Preliminary Meeting Minutes –

Members present:  RMarshall, PRenaud, MBorden, SChicoine

7:03 p.m.   PRenaud began reading the January 14, 2013 meeting minutes.  Several spelling, punctuation and replacement of words were done. No substantive changes were made.  MBorden motioned to accept the minutes as amended.  PRenaud seconded.  Vote unanimous in favor.

7:27 p.m. Old Business
PRenaud commented, “We did not actually vote to approve the questions for ballot.  He note lines 72 to 76 of the January 17th meeting minutes which refer to the typographical changes only.  No vote was taken to approve the questions for ballot. RMarshall asked, “How do we rectify?”  PRenaud motioned to approve the proposed amendments #2, #3, #4, #5, and #6 for the town ballot as listed in the minutes of the public hearing of January 14, 2013.  MBorden seconded. Vote unanimous in favor.

RMarshall read a letter from LGC concerning the PCC questions raised by Donna and Todd Smith about the cost of site plan review and how to shortcut the process of the application.  A comment within the letter is that the Board of Adjustment ruled that a non-residential activity was occurring on the property by using 3 pieces of evidence; the state paperwork of the trade/corporate name, the WMUR story seen on Chronicle, and the knowledge that school field trips have toured the property.
After a brief discussion as to how to proceed, RMarshall said, “I will contact DSmith and tell her it is our opinion that they need to bring in their draft of the site plan application to review.  We’ll to go over it on February 11 and will review options.

RMarshall reported that Beth Nee had responded to e-mail expressing her potential interest in being a new member of the Planning Board.

8:17 p.m. Sawmill Estates continuation – RMarshall informed Board that CBranon will not be here this evening. As a result of his absence, the public hearing will be continued.  PRenaud mentioned that at the next meeting the 65 day extension will be expiring on February 13, 2013. PRenaud motioned to continue the Sawmill Estates hearing to February 11, at.  SChicoine seconded.  Vote unanimous in favor.

8:30p.m
PRenaud reported on the Economic Development Advisory meeting. It is getting off the ground and will at sometime be asking for input from the Board. He then asked about dilapidated buildings regulations that PHopkins was to bring back before the Planning Board.  MBorden, new Code Enforcement Officer, gave us some examples of the regulations that are enforced by towns surrounding us. MBorden said, “In light of state statutes, we, as a Board, do not have to address this.  The statutes state the governing body of a town is the enforcer. I will go to the Selectmen with a fee structure for the dilapidated buildings.   It would be a regulation and the Planning Board will have nothing to do with it.”   

8:37 p.m.  Community Planning Grant Round 2 Update:
RMarshall advised the Planning Board that he has sent in the second round of grants draft last Friday. The final draft is due February 12, 2013.  The Round 2 Grant requires participation by NH Preservation.org as a consultant. MStier, Field Representative for NH Preservation.org, was here on January 17 and got a tour of the Village District.

PRenaud asked, “Do we have to have one more outreach activity in Februaryfor Round 1 completion?”  RMarshall said, “Yes, there is article coming out in the Spirit explaining changes in the zoning ordinance. With the minor changes we are recommending, we can minimize the amount of outreach. We are in compliance with our grant’s guidelines with the outreach specifications.”  

8:45 pm  Site Plan Review and Subdivision Regulations revisions
As part of our Grant 1 activity, the board began review of the recommendations for changes in the Subdivision Regulation proposed by Lisa Murphy at SWRPC. Recommendations were  quickly approved in Section I through Section V.

Recommendations for Section IV, General Provisions for Subdivision of Land, brought about an extensive discussion of monuments, iron pins, and potential conflicting language in the regulation and  language in Appendix A. The conversation was tabled. The Planning Board will resume review on February 25, 2013.

9:25 Sawmill Estates regional impact
RMarshall asked the Planning Board if it felt that the Sawmill Estates subdivision warranted regional impact notification as required in the Subdivision Regulation. After review of Appendix C, Criteria for Determining Regional Impact, discussion followed. The Planning Board agreed that this subdivision had potential regional impact for the Town of Bennington because the development was close to the town line and the development would likely increase traffic on Route 31 in the Bennington village.  He will send a letter to Bennington Select Board informing them of these impacts.
