Rice Holden, LLC       Case No. SP 0615, V 0616 and V 0617
                                                                                    
The Zoning Board of Appeals held a public hearing on December 14, 2006 at 7:00 p.m. in Memorial Hall, 1196 Main Street, Holden, MA on the Petition of Rice Holden, LLC for property located at 48 Phillips Road for a VARIANCE for relief from the single family zone requirement to allow for the creation of 28 condominium units, a VARIANCE for relief from the parking requirement such that six (6) fewer spaces would be provided rather than the number required by the Zoning Bylaw and a SPECIAL PERMIT to modify a pre-existing non-conforming structure.

Members of the Board in attendance:  Ronald Spakauskas, Ronald Oslebo, Silvio Annunziata, Roy Fraser and Fred Lonardo.  Jim Deignan, an Alternate Member of the Board attended the meeting.

The Chairman called the hearing to order.  The Board and the applicant agreed to waive the reading of the application. 

Attorney Patricia Finnegan Gates, representing the developer, summarized the applicant’s re­quest for variance relief and the special permit.  The objective of this application is to preserve the exterior of the building while re-using the building for its main use.

Since there were no further comments or questions, the public hearing was officially closed at 7:35 p.m.

The Board voted unanimously to grant the Special Permit #SP0615 and Variances #V0616 and #V0617 with the condition that 1) the applicant must secure a Site Plan Special Permit from the Holden Planning Board.
