Town Board Minutes 12/05/2006
A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag.  Roll call by Rosemary Centi, Town Clerk, showed the following to be present:

Supervisor Runion welcomed everyone to the evening’s meeting and asked for a motion approving the minutes of the November 21, 2006 Town Board meeting.



MOTION #238  Councilman Bosworth moved to APPROVE THE MINUTES OF THE NOVEMBER 21, 2006 TOWN BOARD MEETING.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

PUBLIC HEARINGS:



7:30 PM – Increasing Senior Citizen Tax Exemption income limits

Town Clerk, Rosemary Centi, read the legal notice.

Supervisor Runion explained the increase in income limits that a senior citizen may have in order to receive a tax exemption. What is new is that it is a multiple year plan until 2009.

MOTION # 239  Councilman Bosworth moved to CLOSE THE PUBLIC HEARING ON THE SENIOR CITIZEN TAX EXEMPTION INCOME LIMITS.  Councilman Ricard seconded the motion and it was carried by the following roll call vote:

MOTION #240  Councilman Bosworth moved to ADOPT LOCAL LAW  #7 OF 2006 AMENDING LOCAL LAW #10 FOR 1984; THE TOWN OF GUILDERLAND SENIOR CITIZEN TAX EXEMPTION LAW.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

AGENDA ITEMS:



#1- Consider accepting for public review the Draft Environmental Impact Statement submitted by Glass Works Village.

Supervisor Runion stated, as the document was quite lengthy; that the Board would like additional time for review to determine completeness.  The board would then set a public hearing for public comments.

Jim Schultz, attorney for the project, stated that they would like to set the public hearing for March in order to proceed.

Councilman Bosworth asked the project representatives if all questions that were asked by the Board at a prior meeting be identified in the document in order to expedite review.

They stated that they would.

MOTION #241  Councilman Ricard moved to AUTHORIZE A WARRANT ADJUSTMENT FOR 2093 WESTERN AVENUE DUE TO AN INCORRECT METER READING.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:

MOTION #242  Councilman Ricard  moved to AUTHORIZE THE SUPERVISOR TO SIGN A COLLECTOR’S WARRANT FOR GUILDERLAND WATER DISTRICT WESTERLY EXTENSIONS IN THE AMOUNT OF $425,002.50.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #243  Councilwoman Slavick moved to APPROVE TRANSFERS AS SUBMITTED BY JEAN STERLING, COMPTROLLER.  Councilman Bosworth seconded the motion and it was carried by the following roll call vote:

Supervisor Runion explained that the Town Board had entered into Executive Session at the last meeting in order to discuss the various insurance renewal contracts.

The Board authorized the Supervisor to negotiate with the various carriers for renewal of the Town’s insurance program.

Prior to December 1st, the renewal date, the sum of $550,000 was budgeted for insurance renewals.

The current carrier had an initial proposal of $1 million worth of coverage with a $1 million umbrella.

The renewal rate was $515,000.  By looking at some competitive proposals, the Town was able to pare down the current carrier’s premium costs.

The base is now  $1million worth of coverage with a $5 million umbrella.

The premium total is $465,065.10, which is a substantial reduction.

The Supervisor asked the Board to ratify the renewal based on the new premium rates.

Councilwoman Slavick asked if the coverage of the vehicles had changed.

Supervisor Runion explained the difference.  The Town has instituted a fleet coverage.


Councilman Pastore asked if the Town had full terrorism coverage and Supervisor Runion stated that they had and also issues relative to zoning under the Public Officials portion of the contract.

Supervisor Runion explained the policy for Public Officials and the Police Department.


Councilman Bosworth asked about the basis of current liability.  Supervisor Runion stated that the policies that the Town has are all occurrence policies.




MOTION #244  Councilman Ricard moved to RATIFY THE TOWN’S INSURANCE RENEWAL BASED ON THE NEW PREMIUM RATES.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #246  Councilman Bosworth moved to ADOPT LOCAL LAW #8 FOR 2006 AMENDING LOCAL LAW #3 OF 1998, GRANTING A PARTIAL TAX EXEMPTION OF REAL PROPERTY OWNED BY PERSONS WHO ARE DISABLED IN ACCORDANCE WITH THE PROVISIONS OF REAL PROPERTY TAX LAW, SECTION 459-C.   Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:
