Selectmen’s Meeting Minutes
Tuesday – May 22, 2007 – 6:00 pm
Present: Selectmen - Selectwoman, Karen Day; Chairman, Aaron Kullgren; Selectman, Jarvis Adams, IV
Administrative Assistant, Deb Davidson taking minutes
Selectman Kullgren called the meeting to order at 6:00 pm
Appointments:
6:00 – Fire Chief, Jim Plourde – Fire Works Permit for ASE – Chief Plourde presented a form for granting class C fireworks. Chief Giammarino has no problem allowing Plourde to go forward with the fireworks display. Chief Plourde had provided Stephen Pelkey from Atlas Fireworks and Laura Sparling from American Steele, a copy of the requirements Chief Plourde requests.
Chief Plourde explained, his recommendations are not for the average homeowner. The document is meant to be for professional use only. Residential properties would need to remain in compliance with RSA 160.
Kullgren asked that Plourde remain in contact with all parties and notify the town office as to what is happening.
Adams asked about item #9 (The display company must agree to compensate the fire department to provide an engine company for standing by at the display until the area is determined to be safe.)
Plourde explained a donation to the Fire Department allows a Fire Truck and a person to be present; this is because the town of Greenfield is a volunteer department.
Chief Plourde will make changes and e-mail them to Deb
Other discussion: Everyone has their new pagers and is satisfied with them. Keene has switched towers, Greenfield now will utilize Crotched Mtn. & Beech Hill towers; it seems to be going well, we may switch towers again if it is found the pagers have a lot of “dead areas” in town.
Selectmen thanked Chief Plourde for his update.
6:15 – Al Burtt – Abatement Settlement Discussion – Adams let Mr. Burtt know he apologized for not getting in touch with him earlier to discuss this.
Mr. Burtt stated he misplaced a piece of paper with “the gentleman’s” name on it. Mr. Burtt wanted to point out a variety of errors from Avitar, that he believes got us to this place, he continued with his explanation. Burtt stated, “Whatever the outcome is, he hopes whenever a new contract is signed the loopholes will be considered”.
Mr. Burtt prepared a list of the costs he believes he should be reimbursed for.
Kullgren read the Pheasant Lane Mall case Mr. Burtt referred to, and pointed out that PLM was given a supplemental billing, unlike Mr. Burtt.
Mr. Burtt explained that an error was noted, and the property was not assessed for the 16’ room that was finished living area. The room was then assessed and no supplemental billing was given. Therefore, Burtt believes if he signs the agreement, they are giving him a supplemental billing.
Aaron stated we will run this by town counsel tonight and will be back in touch with Mr. Burtt in the near future.
6:50 – Kent Vincent (Mr. Vincent was not on the agenda) Mr. Vincent asked if he could discuss his report regarding FEMA; Vincent provided a listing of events that took place in Greenfield - there are a total of 75 events. Things are progressing and he will continue to work on this.
7:00 – In accordance with RSA 91A:3 II (c) motion by Selectman Kullgren to enter into a non-public – Seconded by Day & Adams
No discussion - Voted: Unanimously in the affirmative
7:30 – Motion by Kullgren to enter out of the non-public and to further seal the minutes. Seconded by Day & Adams.
Decision: a letter will be signed & sent to a citizen by the BOS

Decision: The BOS will send a letter to this citizen, and a town employee, will send a personally written letter to this citizen as well.
The Road Agent wanted to formally apologize to the Board of Selectmen for this misunderstanding.

Decision: Selectmen support a letter to be written to the resident and support the Welfare Director’s decision.
On-Going matters:
Recycle Brochure – Will remain on the agenda until it is resolved – Day will find out where the TRC is with this, as it would be nice to have it available for summer residents.
LaGuerre – Mr. LaGuerre contacted the central office this week, asking what is the status of the building permit – Kullgren wanted to go on record that the BOS will sign the building permit, not the Building Inspector. The BOS reviewed the Liability Release, there will be minor changes to reflect the wording “Town of Greenfield private road policy”, as well as including the words “Higgins Lane and/or Winamac Lane” throughout the document.
Discussion followed – In the event Attorney Teague approves release with the respective changes, then the BOS will have the building permit & liability release signed and prepared to sign all documents. If they can make it Thursday by 8:15 am they can have their permit.
Attorney Teague suggested add other road, minor adjustments to document were added/deleted. The changes will be provided to Mr. LaGuerre Wednesday am.
Other Business:
· Certificate of Attendance – DES Certificate for Frank Pelkey
· Neonakis – Selectmen reviewed an e-mail from Planning Board Chairman, Dario Carrara regarding Mrs. Neonakis’ need of subdivision. Adams reported the Planning Board at their May 21st meeting reviewed this situation. It was their opinion a minor subdivision is required and a road does not constitute a natural subdivision. Discussion followed. Attorney Teague discussed criteria which determines if a property meets natural subdivision – the case which is used is “Keene vs. Meredith”; the following is a simple test to use, if a property has a majority of the following it could be considered a subdivision, if the “no” outweigh
the “yes” it would not be a subdivision. If a property owner disagrees with the Planning Board decision, it can be challenged is Superior Court.
o Does a road goes through the property;
o Are there two separate descriptions on the deed;
o Has it been taxed as separate lots;
o Has it been used separately or as though it was one lot;
Attorney Teague commented that “whereas it doesn’t meet the majority of these criteria, and the road is the only one they have as a sub-divider, it is his opinion it would need a subdivision as the no’s outweigh the yes’”
This matter needs to be addressed by the planning board; a letter will be written to Mrs. Neonakis
Decision: A letter from the Board of Selectmen advising Mrs. Neonakis that she needs to go to Planning Board prior to selling the property to determine if a subdivision is needed.
