Minutes of Meeting -- April 3, 2003
A meeting of the Hudson Conservation Commission was held in the Hudson Town Hall, 78 Main Street, Hudson, Massachusetts.  At 7:00 p.m., Chairman Martin Moran called the assembly to order.
Present were:   Martin Moran, Jose Rodrigues, Judith Sabourin, Minot Wood, David Esteves, William Brochu and John Sturgis



5 Worcester Avenue    (NOI, Cont.)



    Present was:     Steve Poole, Consolidated Design Group

Mr. Poole presented updated plans to the Commission.  The furthest away the house can go is twenty feet from the lake.  He now needs to go to the ZBA to reconstruct the house.  The filing date is April 16th so he would like an order of condition and a letter recommending moving the house before the filing date.

The Commission would like a planting strip along the edge of the retaining wall as a buffer.

Minot Wood, seconded by Joe Rodrigues, made a motion to close the public hearing and issue an Order of Conditions for 5 Worcester Ave in accordance with the plan entitled “Conservation Filing Plan 5 Worcester Avenue Hudson, MA” s drawn by Consolidated Design Group of Hudson, MA dated Marc 11, 2003 and revised March 31, 2003 with the following conditions:

18.  A five-foot buffer consisting of a small berm with shrubs shall be built along the top of the retaining wall abutting the lake.

19.  Prior to the beginning of work, the applicant shall:
    a.  Properly install all siltation controls according to the plans approved by the Conservation Commission.
    b.  Provide the Board & Committee Coordinator with the name and telephone number in writing, of the                 person who will be immediately responsible for supervision of all work on the project site and                         compliance with this Order of Conditions.  The Board & Committee Coordinator shall be notified in the             event that the site supervisor or contractor is changed.
    c.  Clearly mark the limits of work in the field and instruct all workers not to work beyond the limits.

    d.  Notify Board & Committee Coordinator of the date upon which work will commence.

20.  No excavated material shall be disposed of in violation of any local, state, or federal laws.  All stumps must be removed from the site; no burying of stumps on site is permitted.
21.  The Conservation Commission shall be notified in writing at the time of any transfer in the title to the property or any change in contractor/developers prior to issuance of the Certificate of Compliance.  The name, address, and telephone number of the new owner shall be included in the notification as well as certification that the new owner has been provided with a copy of this Order of Conditions.
22.  Prior to the issuance of a Certificate of Compliance, the site shall be stabilized with vegetation or other measures approved by the Conservation Commission.
23.  Prior to the issuance of a Certificate of Compliance and after the site has been stabilized; all erosion controls shall be removed from the site.
24.  Prior to the issuance of a Certificate of Compliance, the applicant shall submit to the Conservation Commission for review and approval an as-built plan and a letter of compliance stamped by a registered professional engineer.  Said plan and letter shall show that all conditions of this Order have been complied with in a satisfactory manner.
Vote:   6-0-1 with David Esteves abstaining

Martin Moran, seconded by Joe Rodrigues, made a motion to write a letter to the Zoning Board of Appeals indicating the Commission’s support of moving the house at 5 Worcester Avenue because it is better for the lake if the house is further away from it.

Vote:   7-0-0 unanimous




Falls Brook




Mr. Ansari explained that the footings for the retaining walls do not have adequate cover.  He would like to go in and put some fill to cover the walls to protect them in the winters.  There would be some encroachment on the wetlands.  The Commission indicated that the walls should have been built correctly in the first place.  If there was a problem, the Commission feels that Mr. Ansari should have come before them as soon as the problem was noticed.

The Commission stated that Mr. Ansari can not touch anymore of the wetlands.  He needs to find an alternative means to correct his problem.  The Commission would like to see a new plan before any work is done or any fill is placed.

Martin Moran, seconded by David Esteves, made a motion stating that no more wetlands can be filled in the Falls Brook subdivision and that Mr. Ansari must find an alternative means to complete the walls to the satisfaction of the Building Commissioner.

Vote:   6-0-1 with John Sturgis abstaining

Minot Wood, seconded by Martin Moran, made a motion to write a letter to Jeff Wood, Building Commissioner, indicating that there will be no more filling of the wetlands at the Falls Brook subdivision and asking his input regarding what needs to be done to the walls.

Vote:   7-0-0 unanimous




Forest Avenue School Poster




John Sturgis presented a poster from the 4th grade at Forest Avenue School.  The class identified all the wetland species and put them on a terrific poster.                                                                            
John Sturgis, seconded by Martin Moran, made a motion to write a thank you letter to the 4th grade at Forest Avenue School for the wetland poster they presented to the Commission.

Vote:   7-0-0 unanimous




Walmart




Judith Sabourin, seconded by Martin Moran, made a motion to write a letter to Walmart to clean up the slopes around the store including the foot of the slope and the wetlands.

Vote:   7-0-0 unanimous




Minutes




Martin Moran, seconded by John Sturgis, made a motion to approve the minutes of the March 20, 2003 meeting as written.

Vote:   6-0-1 with David Esteves abstaining

At 8:00 p.m., John Sturgis, seconded by Minot Wood, made a motion to adjourn the meeting.
