Conservation Commission Minutes 01/10/2007
January 10, 2007

Present:  M. Dempsey, T. Schaefer, S. Benanti, J. Termini

Meeting opened 7:25 pm.  

ConCom Business – M. Dempsey made a motion to accept minutes as submitted for December 6, 2006.  J. Termini 2nd.  All in favor.  Unanimous.   

ConCom Business – Monday Night Sign-Off Sheet.  Commissioners scheduled dates for Monday night sign-off availability.  

ConCom Business - Orphan NOIs – Conservation has 4 NOIs that were filed in the past with unresolved issues, ie, missing fees, missing plans, revoked number, etc.  M. Dempsey recommends revoking all permits for these sites and if the resident comes in with a future filing, they are going to have to clear up any past issues.  J. Termini recommends sending an enforcement letter informing them that they will not have access to any permits in town until they’ve resolved the issues, ie pay fees, acquire a new DEP number, or inform ConCom that they’ve never done the project.  L. Felch will write the letters and send certified.  

T. Schaefer said in regard to 66  Main St., that the home is for sale.  He was contacted by an attorney who represents the seller.  The back part of the home or shed has been taken down and there’s a big hole in the ground.  All erosion controls are still in.  T. Schaefer informed the attorney that they’d need to refile for everything.  The house is currently vacant.     

National Grid – Repairs Baldwin Cont.
Present:  Tim Sullivan

Hearing opened at 7:34 pm.  Nothing has changed since the site visit.  M. Dempsey made a motion to close the hearing on the local and state filing permit for National Grid Right of Way behind Baldwin Terrace finding positively and issuing a permit. J. Termini 2nd.  J. Termini requested that they go through the Certificate of Compliance process immediately.  Tim Sullivan said yes, he would.  All in favor.  Unanimous.  Closed 7:37 pm.  

National Grid – Repairs Ashcroft GNOI/NOI Cont.
Present:  Tim Sullivan; Frank Joyal, abutter

Hearing opened at 7:37 pm.  Site visit was held December 9, 2006. Frank Joyal asked about the collapsing culvert.  He was told there would be a cement fascia in front of it.  T. Sullivan said they did not.  F. Joyal said they took the rocks that were collapsing the culvert plastic pipe and piled more rocks on it.  He said they used round rocks on top of round rocks and that they will fall into the stream.  He wants to know if the job is complete?  T. Sullivan said the contractor decided to use a concrete bell instead of a headwall and slip the mate to the plastic pipe.  However, he wasn’t able to find something available.  What he did instead was found the longest flattest pipe on top first, and then extend rocks further into the stream channel.  It was the best fix he could make.  F. Joyal said it doesn’t look like they fixed it, but instead just delayed the problem.  He doesn’t think the rocks will stay on the pipe.  They will fall into the stream and impede the water flow.  Tim Sullivan submitted photos.  T. Schaefer is concerned regarding the small pipe and that it might fall in.  T. Sullivan there’s still work to be done there in the spring and that it isn’t finished yet. He suggested precast with wing-walls?  ConCom asked T. Sullivan to come back with something more substantial and that comes out a little farther.  A new condition can be added.  Continued until February 7, 2007.  Hearing closed 7:49 pm.   

368 Main St. Cont. Request for Seasonal Restriction Waiver
Present:  Peter Staples

Hearing opened 7:50 pm.  M. Dempsey read a letter from Christensen & Sergi requesting a one-week waiver within the time period of February 15th – March 15th.  ConCom informed P. Staples that he needs to notify us 48 hrs. in advance.  J. Termini a reduction in the fee to $1/day instead of issuing a waiver.  Chapter 91 will be obtained by February ’07.  A commissioner will come to look at the site before the work is done.  P. Staples is to notify ConCom if the weather is inclement.  M. Dempsey made a motion that ConCom grant a waiver from the seasonal restriction to Peter Staples at 368 Main St. to allow five (5) days of work between February 15 and March 15, 2007, and reduce the fee for the waiver to $1/ per day.  J. Termini 2nd.  All in favor.  Unanimous.  Hearing closed 7:55 pm.  M. Dempsey will compose a letter and send to P. Staples.  

10 Wood St. – Request for Release of Bond Monies
Present:  Brianna & Chris Kershaw

Hearing opened 7:56 pm.  Requesting money released.  The Kershaw’s submitted photos of completed work.  Conservation bond amount was $20,000.  Planning Board bond amount was $204,000, and they’ve released all but $18,000.  All the work has been done except they were told to wait on topcoat, which should wait one year.  Work is done.  
B. Kershaw submitted a COC Request and associated fee.  Needs to be inspected for Certificate of Compliance.  S. Benanti will visit and check the requirements.  M. Dempsey made a motion that ConCom return all funds and issue a COC for 10 Wood St. based on a positive inspection of the site within 10 days.  T. Schaefer 2nd.  All in favor.  Unanimous.  Hearing closed 8:09 pm.   

M. Dempsey made a motion to close the meeting at 8:16 pm.  T. Schaefer 2nd.  All in favor.  Unanimous.
