REGULAR TOWN BOARD MEETING                                      JULY 6th, 2010

A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag.  Roll call by Rosemary Centi, Town Clerk, showed the following to be present:

Supervisor Runion welcomed everyone to the evening’s meeting and asked for a motion accepting the minutes of the June15th, 2010 Town Board meeting.

 MOTION #116 Councilman Pastore moved to ACCEPT THE MINUTES OF THE JUNE 15H, 2010 TOWN BOARD MEETING.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

PUBLIC COMMENT PERIOD – No public comment

 AGENDA ITEMS.

 

Item #1 on the agenda concerned the adoption of a resolution establishing the work day for elected and appointed officials as required by the State Comptroller for purposes of reporting to the NY State and Local Employee’s Retirement System.

These are based on logs as have been submitted to the Town Clerk’s Office.

MOTION #117  Councilwoman Slavick moved to ADOPT THE FOLLOWING RESOLUTION ESTABLISHING THE WORKDAY FOR ELECTED AND APPOINTED OFFICIALS AS REQUIRED BY THE STATE COMPTROLLER FOR PURPOSES OF REPORTING TO THE NY STATE AND LOCAL EMPLOYEE’S RETIREMENT SYSTEM. Councilman Pastore seconded the motion and it was carried by the following roll call vote:

Abstained– “I have some questions.  We received our packets last week but just today we received the actual list of what the days were for the various elected officials.  It says on the bottom, ‘each of the above individuals has shown a record of activities showing actual time worked’.  I have not seen these logs and I have some questions.”

He further stated that he wanted to see the logs that demonstrate that the Town Attorney and the Town Justices are in fact full time employees of the Town.

He stated that they should have been provided and that they be provided.

Aye - Supervisor Runion stated that the materials had been in the council member’s boxes since last Thursday and he should have contacted the Director of Human Resources to review the materials as she has control of the documents.

BE IT RESOLVED, that the Town Board be and hereby establishes the following as a standard work day and specifies the expiration of each term for elected and appointed officials for the purpose of determining days worked reportable to the New York State and Local Employees’ Retirement System:

Town Justices (four year term)

Receiver of Taxes (four year term)

Councilman Redlich questioned when the budget workshops would be held.

MOTION #118  Supervisor Runion moved to ADJOURN THE JULY 6TH, 2010 TOWN BOARD MEEETING AT 7:40 PM. Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

Aye–Said, “Mr. Supervisor before I vote, I asked you at the last meeting and I’ve asked you by e-mail if you would let us know and we’ve passed half way through the year 2010, you are the Town’s Chief Fiscal Officer, I was hoping you would give us a report on the Town’s financial status and I was hoping that you would schedule dates for budget workshops for this fall.  When do you plan on doing that?”

Supervisor Runion said, “Well Mr. Redlich, we have given you monthly reports, which you can read at your leisure.  Secondly, as you know, you have, I believe a conflict of interest.  Until that conflict of interest or the resolution of your Federal case that you filed against the Appellate Division and the Committee on Professional Standards, I really don’t feel that I should be discussing any kind of budget with you because of your conflicts.”

Mr. Redlich asked if there would be any budget workshops.

Supervisor Runion stated that there will be budget workshops but they are established in late September or early October as was previously stated.  Department heads have not as yet received materials to formulate their budget and until then we cannot hold workshops.  The Supervisor is not required to file a budget prior to September 30, 2010.
