REGULAR TOWN BOARD MEETING                                                      FEBRUARY 3, 2009

A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag.  Roll call by Rosemary Centi, Town Clerk, showed the following to be present:

Supervisor Runion welcomed everyone to the evening’s meeting and asked for a motion accepting the minutes of the January 20, 2009 Town Board meeting


OTION #33  Councilwoman Slavick moved to ACCEPT THE MINUTES OF THE JANUARY 20, 2009 TOWN BOARD MEETING.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:

PUBLIC COMMENT PERIOD:  No public comment

 AGENDA ITEMS:

 Item #1 on the agenda concerned the request of Store Away at Guilderland, LLC to locate an entry sign within the right of way of Wagner Road.

This item had been tabled from the January 20, 2009 meeting. 

 Dan Hershberg, Hershberg &Hershberg, representing the applicant, explained the need for the 16’ high sign.

He stated that in order to be visible from a distance the sign should be this height.

 Supervisor Runion expressed his concerns with the height of the sign and the fact that it was internally lit.  He also stated that it was the first thing you would see upon entering Guilderland Center and was not in character with the rural setting of the area.

He felt that a monument sign, externally lit, would be a better fit for the area.

 Further discussion was held and questions were asked by board members regarding sign height, visibility and the need for a variance from the Zoning Board of Appeals.

 Councilman Pastore asked what the height of the sign would be if the sign were to be located on private property.

 Mr. Hershberg stated that it would be approximately 20’ tall if located on private property.

He further stated that they could put the sign on private property but the recommendation from the building department was to put it on the Town’s right-of way.

Mr. Hershberg stated that 16’ was the height that would provide the best visibility directing people to the site but agreed to bring in more photos of the area showing a monument sign.

Item was tabled until 2/17/2009.

 MOTION #34  Councilman Pastore moved to APPROVE APPOINTING CARLY STAUBACH TO THE POSITION OF TELECOMMUNICATOR FROM THE  ALBANY COUNTY CIVIL SERVICE LIST.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

 MOTION #35  Councilman Pastore moved to ADOPT THE FOLLOWING RESOLUTION AUTHORIZING THE SUPERVISOR TO SUBMIT AN APPLICATION FOR A NYS DEPT. OF STATE LOCAL GOVERNMENT EFFICIENCY GRANT.

Resolved,

That the Town Board of the Town of Guilderland authorizes Supervisor Kenneth D. Runion to submit an application to the New York State Department of State under the 2008-2009 Local Government Efficiency Program, and to designate Town of Guilderland Supervisor Kenneth Runion as the Lead Application Contact Person to execute all financial and administrative processes relative to the grant program.  The project for which funding is sought is the “Guilderland–Altamont Shared Information Access Project”, which involves the creation of a website for the Village of Altamont as a separate component of the Town of Guilderland website, and which creates a capacity for video-on-demand access for municipal meetings of both Town and Village.  Total installation cost for the project is $11,490, and a grant in the amount of $10,341 (90% of the total cost) is requested, with the remaining $1,149 to be shared between the Town and the Village.

Collaborative operation of the service will be governed by an inter-municipal agreement to be negotiated between Town and Village prior to the execution of a vendor agreement for installation of the service.

MOTION # 36  Councilman Redlich moved to AUTHORIZE THE SUPERVISOR TO SUBMIT AN APPLICATION FOR A GRANT TO NYS DEPARTMENT OF ENVIRONMENTAL CONSERVATION FOR FINANCIAL ASSISTANCE FOR TOWN HOUSEHOLD HAZARDOUS WASTE DAYS.

RESOLVED,

 WHEREAS, THE STATE OF NEW YORK PROVIDES FINANCIAL AID FOR HOUSEHOLD HAZARDOUS WASTE PROGRAMS; AND

 WHEREAS, THE TOWN OF GUILDERLAND DEEMS IT TO BE IN THE PUBLIC INTEREST AND BENEFIT TO FILE AN APPLICATION UNDER THESE LAWS; AND

WHEREAS, IT IS NECESSARY THAT A CONTRACT BETWEEN THE PEOPLE OF THE STATE OF NEW YORK (“STATE”) AND THE TOWN OF GUILDERLAND (“MUNICIPALITY”) BE EXECUTED FOR SUCH STATE AID; THEREFORE

THE TOWN BOARD OF THE TOWN OF GUILDERLAND HEREBY AUTHORIZES THE FILING BY SUPERVISOR KENNETH RUNION OF AN APPLICATION WITH THE NEW YORK STATE DEPARTMENT OF ENVIRONMENTAL CONSERVATION FOR GRANT ASSISTANCE IN THE AMOUNT OF $40,030.00 AGAINST A TOTAL PROJECT BUDGET OF $80,060.00 FOR THE CONDUCT OF TWO HOUSEHOLD HAZARDOUS WASTE DAYS (MAY 16TH AND SEPTEMBER 19TH) BY THE MUNICIPALITY AND FOR THE MUNICIPALITY’S PARTICIPATION IN THE COUNTY – WIDE ELECTRONICS COLLECTION DAY (APRIL 25TH), AS WELL AS FOR SIGNING OF A CONTRACT ON BEHALF OF THE MUNICIPALITY IF SAID APPLICATION IS APPROVED BY THE STATE.

 THE MUNICIPALITY AGREES THAT IT WILL FUND THE ENTIRE COST OF SAID HOUSEHOLD HAZARDOUS WASTE PROGRAM AND WILL BE REIMBURSED BY THE STATE FOR THE STATE SHARE OF SUCH COSTS.

THIS RESOLUTION SHALL TAKE PLACE IMMEDIATELY.

MOTION #37  Councilwoman Slavick moved to AUTHORIZE THE SUPERINTENDENT OF THE TRANSFER STATION TO CONDUCT TWO HOUSEHOLD HAZARDOUS WASTE DAYS IN 2009 (MAY 16, 2009 AND SEPTEMBER 19, 2009) AND TO PARTICIPATE IN THE  REGIONAL ELECTRONICS WASTE DAY (APRIL 25, 2009).  Councilman Pastore seconded the motion and it was carried by the following roll call vote:
