ZONING BOARD OF APPEALS

STEVEN & LOREE BONCZEK                                                                           CASE NO. V 1401
 
The Zoning Board of Appeals held a public hearing on April 10, 2014 at 7:15 p.m. in Memorial Hall in the Town Hall, 1196 Main Street, Holden, MA on the Petition of Steven & Loree Bonczek for property located at 8 Spring Street for a VARIANCE for relief from exterior side yard setback requirements in order to install an above ground pool.                             

Members in attendance:  R. Spakauskas, S. Annunziata, R. Fraser, J. Deignan and R. Butler.

The Chairman called the hearing to order.  R. Fraser made a motion to waive the reading of the application due to the fact that there was no one from the public in attendance other than the applicant.  R. Butler seconded.  Vote 5-0, motion approved.

R. Spakauskas questioned the height of the fence.  Mr. Bonczek said in his application he incorrectly noted the fence being eight (8) ft, when it should have been six (6) feet.  The Board agreed to make this change.  

The applicant distributed a picture to the Board indicating the pool would not impede site distance.    His property is long and narrow and if the pool is placed anywhere else, it will result in cutting the yard in half.

J. Deignan said he drove by this property and one other house on the street; he felt that ten (10) ft. might be a little tight.

Dennis Lipka, Building Commissioner, has spoken with the applicants in the past.  They have looked at all other options.  This is a corner lot with two (2) frontages and two (2) sidelines.

Since there were no further comments or questions, the public hearing was closed at 7:35 p.m.

The Board voted unanimously to approve the variance request.
