Planning Board Meeting Minutes
April 13, 2010

7:00 PM the Planning Board meeting was called to order by W. Ritter.
PUBLIC HEARING, AMENDMENT TO ZONING BY-LAW: P. Harding read the Public Hearing notice into record. A copy of the Open Space Residential Design By-law, incorporating written comments from Town Counsel was in the Boards packets for review. Developers have been notified of the hearing. A final version of the By-law must be filed with the Town Clerk by April 28, 2010.
The Board also had a copy of a letter dated April 13, 2010 from Paul McManus, 14 Butternut Circle, in support of the By-law.
W. Ritter motioned to close the Public Hearing. J. Head seconded. All in favor.
A. Bonofiglio motioned to submit the By-law at Town Meeting. O. Lies seconded. Vote 5-0, all in favor.
AQUIFER PROTECTION BY-LAW: DPW updated the Aquifer Protection By-law and map to reflect current DEP requirements. DPW will attend the April 27th meeting to answer any questions the Board may have.
APPROVAL NOT REQUIRED - WAGNER MEADOWS, PRESERVATION LANE: The applicant is requesting approval for minor lot line adjustments for the Wagner Meadows subdivision. No new lots are being created and the adjustments will eliminate awkward angles. The plans have been reviewed by Engineering.
O. Lies motioned to approve. J. Head seconded. Vote 5-0, all in favor.
OTHER BUSINESS:
• Zoning Petition: There is a zoning petition for property at the intersection of Main/Broad down Broad Street to the Busy Bee nursery. The request is to change the zoning from R1 and R40 to Commercial.
• Implementation Committee: M. Wronski updated the Board regarding the Implementation Committee's meeting with the Holden Historical Commission. They would like to put the Jefferson Mill/Eagleville area in the National Register.
PUBLIC HEARING - DEFINITIVE SUBDIVISION AMENDMENT - STANJOY ESTATES: W. Ritter recused himself from the meeting at 7:15 pm, to avoid the appearance of a conflict of interest. A. Bonofiglio read the Public Hearing Notice into record. M. Wronski motioned to open the Public Hearing. J. Head seconded. All in favor.
Steve Mirick, representative for Stanjoy Estates, introduced the consultants on the project. They are requesting an amendment to: 1) change the detention pond from an underground system, to an above ground system, 2) the building footprints would be significanatly reduced, and 3) they are seeking to change both the name of the subdivision and street name. The applicant has also requested a waiver for the installation of a detention pond perimeter fence and the construction of sidewalk along the two frontage lots on Winter Hill Road. The detention pond is approximately 3.5 feet deep.
Paula Thompson, Waterman Design, conducted an overview of the changes, answering questions by the public and the Board. They want to change the detention pond to an open basin, built smaller homes, install rooftop infiltration systems, change the name to Winter Ridge, change the road names at a later time, and are proposing to install a partial foot-rail fence.
The only comment pending from Dan Hazen, DPW, is in regards to the extension of the detention pond outlet on the westerly property line.
Public Comments:
• Donroy Ferdinand, 10 Autumn Cir: Informed the Board that there is a lot of water that comes down off the hill. Paul Thompson explained how they would handle the design for run off at three (3) points.
• Bill Stanton, 162 Winter Hill Rd: Asked about the dimensions of the detention pond.
• Rene Brodeaur, 50 Autumn Cir: Has issues with the amount of water running onto her property.
• Dave Sabourin, 24 Autumn Cir: Concerned with the calculations and that more water is going to be directed onto his or his neighbors properties.
• Seth Trachtenberg, 42 Autumn Cir: Will testify that the neighbor has a stream in her backyard. P. Harding stated that Conservation and DPW have both reviewed the calculations and have found they show a decrease in runoff and meet stormwater management standards. The Town will be monitoring the project during construction and has the right to require remediation efforts.
O. Lies recommended that the Town Engineer be at the next Public Hearing to listen to the abutters concerns.
J. Head motioned to continue the Public Hearing for engineering to answer questions on April 27th. O. Lies seconded. All in favor.
• Bill Stanton, 162 Winter Hill Rd: Made a request that Dennis Lipka, Building Inspector, attend the next meeting because he knows the area, since he built Stanton's house.
OTHER BUSINESS:
• Highlands of Holden: O. Lies said that the two (2) light poles are still there on Newell Road. He was informed that one pole is for the temporary service.
• Post Office: O. Lies asked P. Harding to find out if the Post Office is completed.
• Stonewall: O. Lies inquired about what he heard on the radio about the Planning Board having to give permission for a stone wall to be moved. P. Harding didn't know of this.
