Minutes of Commission meeting held on November 25, 2008.

Present: Mary Vandenberg, Chairperson, Patricia Caron, Howard Fife and James Wettlaufer. Observer: Nathan
Gum law.
7:05 p.m. Chairperson called the meeting to order.
The Minutes of October 28, 2008 were read and accepted. The Minutes of November 18, 2008 were amended to read:
James Wettlaufer recused himself since he and Howard Fife have a conflict of interest under State Ethics Law. No discussion of the November 1, 2008 site visit to the LaMountain property was done as a result. They are awaiting a ruling from the ethics committee.
7:10 p.m. We received from John Jacobi, Chairman of the Board of Health, a copy of their document “Guidelines for the Management of Onsite Decentralized Wastewater Systems in Holland MA”. Copies are to be reviewed and discussed at the
December 9th, 2008 meeting.
Mary vandenBerg reports having received a letter from John Jacoby of the Board of Health inquiring if a Request for Determination of Applicability (RDA) or a Notice of Intent (NOI) has been filed for the construction of a “Farmers Porch” on lots 6 and 7 on Cove Rd. Motion was made to pass on the information to Jack Keogh, Building Inspector.
She received a letter from Matthieu J. Massengill, P.C. who represents Gary Cavaliere who recently purchased property at 22
Brandon St. is concerned with the engineering and appearance of the new septic system. Mary vanbenBerg did a site visit and
found erosion control (silt fences) were still in place. Motion was made by James Wettlaufer that since the site plans have been
followed and a site visit having been done, that a letter be written informing Mr. Massengill that he should bring his concerns to
the Board of Health who are the authority in this matter. Seconded by Howard Fife and approved by all.
7:30 p.m. The Public Hearing for Richard Righetti of 47 Shore Dr., map R-2-A-18 to construct a 16 x 24 foot garage was held. No abutters came. Following discussion, Mary vandenBerg made a motion for a Negative Determination. Seconded by Pat Caron and all were in favor of closing the Hearing at 7:40 p.m. Members signed the Determination of Applicability and Mary vandenBerg signed Procedure Sheet #2008-1289.
8:00 p.m. The continued Public Hearing for a Notice of Intent for Northeast Concepts/Huguenot Farm, Michael LaMountain, DEP File #184-0230, Map 10-A-16, to “grade and pave driveway apron at 00 Mashapaug Rd., for farmhouse outside resource areas and buffers” was held. Present were James LaMountain, Peter Frei, Chad and Janice Brigham. Immediately following Mary vandenBerg’s opening the Hearing, James Wettlaufer announced that under advice of Counsel, he and Howard Fife cannot be
present nor hold any discussion concerning this Notice of Intent hearing, until a written statement from the Ethics Commission is
received. Mary vandenBerg then announced that the Hearing needs to be continued to a further date due to a lack of a quorum, and that they do have the option in the interim to apply to the DEP for a Superseding Order.
8:10 p.m. Aware that we lacked a quorum, Janice Brigham presented an application form for “Agricultural Preservation Restriction (APR) Program” which was accepted, stamped and dated by the Secretary but not acted upon.
Lacking a quorum, the meeting was adjourned at 8:15 p.m.
