Selectmen’s Meeting Minutes
Thursday – August 19, 2004 – 5:45 pm

Present: Selectmen:  Chairman, William Brooks; Selectman; George Rainier; Selectman; Conrad B. Dumas
Meeting called to order at 5:45 pm

6:00 - Mr. & Mrs. George Shepard – Selectmen were unaware of this situation, Peter Hopkins was also asked to attend in the event that there are any questions Selectmen are not aware of.   Mr. & Mrs. Shepard have concerns regarding Peter’s recommendation for them to go to the ZBA and request a variance to replace a trailer in kind.  
Selectman Rainier asked the Shepard’s to explain their situation.  Mr. Shepard stated that they did not change the setbacks, or the footprint of the foundation to place their new mobile home.  Shepard’s believe it would be a fire hazard, to ask them to place a structure connecting the two buildings.   
Selectman Rainier stated that he would like a little history.  
Mrs. Shepard stated that there have been two dwellings on this property since 1971, so she believes they are grandfathered.  They did not change the footprint of the trailer when they brought the new trailer in.   Mrs. Shepard stated that they couldn’t afford to remove the septic or the waterline.  The new trailer is almost the same as the old one, the current day trailers do not meet the same footage as the older trailers.
Peter stated he has intended and is going to send a notice of non-compliance to the Shepard’s. At this point they do not have an occupancy permit.  He cannot grant an occupancy permit because the original building permit has not been completed.  He had explained to them they could not remove the old dwelling without bringing the property up to today’s code.  Peter stated he had explained they could do that by setting the new trailer back further and connecting the two dwellings.  
Selectman Brooks explained to everyone what an occupancy permit is, and why it is necessary.
Hopkins stated he could issue an occupancy permit if they remove the rental unit and he is allowed a final building inspection.  The only other recourse is to go before the ZBA for a variance.  
Selectman Brooks explained the process of the appeal.  The Shepard’s will work with Hopkins to complete the application.
The Shepard’s were provided with an application for appeal to the ZBA, to file an appeal for an Administrative ruling.

6:24 – Cathy Cadorette – Mrs. Cadorette stated she has asked Tax Collector, Geisel to contact a credit bureau several times and let them know that the 1991 & 1992 tax liens were released.  She stated he hasn’t been helpful.  Selectmen instructed Deb to contact Geisel, ask him for a copy of the lien release and mail it to Mrs. Cadorette.  Selectmen asked that they be informed when it happens.
6:35 – RSA 91A: 3 II (e) In accordance with RSA 91A: 3 II (e) motion by Selectman Brooks at 6:35 pm to enter into a non-pubic session to discuss a legal matter. Seconded by Selectman Rainier. Voted Affirmatively
At 7:10 motion by Selectmen Brooks to adjourn the non-public session, and to further seal the minutes.  Seconded by Selectmen Rainier & Dumas.  Voted Affirmatively
7:00 – Resident, Charlie Robitaille – Asking for clarification of Recycling Policy – Mr. Robitaille did not show up
7:10 – Recycling Attendant, Frank Pelkey – To discuss the recycling center –
·       Glass disposal - Mr. Pelkey wanted to discuss a problem disposing of the glass, large pieces make it difficult to dispose of.  If a glass crusher was invested in he could recycle it and the Highway could use it for drainage.  Pelkey stated he has found a glass crusher; the price is $1,000.00. To dispose of glass you need 20 ton and they charge $350.00/load, if you can get someone to take it.   Selectman Dumas asked what does Peterborough do with their glass?  Selectmen would like this explored, they would like Pelkey to report back to them of their findings.  Where would the glass crusher go?  Pelkey stated the crusher could be housed in the glass bay – it needs to be kept under cover.
Selectmen asked if we have money for this?  Pelkey said yes, the metal removal has been paying us; therefore there will be funds available there.  
Selectmen asked what does the Town of Bennington do?  Pelkey stated he thinks they have a hopper for three different kinds of glass and they pay to have it removed through Waste Management.
Jim Plourde stated he would ask Chip what his dad does in Antrim regarding recycling glass.
Frank wanted to bring this about to make Selectmen aware of the situation.
No decisions were made on this at this time.  Further research will be reported back to the Selectmen before any decisions will be made final.

