Town Board Minutes 09/19/2006
A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag.  Roll call by Rosemary Centi, Town Clerk, showed the following to be present:

BUDGET WORKSHOP SESSION: 6:30 PM – Town Board Conference Room

Adjourned at 7:30 pm to Regular Town Board meeting.



Supervisor Runion welcomed everyone to the evening’s meeting and asked for a motion approving the minutes of the September 5, 2006 Town Board meeting.



MOTION #190  Councilman Bosworth moved to APPROVE THE MINUTES OF THE SEPTEMBER 5, 2006 TOWN BOARD MEETING.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

Supervisor Runion reminded everyone of the Hazardous Waste Day to be held on Saturday, September 23, 2006 from 8 am to 2 pm at the Highway Garage on French’s Mill Road.

PRESENTATION:  McKownville Zoning Study Committee – Report on Western Avenue Corridor

Supervisor Runion stated that in December of 2005, the Town Board appointed a committee to review the Western Avenue Corridor and to come up with recommendations for development for that area.

Members of the committee were Donald Reeb, Laura Whalen, Stephen Haraurasz, Mark Macomber and Alice Torda.



Donald Reeb stated that the committee had met frequently with Town Planner, Jan Weston as their guide.

They felt that there were very few parcels left to develop on the corridor and that there were a few properties that the committee were concerned with.

Laura Whalen thanked the Town Board for allowing their committee the opportunity to think about their neighborhood.  She also thanked Town Planner, Jan Weston and Don Csaposs for their help.  She stated that they would like to keep the development at a human scale.



Mark Macomber also thanked the board.  He stated that he discovered a frustration with the residents in that they do not have the same resources at their disposal that a developer would.

He suggested a pamphlet for residents advising and guiding them in their developmental process.



Supervisor Runion thanked the committee for their long hours in analyzing the Western Avenue Corridor and for their recommendations.

He further stated that he found the report enlightening as it contained a very detailed analysis of the corridor with recommendations geared toward improving the quality of life within the McKownville area.

He further stated that over the next several weeks the Board would be looking at implementing some of their recommendations.



Councilman Bosworth stated that it was the first document that they had seen from the neighborhood association for a very long time.  He hoped that this would not be the end of their involvement.



Councilman Ricard stated that the committee had done a very professional job.



Councilwoman Slavick thanked the committee and stated that they had done a very detailed and comprehensive document.



Councilman Pastore also stated that he was very impressed with the report and felt that this report equalled the content and quality of professional reports that the Town had seen.

He commended the committee on its work.



Supervisor Runion stated that after the budget process he would like to set up some work sessions regarding the report.





MOTION #191  Councilwoman Slavick moved to APPOINT EILEEN T. MAGENIS (DEPT. OF WATER & WASTEWATER MANAGEMENT) AND SUSAN M. MERKLEY (POLICE DEPT.) AS KEYBOARD SPECIALISTS FROM ALBANY COUNTY CIVIL SERVICE LIST.  Councilman Ricard seconded the motion and it was carried by the following roll call vote:

MOTION # 192  Councilman Bosworth moved to APPOINT STACIA SMITH-BRIGADIER AS PERSONNEL ADMINISTRATOR PER ALBANY COUNTY CIVIL SERVICE LIST.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:

Item # 4 on the agenda concerned awarding the bid for the demolition and removal of the Depot Road water tank.

Supervisor Runion stated that there had been a question from the second highest bidder for this project indicating that the low bidder should be considered a non-responsible bidder because of the lack of a corporate seal on their surety of intent and failure to provide original signatures on one form.

It was felt by the Town Attorney that there was case law to support that this was ministerial and did not preclude them from bidding.



MOTION #193  Councilman Ricard moved to AWARD BID FOR DEMOLITION AND REMOVAL OF THE DEPOT WATER TANK PER RECOMMENDATION OF DEPARTMENT OF WATER AND WASTEWATER MANAGEMENT.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:

MOTION #194  Councilwoman Slavick moved to AWARD THE BID FOR REPAIR AND PAINTING OF THE WESTMERE WATER TANK PER RECOMMENDATION OF DEPARTMENT OF WATER AND WASTEWATER MANAGEMENT.  Councilman Ricard seconded the motion and it was carried by the following roll call vote:

MOTION # 195  Councilman Ricard moved to WAIVE THE BUILDING PERMIT FEE FOR PREMISES LOCATED AT 464 CHURCH ROAD (TAX MAP #52.18-4-11) DUE TO PREMISES BEING DAMAGED BY FIRE.  Councilman Pastore seconded the motion and it was carried by the following roll call vote:

MOTION #196  Councilman Bosworth moved to AUTHORIZE SUBMISSION OF A GRANT REQUEST TO CAPITAL DISTRICT TRANSPORTATION COMMISSION PURSUANT TO THE “COMMUNITY AND TRANSPORTATION LINKAGE PLANNING PROGRAM FOR 2007-2008” IN THE AMOUNT OF $24,800 FOR THE PREPARATION OF A NEIGHBORHOOD MASTER PLAN FOR THE HAMLET OF GUILDERLAND CENTER.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #197  Councilman Ricard moved to APPROVE AUTHORIZING THE SETTLEMENT OF SEVERAL TAX ASSESSMENT CASES PER THE RECOMMENDATION OF THE ASSESSOR AND TOWN ATTORNEY.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

Supervisor Runion stated that the Board was still looking at the employee manual that had been tabled from the last meeting and that after some corrections would be adopted at the next board meeting.

The board would be continuing their budget workshop in the upstairs conference room and all were invited to attend.

 


MOTION #198 Councilwoman Slavick moved to ADJOURN THE REGULARY SCHEDULED TOWN BOARD MEETING AT 8:07 PM AND MOVE TO THE BUDGET WORKSHOP SESSION.  Councilman Ricard seconded the motion and it was carried by the following roll call vote:
