Conservation Commission Minutes 04/04/2007
April 4, 2007  

Present:  J. Termini, S. Benanti, T. Schaefer, J. Stewart, T. Grim, M. Dempsey

ConCom Business – 2 COC signed and notarized.

ConCom Business – Summer Hours
 
J. Termini made a motion to have summer hours as follows:  All of June, 2007, every Monday evening from 7-8 pm.  July and August, 2007, every other Monday evening from 7-8 pm.  

T. Grim made a motion approve extensions to the Order of Conditions for Stonebridge Road OOCs: Lot 24, 3 Stonebridge and, Lot 15, 23 Stonebridge.  J. Termini 2nd.  All in favor.  Unanimous.  

T. Grim made a motion that grant to Order of Conditions to Lots 5 and 6 and 784 Salem St. and the overall subdivision OOC to 2 year extensions.  T. Schaefer 2nd.  All in favor.  Unanimous.   

T. Grim made a motion accept the February 7, 2007, minutes as submitted.  J. Stewart 2nd.  4 in favor.  1 abstention.  Motion passed.   

T. Grim made a motion accept the March 7, 2007, minutes as submitted.  T. Schaefer 2nd.  4 in favor.  1 abstention.  Motion passed.

2 Mill Street Extension
Present:  Ben Osgood, Rich Briscoe

Meeting opened 7~:42 pm.  Rich Briscoe submitted a map.  The whole site is within the Riverfront Protection Zone.  They are installing on the highest possible spot.  There is no danger of waiting until April 15th.  Currently pumping to keep it under control.  Erosion controls will be a double stacked haybales with silt fence.  The tank will be raised and reused.  Work will take appx. 3-4 days.  Commissioners requested a preconstruction meeting  4 days in advance.  DEP wants them to file state and local Title 5 applications before issuing an Order of Conditions.  They said it’s filed but did not have proof of that. They will get a copy of it and submit to ConComm. Will spray grass after work.  M. Dempsey will put that in as a condition.  M. Dempsey made a motion that ConCom close this hearing and approve this project with an Order of Conditions.  T. Grim 2nd.  All in favor.  Unanimous.   

M. Dempsey does not agree with a 2 year extension for OOC extension requests.  He would have preferred a 6 month extension.  Discussion followed.  Argument against would push all projects to be finished as soon as possible.  If not build within a reasonable amount of time, come back and reapply.  Says 4 years is an unreasonable amount of time.  

ConCom Business - Stonebridge Rd.  

Discussion about enforcement and concerns expressed to ConCom regarding Stonebridge tree cutting compliance with some of our orders.  T. Schaefer is going to follow up with the Planning Board to get more info.  Will discuss at next meeting, May 2, 2007.   

ConCom Business – Order of Conditions
T. Grim suggested that Claudia McKee research those Orders of Conditions that are in question and find out which are actually on deeds.  Perhaps offer them a pre-discounted or a condition rate for older OOC.  The onus is on them to take care of it.  T. Grim made a motion to have Claudia investigate these OOCs issued prior to 1996; determine which ones filed and with Essex County of deeds; and pursue closure (getting COCs) on those.  Issue reduced rate COC prior to 1996 of $150.  T. Schaefer 2nd.  Discussion followed.  Ask for proof of filing at pre-construction meeting.  **ConCom will add to all future OOCs to require the proof of filing with Essex County of Deed of OOC before allowing building to begin.**  5 yes, 1 no.  Motion passed.   

ConCom Business - Meadow Pond

Need to file with ConCom.  M. Dempsey will bring to next meeting.     

There is a major problem of increased ATV usage.  Signs are being made to say “No Motorized Vehicles” Town of Groveland ordinance.   Spoke with Scott Morse – suggested signs.   

ConCom Business – Upcoming Town meeting April 30th.    

T. Grim made a motion to adjourn.  T. Schaefer 2nd.  All in favor.  Unanimous.
