	Organizational Meeting January 3, 2008 The Organizational Meeting of the Town Board of the Town of Guilderland was held at the Town Hall, Route 20 McCormick’s Corners, Guilderland, N.Y. on the 3d day of January 2008 at 7:30 PM. The meeting was opened with the Pledge of Allegiance to the flag. Roll call by Rosemary Centi. Town Clerk, showed the following to be present: Councilman Redlich Councilwoman Slavick Councilman Pastore Councilman Grimm Supervisor Runion ALSO PRESENT: Richard Sherwood, Town Attorney ****************************************************************************Supervisor Runion welcomed everyone to the evening’s meeting and stated that it was the first meeting of the year. He also welcomed the new Board members, Warren Redlich and Mark Grimm. He further stated that the Organizational Meeting was held in order to appoint officials for the 2008 town year as well as to set forth the general guidelines for business to be conducted during the year. AGENDA ITEMS: MOTION #1 Councilwoman Slavick moved to Re-Appoint Richard Sherwood as Town Attorney (Term Expires December 31, 2009). Councilman Pastore seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye Councilman Redlich asked about procedure regarding motions and the discussion for them. MOTION #2 Councilman Pastore moved to Re-appoint Stephen Feeney as a member and Chairperson of the Planning Board for 2008. Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #3 Councilman Pastore moved to Re-appoint Linda Clark as an Assistant Town Attorney and Counsel to the Planning Board. Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye Item # 4 on the agenda concerned the re-appointment of Michael Cleary to the Planning Board. Board members held a discussion and the following vote was recorded: MOTION #4 Councilman Pastore moved to Re-Appoint Michael Cleary as a member of the Planning Board. (Term expires December 31, 2014). Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich No Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm No – Councilman Grimm objected that none of the minority’s nominees were placed on the agenda or voted on. Supervisor Runion Aye Supervisor Runion explained the rules regarding discussion and casting of votes. Item # 5 on the agenda concerned the appointment of Thomas Remmert to the Zoning Board of Appeals. A discussion ensued among Board members and the following vote was cast: MOTION #5 Councilman Pastore moved Appoint Thomas Remmert as a member of the Zoning Board of Appeals (Term expires December 31, 2012) Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich No Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm No Supervisor Runion Aye MOTION #6 Councilwoman Slavick moved to Re-appoint Peter Barber as Chairperson of the Zoning Board of Appeals for 2008. Councilman Pastore seconded the motion and it was carried by the following roll call vote: Councilman Redlich No Councilwoman Slavick Yes Councilman Pastore Yes Councilman Grimm No - Supervisor Runion Yes Councilman Grimm asked that the Town Clerk announce the tally of each vote. MOTION #7 Councilman Pastore moved to Appoint Robert Feller as Assistant Town Attorney and Counsel to the Zoning Board of Appeals. Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #8 Councilman Pastore moved to Re-appoint John G. Wemple, Jr. as a member of the Environmental Conservation Advisory Council and as Chairman of the Environmental Conservation Advisory Council for the year 2008. Councilman Redlich seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye All Environmental Conservation Advisory Council members are appointed to a one-year term. MOTION #9 Councilman Pastore moved to Re-appoint Herb Hennings, Stuart Reese, and Thomas Kriger and appoint Stephen Albert and Gordon McClelland as members of the Environmental Conservation Advisory Council. Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION#10 Councilwoman Slavick moved to Appoint William Young as Chairperson of the Guilderland Industrial Development Agency and re-appoint James Shahda and Michael Bopp, and appoint Christopher Bombardier and Anthony Carrow as members of said Industrial Development Agency and appoint the firm of Hodgson Russ, Joseph Scott of Counsel, as attorney to the IDA. Councilman Pastore seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm No – Councilman Grimm objected to voting on the nominees as a block Supervisor Runion Aye MOTION #11 Councilman Grimm moved to Split the Chairmanship from the rest of the members to be appointed to the Economic Advisory Council. Councilman Redlich seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick No Councilman Pastore No Councilman Grimm Aye Supervisor Runion Aye A discussion was held regarding the re-appointment of Donald Csaposs to the position of Chairperson of the Economic Advisory Council and the following vote was cast. MOTION #12 Councilwoman Slavick moved to Re-appoint Donald Csaposs as member and Chairperson of the Economic Advisory Council. Councilman Pastore seconded the motion and it was carried by the following roll call vote: Councilman Redlich No Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm No Supervisor Runion Aye MOTION #13 Councilwoman Slavick moved to Re-appoint John Decatur, Peter class=Section2> Sparano, Garry Robinson and appoint Katherine Burbank (Chamber of Commerce Representative) and James Lozano as members of the Economic Advisory Council. Councilman Redlich No Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm No Supervisor Runion Aye MOTION #14 Councilman Pastore moved to Appoint the remaining members of Economic Advisory Council to consist of the Chairpersons of the Planning Board, Zoning Board of Appeals, Conservation Council, and IDA. Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #15 Councilwoman Slavick moved to Appoint Charles Cahill as Alternate member of the Zoning Board of Appeals and liaison to Emergency Services. Term shall be for 1 (one) year. Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #18 Councilwoman Slavick moved to Re-appoint Jean Cataldo as Registrar of Vital Statistics and Cindy Wadach, Deputy Registrar. Councilman Pastore seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #19 Councilman Pastore moved to Appoint Rosemary Centi as Passport Agent. Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #20 Councilman Pastore moved to Re-Appoint Rosemary Centi as Marriage Officer ( 4 year Term). Councilman Redlich seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #21 Councilman Pastore moved to Authorize Town Supervisor to make provisional appointments. Councilman Redlich seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #22 Councilman Redlich moved to Designate First National Bank of Scotia, First Niagara Bank, Citizens Bank, J.P. Morgan Chase Bank, Pioneer Commercial Bank, NBT Bank, and M&T Bank as official depositories of the Town of Guilderland. Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #23 Councilwoman Slavick moved to Authorize Supervisor and Comptroller to invest Certificates of Deposit in any of the designated official depositories with a third party holding the securities. Councilman Pastore seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #24 Councilwoman Slavick moved to Authorize Supervisor and Comptroller to sign checks on behalf of the town. Councilman Pastore seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #25 Councilman Pastore moved to Designate Boswell Engineering, Delaware Engineering, Clough Harbour Engineers, Barton and Loguidace and Spectra Engineering to serve as Town Designated Engineers for 2008. Councilwoman Slavick seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #26 Councilwoman Slavick moved to Set meeting dates for the Town Board, Planning Board, Zoning Board of Appeals, and Guilderland Conservation Advisory Council as per Schedule A with a change of the Town Board meeting date of February 5^th 2008, due to the Presidential Primary, to the following Tuesday, February 12^th, 2008. Councilman Pastore seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #27 Councilwoman Slavick moved to Establish mileage rate as approved by Internal Revenue Service for reimbursement to town employees when authorized to use their private vehicles on town business. Councilman Pastore seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #28 Councilman Redlich moved to Authorize the Highway Superintendent and the Superintendent of Water and Wastewater Management to spend up to $2000 per year for the purchase of tools without prior approval of the Town Board. Councilman Pastore seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #29 Councilman Pastore moved to Designate the respective Fire Chiefs as Fire Wardens for 2008 per Schedule D. Councilman Redlich seconded the motion and it was carried by the following roll call vote: Councilman Redlich Aye Councilwoman Slavick Aye Councilman Pastore Aye Councilman Grimm Aye Supervisor Runion Aye MOTION #30 Councilman Pastore moved to Appoint a fire investigation team per Schedule C for 2008. (Union Town employee’s holidays are per contract).