·       Demo dumpster – Pelkey stated that he understood there have been complaints that the dumpster is full on Tuesdays and people have been sent away.  Pelkey stated that there are some people in town that bring two or three loads of demo a week.  Pelkey would like a limitation on the amount of loads of demo allowed per family.  To have two dumpsters, it would not cost extra.  Discussion followed.  Selectmen commented that as long as it is not commercial dumping and it is residents who are remodeling, reroofing their homes etc.  it is not reasonable to expect a resident to keep their demo at their home three-four weeks. If they need to dispose of their debris, they should be allowed.
Decision:  Either get another dumpster and/or be sure the current dumpster is emptied by Tuesday.  Residents should not be turned away.  
·       New Roofing/New Bay – Selectmen asked Pelkey why he wants to recycle the old roof and what the cost for new roofing would be?  Pelkey stated he wasn’t sure.  He would have to get some prices for new roofing.  Selectmen would like new roofing on the new recycling building. Pelkey stated he would figure out what is needed and order it from Belletetes.   Pelkey stated there should be a slip on the original purchase.
Decision:  New roofing will be purchased for the new bay.  The old roof can be recycled in another way, perhaps the highway dept. could use it for something.
·       Recycling Bay – Selectmen would like to visit the center and see how things are going to work.  Selectmen will meet with Pelkey at the Recycling Center at 5:30 on August 26, 2004.  The Board of Selectmen want to see the proposed layout; Pelkey stated he has already built the office area.  Selectmen Rainier asked if the office area could be relocated if needed.   Pelkey said yes it could.

Mail –   Selectmen reviewed weekly miscellaneous mail
Fire Station – MaryAnn Waterhouse called, very upset about the excavation going on behind the Fire Station.  She was told a parking lot was being built, she was not notified, knew nothing of this.  She asked if Selectman Rainier would please call her?  Deb provided her phone number to Selectman Rainier.   Mrs. Waterhouse also stated that her driveway is still not correct.  She asked when would it be fixed?  Again, she asked if Selectman Rainier could please call her regarding this matter, as well.
Theresa Creighton – Mrs. Creighton came to discuss the railroad with Deb today.  She stated that she has been notified that she owes several hundred dollars to the railroad.  They indicated amounts of $1500, $350, $50/year, she is unsure what exactly these fees are for, and she has turned it over to Attorney Taft.   She indicated that the Town has been sanding the right of way for her.  She does have a right of way in her deed.  She would like a letter saying Magoon Lane is a Town Maintained Road.  It is not a town road, it is a private lane.  Mrs. Creighton indicated the “deal” with sanding was between her husband and Dean Russell some 30 years ago.  The town would sand, they would plow.  Selectmen instructed Deb call Attorney Taft and discuss the situation with him, as we don’t know the details.
FLSA Conference – Deb and Catherine attended a very informative conference regarding some recent changes to federal labor laws.  As a result of these federal laws,  some changes are needed to the Town of Greenfield personnel policies.  The policies will be worked on and hopefully ready for next week.  (i.e. hours actually worked MUST be reported, failure to accurately report is a reason for dismissal.  If an employee is only supposed to work 20 hours, that is all that should be worked.  If a disgruntled employee went to the labor board, knowing hours are not accurately reported the town would be in trouble.  Also, Federal Labor Board can do random inspections. For exempt/non-exempt reasons it is important to revise our job descriptions to clarify hiring/firing responsibilities, discretionary abilities, independent judgment & financial judgment are a few of the examples for the revision.  If time cards are in error when submitted and the Bookkeeper has to correct them, the department head and the employee must sign the noted changes.  There were many items that will be addressed internally for the Town.)  
Key Staff Meeting – The next Key Staff Meeting is scheduled for Thursday, August 26, 2004 at 6:00 pm.     
ZBA Appeal –  ZBA Secretary, Kevin O’Connell reported that the Zoning Board of Adjustment has received a letter from Silas Little, on behalf of Joe & Lee LeBlanc.  They are asking for a special exception on grounds that they have been denied building permit.  Kevin stated he would suggest they first apply for a building permit, which will be denied; otherwise they have no purpose for going before the zoning board of adjustment.  Though they applied for a building permit several years ago, it is believed it has expired, therefore this appeal is premature.
With no further business, the meeting adjourned at 8:00 pm.  The next scheduled Selectmen’s Meeting is Thursday, September 2, 2004 at 5:45 pm.
