ZONING BOARD OF APPEALS
HEARING
CATHERINE ESKA                                                                                           Case No. V 1315
 
The Zoning Board of Appeals held a public hearing on January 9, 2014 at 7:45 p.m. in Memorial Hall in the Town Hall, 1196 Main Street, Holden, MA on a Variance request for relief from front and side setback requirements in order to build a two-car attached garage

Members in attendance:  R. Spakauskas, S. Annunziata, R. Fraser, F. Lonardo and R. Butler.        

The Chairman called the hearing to order.  The Secretary read one letter from Isabel McCauley, Senior Civil Engineer for the Town of Holden.  She was of the opinion that the proposed variance had no effect on the Town’s public works infrastructure.

F. Lonardo asked what zone this was in and it was answered R-1.  He asked if this request should have been a special permit rather than a variance because it is non-conforming.  Discussion followed.

S. Annunziata said it appeared the applicant intends to also build a deck and a porch and, there-fore, asked the applicant for clarification on the plan she submitted.  

Joseph Boulanger, 1567 Main Street, asked which side of the house Ms. Eska planned to build her garage, as he is a direct abutter.  She answered it would be on the easterly side.

Due to the fact that there were no further comments or questions, the public hearing was closed at 9:00 p.m.

The Board voted unanimously to approve the variance with the following conditions:  1)  The applicant must adhere to Plan 693-2 dated November 22, 2013 which was submitted with the application;  2)  The garage will be no closer than 26 feet, +/- one foot, to the front yard setback requirement;  and 3)  The garage will be no closer than 14 feet, +/- one foot to the easterly side lot line setback requirement.
