Holland Conservation Commission

Minutes of Commission meeting held on July 26, 2011.

Present: Mary vandenBerg, Chairperson, Marcia Beal, Patricia Caron, Nathan Gumlaw, Mary Lovett, Marianne Martone and James Wettlaufer.

Chairperson called the meeting to order.  The minutes of the July 12, 2011 meeting were read and accepted and will be distributed.

Mary vandenBerg submitted her letter of resignation effective Wednesday, July 27, 2011.

We received from Robert J. McCollum, Wetlands Section Chief, a letter in reference to the Administrative Consent Order with Penalty (ACOP), where we hosted a seminar for neighboring town Public Works Departments to educate them in the requirements of the Massachusetts Wetlands Protection Act.  “The Mass DEP finds you have substantially completed the requirements of the ACOP”.

We received an email memo from Mark J. Beglane of Bacon, Wilson, P.C. requesting that a memo should be sent to all town departments informing them that lots 1 and 2 (Mashapaug Rd.) do not have any current rights to use either Chaffee or Chandler Rds. as a driveway to their property so that in the future should the owner of lot 1 or 2 seek some sort of subdivision or permit based on the use of the aforementioned roads as access, that such permit or subdivision be denied until the aforementioned roads are made public or easement rights are obtained from the owners.

Members signed the Order of Conditions for Peter Woodward of 39 Craig Rd., DEP File #184-0260 to repair a septic system.

Gena and Carlo Delizia recently purchased property at 25 Candlewood Dr. and are concerned with a neighbor who lives at 24 Candlewood Dr. who has cut some 20 trees off lakeside property owned by others.  They brought in several pictures in evidence.  The HCC will obtain, using the Virtual Town Hall Assessor’s web site, to identify this individual and send a letter informing him that he is in violation of the Wetlands Protection Act by cutting trees 100’ from the Hamilton Reservoir and requesting him to appear before the Commission.  James Wettlaufer suggested that the DEP be notified as well.

7:50 p.m.  Procedure Sheet #2008-1471 issued to Lorraine and William Magnotta of 39 Vinton Rd., Map R9-A-3, lot #3 was presented by applicant Matthew LaCroix of DBA Breaking Ground Excavation.  Their project is to: 1) reconstruct existing landscape block wall  50’ L x 8’ H in  rear of property; 2) removal of timber wall at water’s edge to be replaced with a “Monumental Bloc” wall (blocks weigh 780 lbs. each) manufactured by Techo-Bloc.  They were informed that a Notice of Intent would be required for the lakefront wall – forms were given.  Permission was given to proceed with the rear of the property wall since it is not a Conservation issue.

8:15 p.m.  The scheduled Public Hearing of a Notice of Intent for Richard Polverari of 7 Sunset Ln., DEP File #184-0261 to repair his deteriorating lake front wall was held.  Present was his wife Kathleen Polverari.  No abutters came.  Richard presented his project.  Pat Caron made a motion to accept the project, seconded by Nathan Gumlaw and all were in favor of closing the Hearing at 8:25.

The meeting was adjourned at 8:45 p.m.
