Brian was represented by Roger Woods, surveyor.
Larry Smith, a PVPC land use and zoning specialist attended the meeting as
requested by the Board.
It was determined that in 1957, lots (1) and (8) were conveyed out of a master plan of lots owned by Karl G. Bopp.
It was also noted that zoning changes were proposed at a town meeting in 1975 and approved in 1976 at a Town Meeting. In 1975 - 1976 both lots in question, (lots 1 and 8) were in common ownership. Lot (1) had a building used as a business located on it and lot (8) was a building lot. There are no restrictions of having a house and business on the same lot. The lots were sold to Brian Johnson by Walter and Edna
Woods on July 19, 2001. On June 28, 2004, the lots were sold by Brian Johnson to himself and his wife, Kristen Johnson. The applicant wants to convert the existing garage into an accessory apartment. There is nothing in The Holland Schedule of Principal Uses, Number 17, Land Use Classification (Accessory Building) that prevents an accessory dwelling in a detached building in either a residential or business zoning district by
special permit. Mr. Smith stated, “this is an example of a pre-conforming use on a non-conforming lot”. Section 7.03 suggests that the accessory building is neither non-conforming in use nor non-conforming in structure. The building meets current setback requirements.
Mr. Smith noted that “it is the responsibility of the Planning Board to issue a special permit” in this case. Mr. Smith recommended that Brian Johnson withdraw his application without prejudice, and apply to the Planning Board for a Special Permit for approval to use the existing garage for an apartment.
At 8:00 PM Brian Johnson submitted a request to withdraw his application without prejudice. Fred made a motion to close the hearing. Ron Seaburg seconded the motion. Voting in favor of the motion were: Fred Beaulieu, Don Beal, Ron Seaburg, Tom Kenney.
Not voting: Rick Lundin.

The applicants want to add a second floor onto the existing home. Fred noted that the

hearing must be closed by March 20, 2015.
The hearing was re-scheduled for March 10, at 7:30 PM.
