Holland Conservation Commission
Minutes of Commission meeting held on April 10, 2012.
Present: Nathan Gumlaw, Chairperson, Marcia Beal, Neal Byrne, Patricia Caron and Marianne Martone. Absent: Mary Lovett.
Chairperson called the meeting to order. The minutes of March 27, 2012 were read and accepted and will be distributed.
7:00 – 8:00 p.m. We discussed the merits of hiring Angela C. Panaccione of Brimfield as our Conservation Commission Agent. An interview has yet to be scheduled.
We received a phone call from Karen Drudi of 330 Mashapaug Rd. stating that the “Registry of Deeds did not accept a copy of her Order of Conditions. Would we please reissue?” Members signed the reissued Order of Conditions, DEP File #184-0267.
We discussed the 221 & 225 Mashapaug Rd. right of way in preparation of the meeting with the Hunt and Libretto families.
8:00 p.m. Tracy and William Libretto of 221 Mashapaug Rd., Kathleen E. Hunt and Michael Ford of 225 Mashapaug Rd. and Robert Pellicare and Megan Bocian of 223 Mashapaug Rd. came in response to the Certified Letters sent on March 21, 2012 regarding the altering of the area in the right of way bordering their properties. Pictures taken by Mark Stinson, Circuit Rider of the DEP and Karen Hirschberg of the DEP as well as those taken by Board members were presented and discussed. The Board informed them that they were in violation of the Wetlands Protection Act, G.L.c131 para. 40and its regulations at 310 CMR 10.00 which necessitates our sending them an Enforcement Order that would then require them to hire a Wetlands Consultant to figure the actual resource area boundaries, then figure out what was
the unpermitted alteration and to come up with a plan for restoring those resource areas. We gave them Mark Stinson’s phone number who would clarify the situation and possibly recommend a list of Wetlands Consultants.
The meeting was adjourned at 9:05 p.m.
