The Zoning Board of appeals held a public hearing on Thursday, March 30, 2006 at 7:00 p.m. in Memorial Hall, 1196 Main Street, Holden, MA on the Petition of Robert w. Fitzgerald Jr. for property located at 45 Walnut Terrace for a Variance for relief from side yard setback requirements to be six (6) feet from the property line for the purpose of constructing a second garage bay and expanding the 2nd floor of the garage to an unfinished loft. Members of the Board in attendance: Ronald Spakauskas, Ronald Oslebo, Jack LaPrade, Roy Fraser and James Deignan.

The Chairman called the hearing to order. Since there were no objections, reading of the legal notice and list of abutters was waived. Due to the fact that there was no one from the public in attendance, R. Fraser made a motion for the secretary to waive the readings of the Application and Findings of Fact. R. Oslebo seconded. Vote 5-0, motion approved.

R. Oslebo asked the applicant how long he has owned the house; it was answered about 12 years. It was also confirmed that the property is connected to the town sewer system. R. Oslebo also asked the distance of the house on the right hand side; Mr. Fitzgerald said it is approximately 68 feet from the corner to his house.

The applicant then addressed the Board. He currently has walk-up stairs to the attic and would like to expand to make it into a cape, similar to the other houses on the street. His two daughters, 8 and 10 years old currently sleep in one bedroom. J. LaPrade asked about the distance of the house on the other side; Mr. Fitzgerald answered approximately 50 feet.

R. Spakauskas asked what is located on the right side of the house where the garage currently is; it was answered the kitchen which will remain the same. The applicant would also like to make his one car garage large enough to accommodate two cars.

R. Oslebo questioned if the garage is now even with the front of the house; it comes out about 1 ½ feet. This change may make it set back about two feet.

Since there were no further comments or questions, the public hearing was officially closed at 7:25 p.m. The Board voted unanimously to approve the variance with the conditions: 1) The addition should be no closer than the six (6) ft. setback off the northeast side of the lot; 2) The northeast corner should be staked by a registered land surveyor. .
