Town Board Minutes 09/17/2009
REGULAR TOWN BOARD MEETING                                      SEPTEMBER 17, 2009

A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag.  Roll call by Rosemary Centi, Town Clerk, showed the following to be present:

Supervisor Runion welcomed everyone to the evening’s meeting and asked for a motion accepting the minutes of the September l 7, 2009 Town Board meeting.

MOTION #149  Councilwoman Slavick moved to ACCEPT THE MINUTES OF THE SEPTEMBER 1, 2009 TOWN BOARD MEETING.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:

PUBLIC COMMENT PERIOD- Peter Golden, Brandon Terrace

Stated,” According to Town Code a written estimate of revenues and indebtedness should have been prepared by August 1.  By August 22, budget requests should have been submitted to the Supervisor, requests that should have be available to the public.  By September 30, the Supervisor is required to file a tentative budget with the Town Clerk, and by October 5, according to New York State law; the Town Clerk is required to present the draft budget to the board at either a regular or a special meeting.
I have prepared a summary of these requirements, with the appropriate town code and state law for all of you.

And here is my question: since your next regular meeting is not until October 6, when have you scheduled the special budget session?”

“Thank you so much for your time.”

Supervisor Runion thanked Mr. Golden for his comments.

AGENDA ITEMS:

Agenda item # 1:  
Guilderland Police Department Presentation

Henry Boland, Department of Criminal Justice, stated that he was at the board meeting representing Criminal Justice Services and was honored to be able to present this accreditation.

He gave some background information and history on the process of accreditation.
The program consists of 132 standards from operations to administration including the running of the department, the fiscal affairs, personnel issues and administration of all areas of training and the operations of the department including criminal investigations, all other aspects of traffic enforcement, DWI enforcement, etc.
These standards are considered to be the best practices throughout the country.
He stated that he was proud for the fact that New York State, when they instituted the accreditation program, was the first state in the Union to do so.  Since then, 26 other states have instituted the program using New York States as the model.

He further stated that Chief Lawlor, in deciding to pursue the process, worked together with the Supervisor and the Board and put a team together to institute the program.  Sergeant Gary Lee was made Program Manager, insuring that the program met all of the 132 standards and the policies and procedures of the program.

DCJS selected three experienced, independent law enforcement professionals to come into the department.  They spent three days on site looking at all aspects of the police department.  They asked all of the questions so that the entire department knew what was expected in order to achieve accreditation.
The team leader in his final report noted, “The Guilderland Police Department has done an excellent job in preparing for their onsite assessment.  Each of the individuals in the department has acted in a truly professional and courteous manner to each of the team members.  As a result, we strongly recommend that the agency be accredited.”
This accreditation would be for a period of five years.

He further started that out of 500 police departments in NY State only 130 have gained accreditation status, and only 5 in Albany County.
He presented a plaque to Guilderland Police Chief, Carol Lawlor.

Chief Lawlor thanked Mr. Boland, her co-workers and office staff, Captain Cox and others.
She also thanked Sergeant Lee for all of his work and Supervisor Runion and the Police Department’s liaisons to the Town Board, Councilwoman Patricia Slavick and Councilman Paul Pastore.

The John Kimball O’Neil certificate was presented to Sergeant Gary Lee in recognition of his service as a Program Manager for his agency in achieving accreditation and for showing excellence in their work.
Sergeant Gary Lee thanked everyone for the award stating that,  “It took a lot of people to get this done.”

Supervisor Runion thanked Sergeant Lee for all of the work that he had done.
Councilman Grimm also thanked Sergeant Lee.

Supervisor Runion recognized Sergeant Roger Ginder, as Juvenile Officer of the Year, designated by the State of New York Police Juvenile Officer Association at their annual conference.

Senior Patrolman and Youth Services Officer, Brian Forte, explained the award being given to Matthew Ward. He recognized Matthew Ward, Guilderland High School Senior, as having received the State of New York Youth of the Year Award. Matthew is part of the Police Departments Explorer program.

He also presented the Juvenile Officer of the Year award to and thanked Roger Ginder for the work that he had done for the program.

Supervisor Runion again congratulated the Police Department on the accreditation and recognized the professionalism and dedication of the department.

Item #2 on the agenda concerned authorizing the Supervisor to sign an amendment to the agreement with the Town of Colonie for disposal of sewer grit at the Town of Colonie landfill.
This would be less costly than sending it to the Albany landfill.

MOTION #150  Councilman Redlich moved to AUTHORIZE THE SUPERVISOR TO SIGN AN AMENDMENT TO THE AGREEMENT WITH THE TOWN OF COLONIE FOR DISPOSAL OF SEWER GRIT AT THE TOWN OF COLONIE LANDFILL.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

Item #2 on the agenda concerned setting a public hearing for October 20, 2009 at 8:00 PM in regard to sewer assessment roll pursuant to Section 202 of the Town Law.

Councilman Redlich asked if department budget requests had been submitted.
Supervisor Runion stated that they had and were available for review by the public at any time.  

Councilman Redlich asked if the tentative budget would be filed by September 30th, 2009.
Supervisor Runion stated that he had done so every year that he had been Supervisor.

Councilman Redlich also stated that the Town Clerk on or before October 5th, 2009 should present the tentative budget to the Board.
Councilman Redlich moved that a special meeting be held on October 1, 2009 and moved the same.  Councilman Grimm seconded the motion.

Supervisor Runion stated that any special meeting of the Board are to be called by the Supervisor with notice to the board members.

Councilman Redlich asked if the Supervisor would schedule a special meeting for this purpose.

Councilman Pastore asked why this couldn’t be done at board meeting.

Councilman Redlich stated that October 6, 2009 would be a day late.

Town Attorney, Richard Sherwood, stated that the budget did not have to be presented at a special meeting but could be filed with each board member in their mailbox.
A discussion was held regarding available days.

MOTION #151 Councilman Redlich moved to CANCEL THE OCTOBER 6, 2009 TOWN BOARD MEETING AND RE-SCHEDULE THE MEETING FOR OCTOBER 5, 2009.  Councilman Grimm seconded the motion and it was carried by the following roll call vote:
