REGULAR TOWN BOARD MEETING                              JANUARY 20, 2009

A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag.  Roll call by Rosemary Centi, Town Clerk, showed the following to be present:

Supervisor Runion welcomed everyone to the evening’s meeting and asked for a motion accepting the minutes of the December 16, 2008 Town Board meeting and the January 8, 2009 Organizational Meeting..

MOTION #21  Councilwoman Slavick moved to ACCEPT THE MINUTES OF THE DECEMBER 16, 2008 TOWN BOARD MEETING AND THE JANUARY 8, 2009 ORGANIZATIONAL MEETING.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:

PUBLIC COMMENT PERIOD:  No public comment

7:30 P.M.  PUBLIC HEARING:  Local Law in regard to adopting provisions of RPTL (Real Property Tax Law) section 458B allowing a tax exemption for Cold War Veterans.

Town Clerk, Rosemary Centi read the legal notice.
Discussion was held regarding the definition of a Cold War Veteran, which is set by the State.  This would take effect with the 2010 property tax bill.   Application deadline under the law is March 1, 2009.

MOTION # 22  Councilman Redlich moved to CLOSE THE 7:3O P.M. PUBLIC HEARING.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

Councilman Grimm asked about the cost to the Town, which is minimal.

MOTION #23  Councilman Redlich moved to ADOPT LOCAL LAW #1 FOR 2009 IN REGARD TO ADOPTING PROVISIONS OF RPTL SECTION 458B ALLOWING A TAX EXEMPTION FOR COLD WAR VETERANS.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:

AGENDA ITEMS:

Item #1 on the agenda concerning the request of Store Away at Guilderland, LLC to locate an entry sign within the right of way of Wagner Road was tabled.

Item #2 on the agenda concerned setting a public hearing date on a re-zone request for Dutchmen Acres from RA-3 to Country Hamlet.
Supervisor Runion stated that an initial discussion had been held and the developer had been asked to look at and address some additional issues.

Councilman Pastore asked if the amended traffic report had been submitted.
Mr. Myer stated that it would be submitted to the Town Board by February 3, 2009.

Councilwoman Slavick asked how questions from Albany County were addressed.
Mr. Myer stated they had been addressed at a County meeting and that any questions outstanding would be part of the submissions to the various town boards.

Councilman Pastore asked if more information would be forthcoming regarding the impact on the Black Creek.

Supervisor Runion stated that another issue needing to be addressed before the Town Board, raised by the Albany County Department of Public Works, was the cumulative impact of this project on County Routes 201 and 202.
The County is looking to the Town for possible mitigation fees for this intersection.
Mr. Myer stated that the question was raised but without direction.

Supervisor Runion stated that without the traffic report it would be difficult to change the zoning without information regarding the impact of this re-zone on the intersection.

MOTION #24  Councilwoman Slavick moved to SET A PUBLIC HEARING DATE FOR RE-SUBMITTED REQUEST OF DUTCHMEN ACRES FOR PROPOSED ZONING CHANGE FROM RA-3 TO COUNTRY HAMLET ON FEBRUARY 17TH, 2009 AT 7:30 PM .  Councilman Pastore seconded the motion and it was carried by the following roll call vote:

MOTION #25  Councilman Pastore moved to AUTHORIZE THE RELEASE OF WATER DISTRICT EXTENSION #66 ESCROW IN THE AMOUNT OF $14,907.25 PLUS ACCOUNT CLOSING INTEREST.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #26  Councilman Redlich  moved to AUTHORIZE THE DEPARTMENT OF WATER AND WASTEWATER MANAGEMENT TO GO TO BID FOR VARIOUS PROCESS CHEMICALS FOR BOTH WATER AND SANITARY SEWAGE TREATMENT FOR 2009.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #27  Councilwoman Slavick moved to AUTHORIZE THE DEPARTMENT OF WATER AND WASTEWATER MANAGEMENT TO GO TO BID FOR A REPLACEMNT PUMP PANEL FOR THE LYDIUS STREET PUMP STATION..  Councilman Redlich seconded the motion and it was carried by the following roll call vote:

MOTION #28  Councilwoman Slavick moved to APPROVE TRANSFERS AS REQUESTED BY THE TOWN COMPTROLLER.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:

Item # 7 on the agenda concerned authorizing the Supervisor to sign an agreement with Western Turnpike Rescue Squad for the billing of Advanced Life Support Services provided by the Town.

Supervisor Runion explained the agreement as a soft billing.  
Councilman Redlich asked to whom the additional billing went to.
Supervisor Runion explained that the revenue went directly to the Town.
If the resident had insurance, the resident would be required to submit it to their insurance carrier and whatever was collected from the insurance carrier would be applied to the Rescue Squad and the Town.

Councilman Redlich asked about the amount of revenue that might be realized.  
Supervisor Runion stated that it would be approximately $200,000.00.
Supervisor Runion stated that the Town had been providing the service but had not been recovering. This would be a yearly agreement.

MOTION #29  Councilwoman Slavick moved to AUTHORIZE THE SUPERVISOR TO SIGN AN AGREEMENT WITH WESTERN TURNPIKE RESCUE SQUAD FOR BILLING OF ADVANCED LIFE SUPPORT SERVICES PROVIDED BY THE TOWN.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:
