CITY COMMISSION MEETING
6:30PM
A. CALL TO ORDER
Mayor Randall called the meeting to order at 6:30PM. Commissioner Surrency gave the Invocation and Commissioner Roberts led the Pledge of Allegiance.
City Commissioners present: Mayor Randall, Vice Mayor Carlton and Commissioners Surrency, Carter and Roberts. Staff Present: City Manager Smyth, City Clerk McGruder, Interim City Attorney Harris and City Planner Moosbrugger.

E. CITIZEN COMMENTS
1. Sharon Surrency- Chairperson for the School Advisory Council which is composed of volunteers from the community. They meet quarterly to discus issues going on at the school. This week is Teacher Appreciation Week. Asked Mayor Randall to send a letter thanking the Teachers for their assistance with teaching our children.
2. Vivian Wagner- The people elect the City Commissioners and the City Commissioners hires our City Manager and City Attorney. She has heard a lot of rumors and from now on when she hears these rumors she’s going to bring it before the City Commissioners.
3. Ellen Vause- Another break in at Miller Electric by cutting the fence at Florida Septic. They stole about 10K of copper wire. ASO was notified and wants to notify the City Manager and the City Commission.

1. City Commission Meeting Minutes
The City Commissioners gave corrections for the City Managers Evaluation Workshop minutes.
Vice Mayor Carlton- Second time the City Manager failed to record a meeting or workshop.
City Manager Smyth- This was my mistake and apologized.
Moved to adopt the City Commission Meeting minutes as amended.

4. Resolution for a Topographic Survey of the restroom site at the Hawthorne Trailhead.
Commissioner Carter- City Staff has formed a partnership with the Florida Park Service to install an ecologically friendly composting restroom facility at the trailhead. Was this voted on?
City Planner Moosbrugger- There was no vote on this. Was told the City Commissioners had agreed they wanted to do this so just submit the survey.
Moved to post pone or table this item until a later date.

Commissioner Surrency- For those who don’t know, the City Planner will be leaving on May 12 so we should discuss this now because she want have time to bring this back before the City Commission.

G. PUBLIC HEARING
Second Reading
1. An Ordinance requesting and consenting to the inclusion of the City of Hawthorne in the Municipal Service Benefit Unit-Fire by Alachua County.
City Clerk McGruder read the Ordinance by title only.
Moved to approve ordinance on 2nd reading.

Commissioner Carter- Spoke on different verbiage which is in here. Is every section included in the Ordinance?
Interim City Attorney- Yes, that is correct.

H. DISCUSSION
1. City Manager Evaluation
Mayor Randall- There was a workshop on April 23 regarding the City Manager 6 month evaluation.
Commissioner Surrency- Did the evaluation for purpose to make sure the direction we are going is the right direction. The evaluations should be given to the City Manager to give him guidance to better the city. Suggest every City Commissioner turn one in.
Vice Mayor Carlton- Interim City Attorney stated it was nothing in the charter about completing these evaluations so he did not do it.
Commissioner Roberts- Interim City Attorney did say it was not mandatory but she has been working on hers.
Mayor Randall- Have hers ready to share with everyone and will turn it in.
2. Kelly Moosbrugger- Letter in personnel file
Kelly Moosbrugger- Previously had two requests: reimbursement for legal fees and a letter to be placed in her personnel file. Just want closer for her personnel records.
City Manager Smyth- Only questions he can answer regarding personnel is her dates of employment and is she eligible for rehire.
Kelly Moosbrugger- personnel file is public record and would really like a letter in her file stating she did nothing wrong during the investigation and was asked to return to work. Presented a letter to you earlier and would like closer of the entire thing regarding the reimbursement and letter in her file.
Commissioner Roberts- Thanks for a job well done. Kelly is the 3rd University Florida student that has worked for us. The letter would be a good thing because her personnel file is public record. We did vote to resolve this at the next available meeting and would like to discuss it.
Commissioner Surrency- Have you and the City Manager sat down to discuss your personnel file? The first option is to approach your supervisor to see if he plans on putting a letter in your personnel file.
Kelly Moosbrugger and City Manager Smyth both agreed they had not sat down to discuss a letter for her personnel file.
The City Commissioners and Staff continued to discuss this issue.
Moved to encourage the City Manager and Ms. Moosbrugger to meet about her work performance and a letter being placed in her personnel file.

I. CITIZEN COMMENTS
l. Larry Tilbury- Why not get a mediator to sit in with the City Manager and Kelly to see if this can be resolved favorably- What types of items fall under Item D on the agenda? Mayor Randall and the Interim City Attorney explained.
Memory Stewart- Supervise people and we are looking at ways to cut and hire people. Encourage Ms. Smyth to put a letter in Ms. Moosbrugger personnel file to bring closer to this.
Ellen Vause- City and private businesses are different. What Mr. Smyth said was correct. She has enjoyed working with Kelly on the P&Z Board because she is very professional.
Jeff McMeekin- He has been on top of these problems with these checks. Ms. Moosbrugger has been drawn into this mess. The City Commission should be paying her legal fees and the City Manager should put something in her personnel file.
J. REPORTS
City Manager Smyth- Need a workshop to instruct him on the direction they would like him to go for the next 6 months and would like to have a workshop on the wild spaces public places. Will be attending the training he was encouraged to attend by the City Commission on the 12-15 of May.
Interim City Attorney Harris- Have relayed the attorney issue and City’s stand is anyone has any questions please contact her.
Commissioner Roberts- Having a wonderful time with the seniors and encouraged more seniors to come out.
Commissioner Carter- None
Commissioner Surrency- Spring Banquet on May 11 and May 12 is the first County Charter Review meeting. May 18 is the Youth Council meeting at 5:30PM at City Hall.
Vice Mayor Carlton- Moosbrugger has the right to request the City Commission to pay her attorney fees and she has a case for a lawsuit.
Mayor Randall- Relay for Life is May 21-22, 2010. Encouraged everyone to participate.
