Minutes of Commission meeting held on November 10, 2009.
~
Present:  Mary vandenBerg, Chairperson, Marcia Beal, Patricia Caron, Nathan Gumlaw and James Wettlaufer.

Chairperson called the meeting to order.

The Minutes of October 27, 2009 were read and accepted and will be distributed.

Mary vandenBerg reported on the site visit with the DEP to the Fenton St. and Kimball Hill Rd. areas with Robert McCollum and Mark Stinson on Wednesday, October 28, 2009 at 2:00 p.m.  Also present were Lynn Arnold, Chairperson of the Lake Oversight Committee and Pat Caron, Secretary of the HCC.  We are presently waiting for GeoSyntec’s updated plans.

We discussed the James LaMountain and Northeast Concepts Inc. trial and judgment.

Mary vandenBerg will call Robert McCollum of the DEP regarding the piling of firewood on the LaMountain beach property and the continued lumbering, which is in violation of the court order.

We received from New England Land and Lumber an Order of Resources Area Delineation requesting an extension originally issued 11-1-2005 and re-issued on October 7, 2008.  Following discussion, members signed the form.

7:45 p.m.  Andy Harhay of 430 Mashapaug Rd. presented pictures of his cove.  He would like Escape Estates to remove the stumps, large rocks and muck and inquired as to the process.  He was informed a Notice of Intent would be required.

8:05 p.m.  Lynn Arnold of 9 Shore Drive spoke of the cement ramp at the boat launch as having at least 4 inches of road sand and 2 large sand bars, making it very difficult to launch boats on the only public access to the lake on the South side.  She spoke with Brian Johnson of the Highway Department who agreed to removing the sand with a rented excavator if the Conservation Commission approved. The Hamilton Reservoir Association (HRA) has agreed to pay for the rental of the equipment.   Following discussion, members signed the Emergency Certification Form.

8:25 p.m.  Anna Julian of 30 Long Hill Rd. spoke of her concerns regarding the logging being done on Morse Rd./East Brimfield Rd. which she was informed was done by the Army Corps of Engineers.  The HCC was never consulted.  She stated also that she had been informed that 2 more lots along Lake Siog were planned to be cleared.  Mary vandenBerg will inform the DEP and Anna Julian was going to call our State representatives.

We received a Forest Cutting Plan approved by Agent Harry Wandekoski for the Palmer Beagle Club of Bennett Rd. for 40 acres.   

The meeting was adjourned at 8:50 p.m.
