A.  CALL TO ORDER
Mayor Randall called the Special Meeting to order at 6:00PM.

City Commission present: Commissioners Carter, Carlton, and Roberts, Vice Mayor Surrency and Mayor Randall.

Staff Present: City Manager Smyth, City Clerk McGruder and Interim City Attorney Harris.

C.  AGENDA ITEM
1.  A Resolution of the City of Hawthorne, Florida Authorizing the City Manager to execute and submit the certificate of taxable value for FY 2010-11 to the Alachua County Property Appraiser.

City Clerk McGruder read the Resolution by title only.

City Manager Smyth- The rollback for FY 2010-11 is 6.1040.  That is based on capita rate income of 0.9811.  The maximum rate is 5.9865 mills.  The current year is 5.3194 mills and he is proposing it remains the same for the upcoming fiscal year.

Vice Mayor Surrency- Why do we have to set a maximum millage rate at 5.9865?

City Manager Smyth- It is state law.  We must adopt a maximum millage equal to the current year rolled back of 5.9864 mills.  By a majority vote the Commission may adopt a maximum millage rate equal to the current year roll back rate of 5.9864 mills, by  2/3 vote of the City Commission we can adopt a maximum millage up to 6.5850 mills, or unanimous vote up  to 6.5850 or greater mills.  The City Commission must authorize him through the resolution to transmit these forms to the Property Appraisers.

Commissioner Roberts- If this is current and we are not approving this, it seems we should just pass it at the current rate of 5.3194.

City Manager Smyth- I must fill out the DR420 form and submit it back to the Property Appraisers office according to state statue.  You are not adopting it we are just announcing what it is or what it could be.  You have until the first budget hearing in September before you officially adopt it.  The Act of Legislature in 2007 changed how things are done, also the referendum vote passing Amendment #1 in 2008.  These forms are different from last year.  We must announce all the millage levy and the percentage change is from last year to this year.

The City Commission and staff continued this discussion.

Moved to approve the Resolution setting the maximum millage rate.