· FYI - an employee has provided the central office with a doctor note indicating that due to illness this employee could not work for a few days. The employee has returned to work and will provide a note indicating ability to return to work and is 100%.
· RD Home Repair Loan & Grant program – Reviewed the 2007 criteria & posters
· Dodge Rd. – Wetlands Application was submitted from Gove Environmental Services
· Creating Positive Change – Invitation to their Annual Meeting – June 5 @ 5:30 in Peterborough. No Selectmen can attend
· SWRPC – Invitation to their Annual Dinner Meeting – June 19th at Franklin Pierce. No Selectmen can attend
· LGC card – Junk & Junkyard Guide - $12.00/copy; Discussion followed about Junk & potential Junkyards in town. Selectmen would like to have the guide purchased. Provide the copy to the Code Officer and have him report to BOS with his findings of situations within town.
· Driveway Permits – Heirs of Edward Coville were issued a driveway permit from the State for timber cut purposes
· News Release – Executive Council District Two Report
· Financial Statements – Brantwood Camp
· DRA – Missing documents from Town Meeting; discussion followed -
o Minutes – Town Clerk – Selectmen want it in the mail by next Tuesday
o Town Report – Town Clerk – Selectmen want it in the mail by next Tuesday
o MS-61 – Tax Collector – Selectmen want it in the mail by next Tuesday
o MS-11 – Town Clerk – Selectmen want it in the mail by next Tuesday
Letters –
o E-mail – Devine Millimet – “Things to consider before, during & after terminating employees” – complimentary monthly document from law firm.
o Letter of praise – Mrs. Margot Colburn of New Boston recently had an accident; her letter was commending Officer McMahon for his help and how he handled the situation with her.
o David Plourde – Damage to Dudley Road between Dunklee Hill Rd. & Blanchard Hill Rd. resulting from recent flooding. Selectmen discussed this, this matter has come up two other times, a copy of the letter was sent to the Road Agent, who indicated he would get to dumping some gravel out there to help the situation out.
§ Decision: A letter to the Plourde's, as well as the Road Agent will address the road and deposit gravel as soon as he can get to it.
o Hardwick – Intent to cut was reviewed, Mr. Hardwick is requesting use of the Class VI Portion of Old Lyndeborough Mtn. Rd.- Selectmen would like to meet with Lyndeborough BOS, and discuss this as well as the Town Forester. Administrative Assistant will set up a time for all to meet.
o Carbee – Selectmen reviewed Mr. Carbee’s response to their recent letter
o Corcoran Environmental Services – Kullgren read the letter submitted by Corcoran Environmental Services. Day reported on the meeting in Antrim on Monday, May 21. This company would like towns to join with them; they do single stream recycle, they separate everything, there would be only two containers - one for recyclable, one for rubbish. They also take demolition items; they take all the number of plastics. The TRC was at the meeting, Day asked them to research the program and determine feasibility for Greenfield. This could be a good option.
o RFP – CDBG Administration – Resume from Donna Kerwin Lane -
Crotched Mtn. – Selectmen will meet Tuesday, May 29th with Don Shumway & Michael Redmond to have a site walk of the Old Town Office to see what improvements have taken place. The meeting will be scheduled for 6:00 pm. There will be no other appointments scheduled for the meeting on May 29th.
Assessing –
· Craigin or Flynn Property – Selectmen briefly discussed this, they didn’t clearly understand the situation, and Day stated she would like to have the file to read it thoroughly on Thursday morning.
Legal questions -
Burtt abatement – Kullgren discussed the abatement with town counsel, explained how we got to where we are today. Discussion followed.
John Teague explained his opinion of this situation. Selectmen will grant the abatement.
Abatement – Smith – Granted
Vacation request – Catherine requested, in writing, vacation the week of June 29 through July 10th. Selectmen approved this request.
Road Bond – Dunklee Hill Road – Selectmen required a road bond for a timber cut last fall, the logging is complete, the road (now a class A Trail) was damaged as a result of the recent rain - not due to the logging operation. Bob Plourde had discussed this with Administrative Assistant, if the highway crew could dump a few loads of stone, Mr. Plourde will spread it about on the road with his equipment. Discussion followed.
Decision: Selectmen will return the road bond funds to the logger and the property owner, whereas the damage to the road was a result of the recent flooding and not due to the logging operation. The Road Agent will dump stone on the trail in an effort to repair the damage
Meeting adjourned at 10:40 pm – the next scheduled Selectmen’s meeting is Tuesday, May 29th , 2007 at 6:00 pm.
