7: 27pm Minutes: GMorris began reading the January 10, 2011 meeting minutes. The following changes were made:
Line 18: added the word ‘List’ to sentence
Line 44: put a question mark at the end of the sentence
Lines 87 & 88 placed above line 83
Line 96: removed the word ‘of’ from the sentence
Line 98: replaced the phrase “Gould Hill Rd” and with 46 Zephyr Lake Road and inserted the word ‘also” in the sentence, to read as “…proposed 46 Zephyr Lake Road site which may also provide coverage.
Line 109: inserted the word ‘the,’ to read as “but if the Board decreases the buffer zone then no easement is needed.”
Line 111: changed the word ‘least’ to ‘lease’
Line 122: changed the word ‘camouflaged’ to ‘camouflage’
Line 159: inserted the word ‘have’ to read as “GMorris stated that we have a 11/23/10 report…”
MSteere motioned to accept the minutes as amended. JAdams seconded. Motion carried.
7:40 pm: Public Hearing began on Proposed Ordinance Changes
A clipboard sent around for audience signatures for attendance records. GMorris read the procedures to be used for the hearing. A lengthy discussion followed on the proposed amendments. Audience participation offered several changes to the proposed ordinances.
Amend #1- adding in Sec 7 to existing zoning the title VTOL rather than helicopter. An audience member proposed the 250’ setback be changed to 500’. It was also suggested that the word ‘homeowner’ be changed to ‘property owner.
Amend #2 recommends Sec. X.C.2 Wind Energy Systems to read be modified to allow small wind energy systems in the Special Purpose District. No recommendations were suggested.
Amend #3 – add a Sec 3.I.3 into Special Purpose District, known as “CMREC”, provide for medical, educational and residential care of persons with disabilities. No changes were suggested.
DShumway, President, CMRC, commented that CMRC appreciates the time and effort in putting this Special Purpose District together.
8:25 pm GMorris closed the Public Hearing.
GMorris explained to the public that based on comments from the public, the Board will deliberate on what substantive changes are done, if any, and a that a second public hearing will be held on the substantive changes if necessary.
The Board made the following changes:
Amend #1: MSteere motioned to modify setback requirement from 250’ to 500’ on VTOL aircraft. KO’Connell suggested a 500’ setback or easement could be written into the ordinance. JAdams likes the amendment as it exists. BMarshall commented that after an extensive discussion the Board was trying to get away from a large area for the VTOL. GMorris called for a vote to change the 250’ setback requirement to 500’. BMarshall, JAdams, JFletcher voted against the change, and MSteere and KO’Connell voted for the change. The nays carried the vote. GMorris will change the word helicopter to VTOL and will changed homeowner to resident. He will add “accessory use for the residence as per RSA 674.16.v.” Aircraft may land in all
zones at any time for medical, emergency situations. GMorris will remove “properly licensed” from the amendment.
Amend #2: BMarshall asked that the word “use” to be inserted after the word “public.”
Amend #3: GMorris will modify the word ‘helipad’ to read 'VTOL landing area' and will reword Sec 5 its clear that maximum height is 50' or three stories
MSteere motioned to accept as amended those ordinances that are going on ballot for town meeting. BMarshall seconded. The motion carried. The board agreed that because there were no substantive changes to the proposed ordinance, a second public hearing will not be held.
9:01 Zephyr Lake Road Cell Tower Deliberations:
GM handed copies of all letters received from the public to the board so they can review them.
PRenaud asked to record the session. There were no objections.
JSpringer said that the Board had asked for several things from him and that the containment system is being worked on and he didn’t have that information this evening. As the existing structure issues were the most important, he handed out new colored maps showing RF coverage from the Fire Station and the CMRC gym and water tower. The RF Engineer ran plots at these locations at several heights. All plots are shown without the Zephyr Lake Rd site being turned on. He commented that KBreuer is present to answer any questions. GMorris asked if the height is working against us. KBreuer said, “The 117’ water tank has a lot of small hills which is blocking the signal. The terrain has a direct affect and causes shadowing.
BMarshall said that he needs two maps showing Zephyr Lake road site turned on and off with all other sites as well. He’s not confident in the data that we are getting from ATT concerning the distance of the RF frequency. BMarshall showed the 12/13/10 map and asked KBreuer if this was wrong. KBreuer said that it was inaccurate and is no longer valid.
GMorris asked, “Do we want to discuss the letters?” JAdams, said, “No, I want to read them make notes, and then discuss them. This way we each will have different questions from these letters.”
BMarshall is concerned about the subterranean construction of a concrete pad and the impact on the aquifers, the residential area and downhill marshy area below the site. He also has concerns about the driveway construction. BMarshall said that the driveway is actually a spur off an existing driveway, and the fire chief said that it would need to be moderated in slope.
His comment was, “If we put these questions out, then the applicant will have time to prepare the answers when we are ready to discuss them.”
JAdams, “Would like to know how far down the tower support is?” PMarchand responded, ”The depth will be 10-12’ deep and 20’ wide.”
GMorris asked about the depth of pad, if you go down 10’- 12’, what if you hit ledge? PMarchand said, “It can be anchored to ledge.” GMorris then asked, “What if you hit water?” PMarchand responded, “Because no borings have been done, he didn’t want to respond to that question.”
MSteere motioned that deliberations continue to next week. JAdams seconded the motion. Motion carried.
GMorris ask the Board to look at Capital Improvement plans, make notations, mark-up the sheets and submit any changes.
9:50pm MSteere motioned to adjourn. JFletcher seconded. Motion carried.
