Town Board Minutes 05.01.2007
A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag. Roll call by Anna Russo, Deputy Town Clerk, showed the following to be present:

Supervisor Runion welcomed everyone to the evening's meeting and asked for a motion approving the minutes of the April 17, 2007 Town Board meeting.
MOTION #115  Councilman Bosworth moved to APPROVE THE MINUTES OF THE APRIL 17, 2007 TOWN BOARD MEETING.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION # 116  Councilman Ricard moved to APPROVE AUTHORIZING THE DEPARTMENT OF WATER AND WASTEWATER MANAGEMENT TO GO OUT TO BID FOR TRANSPORTING AND DISPOSAL OF NOTT ROAD TREATMENT PLANT SLUDGE.  Councilman Bosworth seconded the motion and it was carried by the following roll call vote:

MOTION #117  Councilman Bosworth moved to APPROVE
THAT THE TOWN BOARD AUTHORIZES THE SUPERVISOR TO EXECUTE A MEMORANDUM OF UNDERSTANDING WITH THE CAPITAL DISTRICT TRANSPORTATION COMMITTEE UNDER WHICH CDTC WILL ADMINISTER THE PREPARATION OF A NEIGHBORHOOD PLAN FOR THE HAMLET OF GUILDERLAND CENTER.  THE TOTAL ESTIMATED COST OF THE PROJECT IS $30,800, OF WHICH $23,100 (75%) WILL BE FUNDED BY A LINKAGE GRANT FROM CDTC AND $7,700 WILL BE FUNDED BY THE TOWN OF GUILDERLAND.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #118  Councilman Bosworth moved to APPROVE AWARDING THE BID FOR SOIL BORING AND TESTING FOR THE TAWASENTHA PARK PEDESTRIAN BRIDGE PROJECT TO SOIL AND MATERIAL TESTING, INC., IN THE AMOUNT OF $2,625.00.  Councilman Ricard seconded the motion and it was carried by the following roll call vote:

MOTION #120  Councilwoman Slavick moved to APPROVE AUTHORIZING THE SUPERVISOR TO SIGN A COLLECTOR'S WARRANT FOR GUILDERLAND WATER DISTRICT IN THE AMOUNT OF $362,538.00.  Councilman Ricard seconded the motion and it was carried by the following roll call vote:

MOTION #122  Councilwoman Slavick moved to ENTER INTO EXECUTIVE SESSION RE:  PENDING CIVIL SERVICE LAW SECTION 75 PROCEEDING at 7:44 PM.  Councilman Ricard seconded the notion and it was carried by the following roll call vote:

MOTION #123  Councilman Pastore moved to AUTHORIZE THE SUPERVISOR TO SIGN A STIPULATION IN REGARD TO DISCIPLINARY CHARGES PURSUANT TO N.Y. CIVIL SERVICE LAW ARTICLE 75 AND N.Y. TOWN LAW SECTION 155 IN THE MATTER OF JAMES R. MURLEY, CHIEF OF POLICE.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

Supervisor Runion and the Town Board returned to the boardroom and Supervisor Runion stated that the Town of Guilderland had reached an agreement with James R. Murley and his attorneys with respect to the outstanding administrative proceeding commenced pursuant to Article 75 of the Civil Service Law and Section 155 of Town Law.
Pursuant to the town agreement, Mr. Murley, a town employee for over 35 years, has submitted his retirement papers to the N.Y.S. Comptrollers Office to be effective May 30, 2007.
Effective April 27th, Mr. Murley ceased to be an active employee of the Town of Guilderland.
Supervisor Runion answered questions from reporters.
