a motion to accept the new redline plan dated 5/3/05 as a minor revision, seconded by Joe Rodrigues with all in favor.
3.5 Request for Determination (HUD #302)
Applicant: Larry Rummerfield
Location: 6 Tiffany Lane
Project Description: construct a stone wall length 20' and back fill and
construct a 10' X 12' shed within 35 ft of the intermittent stream.
Katrina Proctor updated the Commission on past events. Mr. Rummerfield filed for a Building Permit for a shed and stone wall and Proctor required that he file with the Commission. The abutter at 4 Tiffany Lane called with concerns that Mr. Rummerfield has made other improvements to his property without filing with the Commission. In August 2004, Mr. Rummerfield graded his yard up to the boulders without a Conservation permit. A carport was also constructed.
KP has inspected the property and described the site to the Commission. The resource area in question is an intermittent stream and a narrow swath of Bordering Vegetated Wetland, which traverses his property. The Commission received a letter from David Dykes, abutter at 4 Tiffany Lane and explained the contents to Mr. Rummerfield. Mr. Dykes was concerned that activities come under the Wetlands Protection Act come before the Conservation Commission.
Marty Moran made a motion to issue a negative determination on the proposed project with the condition that the top of the wall be constructed 6” above the ground to contain run off, seconded by Joe Rodrigues with all in favor.
3.6 Notice of Intent (No DEP # ISSUED YET)
Applicant: Mary L. Kelly
Location: 7 Worcester Ave.
Project Description: construction of an addition to the existing house including a septic system upgrade and site grading.
The house is on town water, shingle roof and slab foundation.
Marty Moran made a motion to close the hearing and issue the standard conditions - short version, seconded by Paul Byrne with all in favor.

4.10 Assabet River Rail Trail – Paul Byrne requested that a letter be sent to the contractor requiring the fill material to be removed immediately from the stockpiled area on Wilkens St. As noted previously, the excavate is contaminated and the stockpiled adjacent to wetlands which was not proposed or approved in the Order of Conditions and this is a additional special concern because of proximity to wetlands and an area of estimated habitat for rare and endangered species (NHESP MAP). Marty Moran spoke to the contractor in April and was told the material would be removed soon. Proctor will send a letter to the contractor as requested.
4.11 Coolidge St. – Paramount Construction (Todd Marsh)
The Commission talked with Steve Poole, Consolidated Design engineer/representative of Todd Marsh about the site and Order of Conditions. Steve said that the owner would be taking the debris off site. Proctor will check with DEP to find out about the Commission’s authority to require heavy equipment to be removed from the Buffer Zone. Proctor will also check with the Building Inspector to see if he has any authority over the issue. Poole said that they would be filing with the commission for a temporary contractor’s garage. The Commission stated that it is the obligation of the owner to seed lot 1 per the Order of Conditions. Poole agreed that the area needs to be hydroseeded. The Commission stated that removal of debris and hydroseeding must be
done within 2 weeks.
