ZONING BOARD OF APPEALS
HEARING

Michael Himmer                                                                                                CASE NO.  V 1402

The Zoning Board of Appeals held a public hearing on April 10, 2014 at 7:30 p.m. in Memorial Hall in the Town Hall, 1196 Main Street, Holden, MA on the Petition of Michael Himmer for property located at 13 Colorado Drive for a VARIANCE for relief from side yard and frontage setback requirements and relief for existing non-conforming lot for an addition.

Members in attendance:  R. Spakauskas, S. Annunziata, R. Fraser, J. Deignan and F. Lonardo.

The Chairman called the hearing to order.  The secretary read the application and Findings of Fact.  

Mr. Himmer addressed the Board.  He would like to remain in the neighborhood that he currently lives in.  However, a variance would be needed to expand with an additional bedroom and garage.  

F. Lonardo asked if Mr. Himmer had spoken with the Building Commissioner prior to applying for this variance because he questioned why this would require a variance and not a special permit.  Discussion ensued between the Board and Dennis Lipka, Building Commissioner.

D. Lipka said the hardship is the shape of the lot and by the Town of Holden changing the Zoning Bylaws.

Mr. William Hurwitz, 16 Colorado Drive, spoke in favor of granting this variance to Mr. Himmer.

Since there were no further comments or questions, the public hearing was closed at 7:50 p.m.

The Board voted unanimously to grant the variance with the following condition:  1)  An as-built plan is required to be given to the Building Department prior to the applicant receiving an occupancy permit.
