Town Board Minutes 09/05/2006
A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag.  Roll call by Rosemary Centi, Town Clerk, showed the following to be present:

Supervisor Runion welcomed everyone to the evening’s meeting and asked for a motion approving the minutes of the July 11, 2006 Town Board meeting.

MOTION #170  Councilman Bosworth moved to APPROVE THE MINUTES OF THE JULY 11TH, 2006 TOWN BOARD MEETING.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

PUBLIC COMMENT PERIOD – No Public Comment



PUBLIC HEARING: 



7:30 PM – Local Law allowing car washes to connect to municipal water.

Rosemary Centi, Town Clerk, read the legal notice.



Town Attorney, Richard Sherwood, stated in speaking with Bill West, Superintendent of Water and Wastewater Management, a law was in place to regulate the usage of municipal water.  Since the car wash would be using water in the winter at slower usage times Mr. West did not have a problem with the change in the law.

MOTION # 172  Councilman Ricard moved to ADOPT LOCAL LAW #6 OF 2006 DELETING THE PROHIBITION OF  CAR WASHES FROM  USING MUNICIPAL WATER.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

AGENDA ITEMS:



Item #1 on the agenda concerned retaining Delaware Engineering to prepare map, plan, and report for West End Water System Improvements.

Supervisor Runion stated that a consultant had taken a look at constructing a west end water main extension, which would loop to the town’s present water system.  This would loop the dead end lines and improve water quality.

Ed Hernandez presented for Delaware Engineering.

He stated that his firm had developed several options for serving the Weaver Road area and the Chandler Road area and coming down Route 158 that would provide cost effective service to the greatest number of residents.



Supervisor Runion stated that the first thing that the Town Board needed to do would be to select an option.

Mr. Hernandez stated that the recommended option would be to come down the existing connection at Hurst Road near the park to Route 146 to serve Weaver Road, around Route 158 to loop the system, cross Route 20 to serve Chandler and then down Old State Road and Miller Road which would provide a loop and connect the system at three points.



This would be Chandler Option 3, Weaver Option 2 and then the Route 158 extension.

This would serve the most existing residents.



A discussion ensued concerning the number of homes to be serviced.



Councilman Bosworth asked about the number of homes that could be served under these options.

Mr. Hernandez stated that under Chandler Road -Option 3 –60 customers

                                                     Weaver Road – Option 2, with a small additional extension just beyond Depot and Route 146, Option 2A – 33

                                                     Church Road – 30

                                                      Grant Hill – 4

                                                       Rt. 158 – 31 



The study is posted on the Town’s website.



Mr. Hernandez stated that in looking at the various options, cost and the greatest number of people served weighed in the decision.

Some people would be left out due to the cost factor.  A cut-off had to be decided upon.

Mr. Hernandez further stated that the Church Road extension would give the Town an interconnection with the Town of Rotterdam, which in turn is connected with the City of Schenectady.  This would be an important interconnection in case the Town of Guilderland should need additional water.  It would provide service to 30 homes.

The preliminary cost estimate for all of the recommended extensions would be approximately $7.1 million.



The Chandler Option 3 would be $2.4 million.

Weaver Options 2 and 2A is $1.8 million.

Church Road - $446,000

Grant Hill - $300,000

Rt. 158 - $2.1 million.



The typical capital cost to a resident in the new service area is approximately $456.20 per year.

The estimated annual cost to an existing customer within the district is approximately $9.87.

The one-time connection fee is $1,750 to cover installation of the meter and service connection.

Supervisor Runion stated that the $456.20 is debt service principal and interest.

The water usage charge is around $118.00 added to the $456.00.

This amount would be weighted so that new customers in the system would pay the bulk of the cost of the extension.



Bob St. Pierre – Weaver Road, asked about development in the area.



Supervisor Runion stated that before this study was done, the Comprehensive Plan and the Rural Guilderland Studies were done.  There was a variety of zoning changes that were recommended and implemented that would insure that future growth would not be spawned by the water extension in and of itself.



James Bruce – Weaver Road, stated that he very much appreciated that water would be brought to the West end.

He also read a note from Robert and Ruth Quay stating that they were in favor of the extensions.



Supervisor Runion stated that this is an extension that would take care of a number of problems concerning water issues.



Ken French – Chandler Road, asked about the loan period and whether there were plans for a junction to County Line Road to Route 158.



Supervisor Runion stated that it was a 30-year bond and that there would not be a connection to that area.  The options recommended allow for looping existing water lines and improving water quality.  He stated that the cost for extensions prohibited connecting to all areas.



Stuart Dean – Weaver Road, stated that he would not be getting water but that he was in favor due to the fact that there would be a fire hydrant and his insurance rates would be reduced.

Supervisor Runion stated that within the report fire flows would be analyzed.



Brian French – Gay Lane, stated that the people in the Chandler Road area really need water.



Mr. Hernandez summarized the steps necessary before construction could begin.

· Prepare Map plan and report

· Detailed outline of construction and cost

· SEQR requirements

· Surveying / archaeological studies

· Design process for project

· Completion in approximately 1-2 years.



Councilwoman Slavick asked if the $7.1 million included all cost.

Mr. Hernandez stated that it did.

Councilman Bosworth clarified that this would be an extension to existing homeowners.



Councilman Pastore asked if the numbers cited earlier for the increase in the number of homes that would be supplied water also included homes whose water quality would be improved by the extension.



Mr. Hernandez stated that it did not, but that you could basically include the entire water district because the quality of water would be improved throughout the extension due to the looping.  These were specifically homes that did not have municipal water.

 

Councilman Pastore asked if this should be a consideration in picking an option.

Mr. Hernandez stated that those homes would be picked up by any of the options.



Councilwoman Slavick asked if homeowners could opt to not connect.



Mr Hernandez stated that they did not have to connect but they would still have to pay the bond cost.  This was the only way to be able to fund the extension.



Gary Beckman asked how vacant land would be assessed.



Donna Miller asked how much existing users paid before.  She asked why the rest of the Town could not shoulder more of the cost.



Supervisor Runion stated that the Comptroller’s Office looks at the relative cost allocation and comes up with a formula.

He further clarified that if the current residents were to pay off the current system on their own, without any sharing throughout, the cost would be approximately $3,342 per year per resident.



Bill Miller – Weaver Road asked about future construction and whether they would pay any of the cost.



Supervisor Runion stated that when they hooked up they would pay the full hook up fee and the cost per year.



John Abbruzzese asked if the State mandated that dead end lines be connected in the future.



Supervisor Runion stated that there was not a mandate, but that the standards for the quality of water were becoming more stringent and the standards could not be met in any other way.



Mr. Abbruzzese stated that he was in favor of the water extension.

Supervisor Runion stated that the Town has been mandated to undertake an MS-4 program, which is a storm water management program.

The Town is at the point where it needs to start implementation of the detection of illicit discharging and to map areas of storm water drainage.

In order to do that, an appointment needed to be made of someone with a degree in Natural Sciences.

Ed Zyniecki has a degree in that field.  He will be working in a new department that will be called Community Environment.



Councilwoman Slavick asked if there would be a Civil Service test for the position and Supervisor Runion stated that a test was being prepared.
