Conservation Commission Minutes 10/10/2007

The following minutes are transcribed from notes taken by M. Dempsey.

M. Dempsey made a motion to open the meeting at 7:20 pm.  T. Grim 2nd.  All in favor.  Unanimous.  

Attendance:  T. Schaefer, M. Dempsey, J. Stewart, C. Keene, T. Grim    

1.  M. Dempsey made a motion to accept the minutes from August 8, 2007 as submitted.  T. Schaefer 2nd.  4 voted “yes”.  1 abstain.  Motion passed.  

2.  M. Dempsey made a motion to accept the minutes from September 12, 2007 as submitted.  T. Grim 2nd.  5 voted “yes”.  Motion passed.  

3.  Tabled discussion and vote on Open Space plan until November 14, 2007 meeting.

4.  Tabled Veasey Tree Removal plan until November 14, 2007 meeting.

5.  Seasonal Restriction Visits.  ConCom should do these this month if possible before November 1, 2007.

6.  42 Center St./ GRDA/Septic
     Present:  Rich Briscoe, William Powers

The system is out of the 100’ buffer, but within 200’ of a pond.  There is a slope down towards the system.  The system has failed.  An emergency order would make sense.  Erosion controls are on the plan in the front of the house next to the street across from Johnson Pond.  

They will install erosion controls on October 11, 2007.  ConCom will issue an emergency order and permit letter.  M. Dempsey made a motion to issue an emergency order to start work on October 12, 2007, with erosion controls on plan as noted.  T. Grim 2nd.  All in favor.  Unanimous.    Fax plan to: 978-372-2450.

7.  29 Cannon Hill Ave.
     Present:  Ken & Andrea Belisle

Request for waiver from seasonal restriction.  They will have the foundation and frame in place November 1, 2007.  Request a 3 week waiver.  Typical fee for this would be $1,050 for 15 days.

The site is not at risk for any further problems.  T. Grim made a motion to grant a waiver to the seasonal restriction for a period not to exceed 21 calendar days to November 21, 2007 and reduce the waiver fee to $10/day at 29 Cannon Hill Ave. for work on the building.  T. Schaefer 2nd.  All in favor.  Unanimous.  ConCom will issue a letter for this.  The Belisle’s will mail or drop off a check for $210.  

8.  196 King St. GNOI (extension)/NOI (new) continued from 9/12/2007.
     Present:  Nicholas DeCoulous, Michael Soraghan

Engineer – Michael Soraghan, PE, explained the septic system.  

The plan has been approved by the Board of Health.  There is a reserve area as noted on the plan.  Abutters complained about flooding of their basements, the septic system should not affect it positively or negatively.  The system must be where it is located and the house the same, due to restrictions on closeness to the nearby wells and wetlands.  He recommends removing the stone wall to assist critter access through the property.  

Question: Does the system require pumping every year?  No, but it does require yearly inspection because its an innovative system as noted by DEP.  We discussed the letter of September 17, 2007 from NHESP.  The applicant plans on discussing their project with them – Patrick Seekamp.  Tom Schaefer will call NHESP about their concerns.

The applicant will remove one (1) haybale every 50 ft.  Continued until November 14, 2007.  (They will not come again until NHESP responds).
