Members present: KO’Connell, BMarshall (alt), GMorris, JFletcher, JAdams, MSteere arrives at 7:24pm.
Chairman Morris declared that BMarshall would sit in for MBorden.
7:15pm Start of Meeting
JFletcher reads the minutes from the May 11, 2009 meeting.
The following changes are noted:
Line 108: change question mark to period.
Line 58/59: add winter at the start of line and remove it from the middle of line.
MSteere moves the minutes be accepted as amended, JAdams seconds, no discussion, all in favor, the motion passes.
7:33pm Continuation of deliberative hearing for 783 Forest Rd Properties, Delay’s Harvester Market. The PB schedules a site walk Friday at 6:00pm May 22, 2009 for DeLay’s Harvester Market. JPlourde defers to PHopkins for fire/life safety evaluation. The continuation of the deliberative hearing is scheduled for June 8, 2009 at 9:00pm.

Site Plan Review for Cingular Wireless PC Services, LLC Cell Tower Map R1 Lot 009
Applicants and Representatives: Doug Wilkins, Peter Marchant (KJK Wireless)
GMorris addresses the PB and discusses the RSA regarding proper notification required for cell towers. The question is regarding whether notification included all municipalities within a 20 mile radius that the tower could be visible. The PB discusses the elevation of surrounding mountains and hills that would block the view of certain areas, but there are other areas which the tower could be potentially visible. GMorris asks if the applicant has any insight as to what locations the tower may be visible from. The applicant’s representative DWilkins states that they have notified many of the surrounding towns where they felt there may be some visibility issues. GMorris asks if the PB feels that this meeting has been properly noticed. KO’Connell states that the RSA is fairly clear, and that the
additional towns should be noticed. All the abutting towns plus Antrim have been noticed. GMorris asks if all the towns within a 20 mile radius as depicted on a map should be notified. Members from the Francistown PB are present and state that they had similar discussions and concerns. MSteere moves that the PB notifies every town within the 20 mile radius from the location of the tower. JFletcher seconds, no discussion. MSteere aye, BMarshall and JFletcher no, and KO’Connell and GMorris abstain. MSteere suggested the PB review a topographical map of the region to determine which towns should be notified due to visibility. The PB is in agreement with this approach.
The PB decides they must hold off the meeting and re-schedule for June 8, 2009 7:15pm in order to meet the notification requirements as depicted in the RSA. The applicant asks if there are any issues regarding completeness of the application. GMorris states that the town’s representative viewed the application and noted no deficiencies. The public asks if a copy of the application can be made available for review. GMorris will leave a copy of the application with Catherine Shaw.
8:10pm The PB enters into further discussion regarding notification for cell towers. BMarshall moves that the PB reconsider the previous vote regarding notification of all towns within a 20 mile radius. JFletcher seconds the motion. The PB discusses the merits of the motion. The PB wants to protect the town by meeting the requirements of the RSA, however not all locations would have direct line of site visibility of the tower. BMarshall states that the town would have to spend a lot of time trying to determine which locations should and should not be notified, each time there is a similar application. To protect the town it would be best to notify all municipalities within the 20 mile radius. GMorris calls for a vote, all in favor, the motion to reconsider passes. The PB reconsiders the
previous vote: The motion was that the PB notifies every town within the 20 mile radius from the location of the tower. The PB discusses what publications would be used. BMarshall volunteers to go through the list of towns and determine what publications each town uses for such notifications. JFletcher suggests that the PB develops a list that encompasses a 20 mile radius covering the entire town. GMorris calls for a vote, BMarshall, MSteere, JFletcher aye, none oppose, K’OConnell and GMorris abstain, and the motion passes.

8:28pm Other Business
GMorris updates the PB with his discussions with Carol Ogilvie and the town treasurer regarding bonding procedures. BMarshall would like to know when the PB will take up discussions regarding the Master Plan. The PB enters into a general discussion. For June 22, 2009 the PB will review the Land Use portion of the master plan. The open space ordinance will be scheduled for review at a later date.
8:52pm MSteere moves that the meeting be adjourned, KO’Connell seconds, no discussion, all in favor and the meeting is adjourned.
