Case 08-6

The Board met on October 15, 2008 to decide whether to vacate its decision of September 16 to deny a re-hearing of case 08-6, and allow an amended request for re-hearing of case 08-6 as motioned by Mr. Silas Little: council for Gene Mitchell.

After motions to vote, the board finds the following;
The Board unanimously grants the motion to vacate.
The Board unanimously accepts the amended request for re-hearing.
The Board unanimously finds that the facts stated in the original decision to deny motion for re-hearing case 08-6 stand, and the supplemental request did not address any error the board had made in it’s original decision, and did not provide any new evidence that changed the opinion of the Board.

Therefore, based on the above discussed the motion for re-hearing is DENIED.
