Town Board Minutes 09.02.2008
                                                                                                                                                                                                                  A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag.  Roll call by Rosemary Centi, Town Clerk, showed the following to be present:

ALSO PRESENT:                   Richard Sherwood, Town Attorney

Supervisor Runion welcomed everyone to the evening’s meeting and asked for a motion accepting the minutes of the August 19th, 2008 Town Board meeting.

MOTION #173  Councilwoman Slavick moved to ACCEPT THE MINUTES OF THE AUGUST 19TH , 2008 TOWN BOARD MEETING.  Councilman Pastore seconded the motion and it was carried by the following a roll call vote:

                                        Supervisor Runion               Aye

Supervisor Runion explained the new tax bills and the fact that checks should be made to the school district that your property is located in.  He further stated that residents should contact their escrow company when applicable.

He gave an explanation of the collection period and at what point a finance charge would be added.

MOTION #174  Councilman Pastore moved to APPROVE THE PERMANENT APPOINTMENT OF EMANUEL SHULMAN TO THE POSITION OF TECHNICAL FIRST SERGEANT PURSUANT TO THE ALBANY COUNTY CIVIL SERVICE LIST.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #175  Councilman Redlich moved to APPROVE AWARDING THE BIDS FOR SURPLUS EQUIPMENT TO BE SOLD BY THE DEPARTMENT OF WATER AND WASTEWATER MANAGEMENT.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

Item #3 on the agenda concerned approving the recommendation of the Traffic Safety Committee to change form Yield sign to Stop sign at the following intersections:



a.      Walnut Lane at Garnett Lane
b.      Highgate Drive at Walnut Lane
c.      Highgate Drive at Sommerset
d.      Covington Place at Sommerset
e.      Sommerset Drive at Walnut Lane
f.      Walnut Lane at Covington Place



Jerold Nadel of Vesper Drive, President of the Covington Woods Homeowners Association, stated that the homeowners had petitioned the Town Board for the changes.  A survey had been done asking local homeowners their opinion of the changes and the majority had agreed to them. He further stated that he had received no negative feedback to the changes.

MOTION #176  Councilman Redlich moved to APPROVE THE RECOMMENDATION OF THE TRAFFIC SAFETY COMMITTEE TO CHANGE FROM YIELD SIGN TO STOP SIGN AT THE FOLLOWING INTERSECTIONS:



a.      Walnut Lane at Garnett Lane
b.      Highgate Drive at Walnut Lane
c.      Highgate Drive at Sommerset
d.      Covington Place at Sommerset
e.      Sommerset Drive at Walnut Lane
f.      Walnut Lane at Covington Place

Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

                                        Councilman Pastore              Aye - disclosed that he lives in Covington Woods and inquired of Town Attorney, Dick Sherwood, whether that fact necessitated his abstention from the vote.  After Town Attorney Dick Sherwood opined that it was not a conflict, Councilman Pastore voted Aye.

Item # 4 on the agenda concerned re-considering Town Board motions #164 and #172 of August 19, 2008, designating a private lane off of County Line Road as Andy’s Way.  The Supervisor had received a telephone call from Eric Almond who objected to changing the name of the lane from Almond Lane to Andy’s Way. He had indicated that, at one point in time, there had been a sign designating it Almond Lane. 

Andy Hoelzli, owner of the largest piece of property, stated that he had purchased the property from one of the Almonds and that the easement was all on his property.

Mr. Hoelzli stated that he had spoken with the Assessor’s office and there was no indication that the lane had been named Almond Lane.

Councilman Redlich stated that the parties involved should get together and try to resolve the issue.
Supervisor Runion stated that there was some controversy over a fence and that the issue had been before the Planning Board.

Mr. Hoelzli stated that was no longer an issue. He further stated that there were no buildings belonging to the Almond family on their property.

Councilman Pastore stated that in the letter that had been sent to Supervisor Runion mention was made of a street sign at the lane.

Mr. Hoelzli stated that it was not a designated town street and it could have been a hand made sign.
He stated that he would be willing to speak with Mr. Almond.

MOTION #177  Councilman Redlich moved to RESCIND MOTIONS #164 AND #172  MADE AT THE  AUGUST 19, 2008 TOWN BOARD MEETING DESIGNATING A PRIVATE LANE OFF OF COUNTY LINE ROAD AS ANDY’S WAY.   Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

                                        Councilman Pastore              Aye - stated that he was in favor.  He expressed some concern that if the issue was not resolved, he would like someone to appear here and express their objections to the Town Board and if not, he would like to proceed accordingly.

MOTION #178  Councilman Redlich moved to INCREASE THE PETTY CASH ACCOUNT IN THE RECEIVER OF TAXES OFFICE FROM $200.00 TO $300.00.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:
