Holland Conservation Commission

Minutes of Commission meeting held on June 6, 2006.

Present: Mary vandenBerg, Chairperson, Steven Anderstrom, Patricia Caron, and Rolf Hilbig. Absent: Howard Fife, Ann Hall and James Wettlaufer.

7:00 p.m. Chairperson called the meeting to order.

7:05 p.m. Minutes of Commission Meeting held on May 23, 2006 were read, accepted and will be distributed. No meeting was held on May 30, 2006 - Annual Town Meeting.

Members signed:

1 – Determination of Applicability for Gerald Joyal of 13 Massaconnic Trail for installation of holding tank.
2 – Determination of Applicability for Peter Schartner of 44 Over The Top Rd. for the installation of a tight tank.
3 – Enforcement Order to Michael J. LaMountain of 14 Lakeridge Dr. for the removal of vegetation within both the inner and outer riparian zones of Amber Brook.
4 – Vendor Voucher to MACC for $65.00 for the publication of “2006 Environmental Handbook for Massachusetts Conservation Commissioners”.
5 – Vendor Voucher paying the Republican for Legal Ads of Christopher Batista - $36.00; Charles Petit - $36.00; Peter Schartner - $38.00; Gerald Joyal - $36.00 and Francis Gregoire - $38.00.

Agent Howard Fife’s Report:

On 6-2-2006 met with Tim McKenna DEP,
1. Reviewed Alexander/Allen Hill property. He feels we are on the right track now. Lot 9 house lot area is going to affect the buffer zone.
2. Passed by and discussed LaMountain property. He claimed agricultural exemption as reason for not filing for work being done. There is no agricultural exemption for a new farm. Advised an Enforcement Order requiring a Request for Determination.
3. Looked at Bunn’s crossing. McKenna suggested the use of a culvert through the approach fill to allow floodwaters to pass under the fill.
On 6-5-2006 met with Andre Cormier regarding the Butterworth Rd. Detention Basins – Plans to meet with the HCC on 6-6-06.

7:30 p.m. Francis Gregoire’s Public Hearing of a Notice of Intent to build a single-family home at Wales Rd., DEP File # 184-0202 was held. Present were Francis Gregoire, his Mother Dorothy Gregoire and Keith Terry of Sherman and Frydryk, Land Surveying and Engineering. Mary vandenBerg suggested that a trench to the house should be dug before the drilling of the well. Following discussion, motion was made to accept this project. Motion accepted and all parties were in favor of closing the hearing at 7:50 p.m. Francis Gregoire gave us a $50.00 check paying for his Legal Ad.

7:55 p.m. Joel Jette, contractor sought our opinion regarding a 12 ft. addition for Peter Uldrich of 4 Lakeshore Dr. He was given Notice of Intent forms.

8:15 p.m. William Kane and Janice Henry are considering purchasing a house at 49 Kimball Hill Rd. They are aware of water in the cellar due to a crack in the foundation and are unable to question the owner because he died and wandered if we could enlighten them. Our only suggestion was that perhaps they could contact the original owner. A French trench was also suggested.

8:30 p.m. Procedure Sheet #2006-1084 issued to Carol and Donald Beam of 4 Shore Ln. R-01-A-08 was presented by David Buccelli for the removal of 5 pine trees. Motion to accept the project was made and accepted by all. Mary vandenBerg signed the Procedure Sheet.
8:45 p.m. Andre Cormier, Jr. of Escape Estates spoke of re-designing the retention basins on lot 7 and 8 and 3 and 4 on Butterworth Rd. to follow the natural contour rather than cutting trees. The basins would contain the same volume of water as the originals. He also spoke of the Open Space to protect the wetlands in the 14 acres on Butterworth Rd. that will be placed in a 501C3 land trust which is now being drawn up by an attorney.
He also brought us a recorded Order of Conditions for Lot 7, Butterworth Rd. – Mary vandenBerg signed the Procedure Sheet.
We all approved of Mary vandenBerg signing the Procedure Sheet for Lot 12, Butterworth Rd. when presented.

Motion to adjourn made by Rolf Hilbig, seconded and approved by all. Meeting adjourned at 9:15 p.m.
