Town Board Minutes 04/04/2006
A regular Meeting of the Town Board of Guilderland was held at the Town Hall, Route 20 McCormick's Corners, Guilderland, NY, on the above date at 7:30 pm.  The meeting was opened with the Pledge of Allegiance to the flag.  Roll call by Rosemary Centi, Town Clerk, showed the following to be present:

Supervisor Runion welcomed everyone to the evening’s meeting and asked for a motion approving the minutes of the March 21, 2006 town board meeting.

MOTION #84  Councilman Bosworth moved to APPROVE THE MINUTES OF THE MARCH 21, 2006 TOWN BOARD MEETING.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

PUBLIC COMMENT PERIOD – No public comment




PUBLIC HEARING:

7:30 PM – Local Law increasing Veteran’s Exemption



Town Clerk, Rosemary Centi, read the legal notice.

Supervisor Runion read a memo from Town Assessor, Carol Wysomski (P 32A)

regarding the amount of the cap increase that could be up to $240,000.

$240,000 was the recommended amount and would keep the exemption amounts between the County and the Town the same.

MOTION #85  Councilman Bosworth moved to CLOSE THE PUBLIC HEARING ON INCREASING VETERAN’S EXEMPTION.  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

Supervisor Runion stated that the local law provides the additional caps and felt it was important to keep up with the upper cap level because the town’s assessments are based on full value.  This would insure that our veteran’s would qualify for maximum exemption allowed under the law. 






MOTION #86  Councilman Bosworth moved to ADOPT LOCAL LAW # 1 OF 2006 ADOPTING CHAPTER 256 OF THE LAWS OF NEW YORK FOR 2005, AMENDING SECTION  458-a OF THE REAL PROPERTY TAX LAW REGARDING INCREASING THE MAXIMUM TAX EXEMPTIONS FOR VETERANS.  Councilman Ricard seconded the motion and it was carried by the following roll call vote:

Item # 1 concerned setting a public hearing to re-zone premises located at 2026 Western Avenue (51.07-2-14) and 2028 Western Avenue (51.07-2-46) from Local Business to BNRP (Business Non -Retail Professional).

MOTION #87  Councilwoman Slavick moved to SET A PUBLIC HEARING ON MAY 16, 2006 AT 7:30 PM TO RE-ZONE PREMISES LOCATED AT 2026 WESTERN AVENUE (tax map 51.07-2-14) FROM LOCAL  BUSINESS TO BNRP (BUSINESS NON-RETAIL PROFESSIONAL).  Supervisor Runion seconded the motion and it was carried by the following roll call vote:

MOTION #88 Councilman Bosworth moved to SET A PUBLIC HEARING ON MAY 16, 2006 AT 8:00 PM TO RE-ZONE PREMISES LOCATED AT 2028 WESTERN AVENUE (tax map 51.07-2-46) FROM LOCAL BUSINESS TO BNRP (BUSINESS NON-RETAIL PROFESSIONAL).  Councilman Ricard seconded the motion and it was carried by the following roll call vote:

Item #2 concerned setting a public hearing to re-zone lands within the Normanskill Flood Plain from RO-40 to Rural Agricultural 3 (RA3).

Supervisor Runion stated that he had received a memo from the Town Planner, Jan Weston regarding problems with density for development in the area. (P 33A)



Councilman Bosworth asked if, in the future, people wanting to build in the area would be inhibited somewhat by the re-zoning because of the flood plain.

Supervisor Runion stated that they would have been inhibited by the flood plain regardless of the zoning.

He further clarified that the purpose of the re-zone was to permit more compact development within the area similar to what has been done in the Western Guilderland Plan in order to permit larger areas of wetland or other aesthetic features of the property to be set aside.

He further stated that there has been interest expressed to the Planning Board about developing these sights.

This would be viewed as an environmental protection.



Councilman Pastore asked what the current status of the property was.

Supervisor Runion stated that a portion of the property does have a pending application before the Planning Board but no concept approval because of issues with public water and sewer, which is not available to this property.

