Town Board Minutes 03.06.2007
                                                                                                                                                                                                                  A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag.  Roll call by Rosemary Centi, Town Clerk, showed the following to be present:

Supervisor Runion welcomed everyone to the evening's meeting and asked for a motion approving the minutes of the February 6, 2007 Town Board meeting.

MOTION #68  Councilman Bosworth moved to APPROVE THE MINUTES OF THE FEBRUARY 6, 2007 TOWN BOARD MEETING.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

PUBLIC COMMENT PERIOD - NO PUBLIC COMMENT

 
PUBLIC HEARINGS:
7:30 PM  Section 8 Housing Choice Voucher Program
Town Clerk, Rosemary Centi, read the legal notice.
 
Mr. Joseph Mastrianni, presenting for Section 8 Housing Choice Voucher program, stated that there were no changes in the Plan and offered the summary for the Plan.

There is no Town Funding involved.  About 100 families could be helped.
Councilman Pastore asked about the reserve amount and the numbers from previous years.
Councilwoman Slavick asked how long the reserve could be carried.
Mr. Mastrianni stated that they could carry it for this year.
Councilwoman Slavick asked what would happen if there were no reserve.
Mr. Mastrianni stated they would have fewer families in the program but that they could move families to other programs, which they are allowed to do.
 
Supervisor Runion thanked Mr. Mastrianni for his clear summary and the good job that was being done in the Town.
 
MOTION #69  Councilman Bosworth moved to CLOSE THE PUBLIC HEARING ON SECTION 8 HOUSING CHOICE VOUCHER PROGRAM.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #70  Councilman Ricard moved to AUTHORIZE THE DEPARTMENT OF WATER AND WASTEWATER MANAGEMENT TO PURCHASE THROUGH NYS CONTRACT A MID SIZE DUMP TRUCK CHASIS AND TO GO OUT TO BID FOR THE DUMP TRUCK BODY.  Councilman Bosworth seconded the motion and it was carried by the following roll call vote:

MOTION #73  Councilman Bosworth moved to AUTHORIZE THE SUPERVISOR TO SIGN A CONTRACT WITH NYS OFFICE OF PARKS IN CONNECTION WITH GRANT TO ACQUIRE "BATTLE OF NORMANSKILL" SITE.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #75  Councilman Pastore moved to APPROVE AWARDING THE BID FOR GRANULATED ACTIVATED CARBON TO CALGON CORPORATION (sole bidder).  Councilman Ricard seconded the motion and it was carried by the following roll call vote:

PRESENTATION OF GUILDERLAND HAMLET PLAN - Plan is available for review in the Town Clerk's Office.

 
John Behan, Behan Planning Associates presenting.
Supervisor Runion stated the Capital District Transportation Committee funded the plan as part of their linkage program.
He further stated that his was part of the Town's Comprehensive Plan recommendation and acknowledged the part played by the committee in putting the Plan together and in securing funds for the Plan.
 (Mr. Behan projected the Plan on a screen for viewers)
Supervisor Runion asked what the adoption process would be.
Mr. Behan stated that it would be simple and straightforward. There would be a SEQR review, a resolution by the Town Board to adopt it as an element of the Comprehensive Plan, referred to the County and Town Planning Boards for comments and adopted as is by the Town Board.
 
Councilman Bosworth asked if it would be an amendment to the Comprehensive Plan.
Mr. Behan stated that it would be a refined supplement or addition to the Plan providing more clarity and direction and that it is right in line with the Comprehensive Plan.
 
Councilman Ricard asked if there were any zoning changes.
Mr. Behan stated that the Board could adopt the Plan and zoning changes simultaneously.
He further stated that the Plan was ready tot be adopted.
 
Councilman Bosworth asked about the immediate zoning impact for the area.
Mr. Behan state that the most immediate need would be the design guidelines.
 
Councilman Pastore asked about the suggestion of roundabout and sidewalk linkage. 
He also asked which features such as medians or roundabouts would be better as a traffic calming measures.
 
Chris O'Neal explained the benefits of a roundabout in reducing fatalities and serious injury accidents by 90% and in slowing traffic down.
 
Councilman Pastore if it would be costly.  Mr. O'Neal stated that it could be but the benefits were substantial.
Councilwoman Slavick asked about the improvement district.
 
Mr. Behan described it as a group of residents or property owners getting together to create a district to pay for a significant project.  (i.e. lighting district)
Mr. Behan continued by saying that there was a lot of agreement concerning implementation of the Plan.
Supervisor Runion thanked Mr. Behan and stated that Town Planner, Jan Weston would proceed with handling information to present to the Board.
 
MOTION #76  Councilman Bosworth moved to ENTER INTO EXECUTIVE SESSION AT 8:35 PM TO DISCUSS PERSONNEL INVESTIGATION.   Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #77  Councilman Bosworth moved that THE TOWN SUPERVISOR IS DIRECTED TO BRING CHARGES FOR MISCONDUCT  PURSUANT TO SECTION 75 OF THE CIVIL SERVICE LAW AND SECTION 155 OF THE TOWN LAW AGAINST JAMES R. MURLEY, CHIEF OF POLICE AND IS FURTHER DIRECTED TO SUSPEND THE CHIEF OF POLICE WITHOUT PAY UPON SERVICE OF THE CHARGES.  Councilman Ricard seconded the motion and it was carried by the following roll call vote:

MOTION #78  Councilman Ricard moved that  THE SUPERVISOR IS DIRECTED BY THE TOWN BOARD TO REFER THE INVESTIGATIVE FILE REGARDING POLICE CHIEF, JAMES R. MURLEY, TO THE NEW YORK STATE POLICE FOR INVESTIGATION INTO CRIMINAL CHARGES.  Councilman Bosworth seconded the motion and it was carried by the following roll call vote:
