Holland Conservation Commission

Minutes of Commission meeting held on January 13, 2009.

Present:  Mary vandenBerg, Chairperson, Patricia Caron and Howard Fife.  Appointed Candidate:  Marcia Beal.  Absent: Nathan Gumlaw, Appointed Candidate, and James Wettlaufer.

7:05 p.m.  Chairperson called the meeting to order.

The Minutes of December 23, 2008 were read and accepted and will be distributed.

At the Select board Meeting on January 6, 2009 Marcia Beal and Nathan Gumlaw were appointed by the Selectmen to the Conservation Commission.

We received from the DEP a copy sent on December 30, 2008 to James LaMountain of Huguenot Farms regarding the DEP Wetlands File #184-230, Request for Superseding Conditions stating “The Department and Attorney General’s Office are presently engaged in enforcement actions regarding certain activities that have been undertaken on the subject property.  The future status of those pending matters could affect your ability to proceed with, and the Department’s decision regarding, the subject Request for Superseding Order of Conditions (DEP Wetlands File #184-230).  The Department is therefore exercising its discretion under 310 CMR 4.04 (e) 2 to extend the time periods for Departmental action.  The Department is hereby notifying you that it is suspending review of the request for Superseding Order of Conditions for Wetland File #184-230 in accordance with 310 CMR 4.04 (e) 2.

We received from the Department of Conservation and Recreation (DCR) a copy of a letter sent on December 31, 2008 to Chad Brigham, President; James LaMountain, Director of Northeast Concept, Inc.; and James LaMountain, President of Huguenot Farms, a STOP ORDER stating “the Department of Conservation and Recreation hereby orders you to cease and desist immediately from all forest cutting and related operations on the property (File No. 135-2599-7) off Mashapaug Rd.  Without limiting its terms, this Stop Order is applicable individually, and your business organization, your employees, agents, contractor and any other persons conducting activities on the property.  Included within this Stop Order, the Department hereby revokes the prior approval of the Forest Cutting Plan.  This Stop Order, including the revocation of the Forest Cutting Plan approval, is effective immediately.”

We received from Andrew Harhay, a copy confirming the recorded Certificate of Compliance for project DEP File #184-0205 at 430 Mashapaug Rd.

Mary vandenBerg completed the Conservation Commission 2010 Budget Request to be given to the Finance Committee.

No petitioners came.

The meeting was adjourned at 8:00 p.m.