MOTION #89  Councilman Bosworth moved to SET A PUBLIC HEARING ON MAY 16, 2006 AT 8:30 PM TO RE-ZONE LANDS WITHIN THE NORMANSKILL FLOOD PLAIN FROM RO-40 TO RURAL AGRICULTURAL 3 (RA 3).  Councilwoman Slavick seconded the motion and it was carried by the following roll call vote:

MOTION #90  Councilman Pastore moved to ADOPT A RESOLUTION  FOR AN ANNUAL PLAN FOR 2006 FOR THE TOWN OF GUILDERLAND SECTION 8 CHOICE VOUCHER PROGRAM AND AUTHORIZE THE SUPERVISOR TO SIGN A CERTIFICATE OF COMPLIANCE WITH SECTION 8 HOUSING PLAN


           

WHEREAS, the town of Guilderland operates a Section 8 Housing Choice Voucher Program funded by the U.S. Department of Housing and Urban Development,

and



WHEREAS, the town of Guilderland is required by the U.S. Department of Housing and Urban Development to prepare and adopt a written Annual Plan that establishes local policies for administration of the Section 8 Housing Choice Voucher Program in accordance with regulations of the U.S. Department of Housing and Urban Development, and



            WHEREAS, the town board of the town of Guilderland has caused a written Annual Plan for 2006 to be prepared establishing local policies for administration of the

Section 8 Housing Choice Voucher Program in accordance with regulations of the U.S. Department of Housing and Urban Development, and has reviewed such written plan,



            NOW THEREFORE, BE IT RESOLVED that the town board of the town of Guilderland hereby adopts the Annual Plan for 2006 for operation of the town of Guilderland Section 8 Housing Choice Voucher Program.

Item #4 on the agenda concerned appointing Gregory Amyot to position of Fire Inspector from the Albany County Civil Service List.

Supervisor Runion stated that Mr. Amyot was #1 on the list and recommended by Chief Fire Inspector, Donald Albright. Mr. Amyot has all required certifications. 

MOTION #91  Councilwoman Slavick moved to APPOINT GREGORY AMYOT TO POSITION OF FIRE INSPECTOR FROM THE ALBANY COUNTY CIVIL SERVICE LIST.  Councilman Bosworth seconded the motion and it was carried by the following roll call vote:

MOTION #92  Councilman  Bosworth moved to APPOINT CHRISTINE RITMO AS DEPUTY COURT CLERK PER ALBANY COUNTY CIVIL SERVICE LIST.  Councilman Ricard seconded the motion and it was carried by the following roll call vote;

Item #6 on the agenda concerned authorizing the Supervisor to sign a lease agreement with Cellco Partnership for location of wireless equipment at Ft. Hunter Water Tower.

Supervisor Runion stated that this was a proposed lease similar to other leases with wire carriers. Approval contingent on zoning board approval and on structural and sight review conducted by the town designated engineer.

MOTION #93 Councilman Pastore moved to AUTHORIZE SUPERVISOR TO SIGN A LEASE AGREEEMENT WITH CELLCO PARTNERSHIP FOR LOCATION OF WIRELESS EQUIPMENT AT FT. HUNTER WATER TOWER CONTINGENT ON ZONING BOARD APPROVAL AND TOWN DESIGNATED ENGINEER APPROVAL OF THE STRUCTURAL COMPONENTS OF THE ANTENNAE.  Councilwoman Slavick seconded the motion and it was carried by the following roll vote:

Item #7 on the agenda authorizing the Supervisor to sign a Collector’s Warrant for the town of Guilderland – tabled.

Supervisor Runion stated that 1600 water bills had been mailed and due to an error in the billing rate used, the amount on a number of the bills was wrong.  Any amount over $35.00 was in error.

Checks would be returned with new bills and an explanation to those customers.











Item #8 on the agenda concerned accepting a deed from Woodland by Mitchell, LTD of green space along Normanskill located within such subdivision.

Town Attorney, Richard Sherwood had reviewed all documents and found them to be in order. Subdivision has been completed.

Councilman Bosworth asked the Supervisor to have someone from the City of Albany make a presentation on what their plans are regarding their landfill.
