Meeting Minutes
August 4, 2005, 7:30 P.M.
1.0     Preliminaries
1.1.    Dale Nadeau opened the meeting at 7:30 PM.
1.2.    Roll Call:  Chairman Dale Nadeau, Vice-Chairman James Saart, Clerk Dan Ehntholt.  Administrator Katrina Proctor absent due to attendance at a Conservation Commission meeting.
1.3.    Additions or deletions to the agenda

2.0     Hearings and Appointments
2.1     7:30 p.m. - Application for Massagist Permit Jini Yu
Jini Yu explained that she will be practicing on Market Street at Sereni Salon & Wellness Center.  She explained that she stopped practicing in Leominster at a spa.  She attended the Salter School in Tewksbury.  Dale Nadeau noted that the present regulation allows an individual only to practice on same sex gender and if she would like to service both genders a variance must be granted.  Mr. Nadeau asked Ms. Yu if she would like to request the variance.  Jini Yu requested the variance.

James Saart made a motion to approve the Massagist Permit to Jini Yu and also allow the variance to service both genders, seconded by James Saart with all in favor.  Permit granted. Approved 3-0.

3.0     Minutes
3.1     July 13, 2005 Dan Ehntholt made a motion to approve the minutes of July 13, 2005, seconded by Dale Nadeau with all in favor.  Approved 3-0

4.0     Vouchers – James Saart made a motion to approve the vouchers listed below, seconded by Dan Ehntholt with all in favor.  Approved 3-0
4.1     Microbac $20
4.2     MAHB – Annual Dues $100.00
4.3     John Scichilone $35.00, 29 Bennett St.
4.4     John Scichilone $35.00, 34 High St.
4.5     FY’05 year end operating budget expense ledger – NOTED.

5.0     Review Septic Permits
5.1     Sauta Farms tight tank – James Saart made a motion to issue the septic permit, with the condition that weekly or every other week inspection must be submitted to the Board of Health so that pumping of the tank at 75% capacity is not overlooked, seconded by Dan Ehntholt with all in favor.
5.2     65 Murphy Rd. –James Saart made a motion to issue the septic permit, seconded by Dan Ehntholt with all in favor.
5.3     19 Rock Ave. – James Saart made a motion to issue the septic permit with the waivers requested, seconded by Dan Ehntholt with all in favor.
5.4     6 Wilkins St. –James Saart made a motion to issue the septic permit, seconded by Dan Ehntholt with all in favor.
5.5     Lot 9 Elaine Circle –James Saart made a motion to issue the septic permit, seconded by Dan Ehntholt with all in favor.
5.6     20 Lakeside Ave. –James Saart made a motion to issue the septic permit, seconded by Dan Ehntholt with all in favor.
5.7     14 Rock Ave. –James Saart made a motion to issue the septic permit, seconded by Dan Ehntholt with all in favor.

6.0     General Business
6.1     FY’06 Municipal Waste Grant and Information Sessions – Missed the deadline.
6.2     Mass Highway – notification of herbicide application along state highways on 8/10/05 – 9/30/05 – NOTED.
6.3     Incident Command For Public Health Training – James Saart made a motion to approve the Incident Command Public Health Training for Ehntholt, Proctor and Wong, seconded by Dale Nadeau with all in favor.
6.4     ZBA Request for Comments – Michael & Karen Sanford, 10 Herman Circle – addition in the floodplain.  The Board will send comments to the ZBA as follows. The Board of Health did not have sufficient information as to whether this property has a septic system or is connected to town sewer.  If 10 Herman Circle has a septic system, the Board requires a review of the septic system plan to make certain that there is no impact on the septic system.
6.5     Planning Board Request for Comments – 43 Brigham St. – preliminary subdivision plans.  Dan Ehntholt made a motion to send a letter to the Planning Board requesting that the Planning Board does not approve the preliminary plan until additional information is provided to the Board of Health regarding soil suitability in the area.  The motion was seconded by James Saart with all in favor.
6.6     The next Board of Health meeting was scheduled for August 25, 2005.
7.0     Correspondence – NOTED.
7.1     Mass DPH – The Reporter Volume 25 Spring/Summer 2005 – Dan Enthnolt will take a look at this.
7.2     Health Agent’s letters – NOTED.
7.2.1   Re:  Proposed Dunkin Donuts at 422 Main St.
7.2.2   Re:  trash, junk and rubbish abandoned on the property by the side of the house, 34 High St.
7.2.3   Re:  181 Chapin Rd. – sanitary code
7.2.4   Re:  50 Broad St. – sanitary code
8.0     Pending – NOTED.
8.1     Memorandum of Understanding
8.2     Nondisclosure Agreement, Emergency Preparedness
9.0     Advertisements and Conferences – NOTED.
9.1     Hearing for Tobacco Control Regulations – September 14, 2005
9.2     Proctor will attend American Public Health Association Annual Meeting November 5 – 9th.
10.0    Commentary
11.0    Adjournment - James Saart made a motion to adjourn the meeting at 8:15 pm, seconded by Dan Ehntholt with all in favor.
