7:05pm Start of Meeting
MBorden reads the minutes January 26, 2009 meeting.
Corrections: Line 5: remove second JFletcher. Line 34: correct spelling of lawyer, Line 37: should read ‘proposed lot merger’, Line 43: change to PSilvernal notes that the deed, Line 49: remove somewhat. MBorden moves that minutes be accepted as amended, KO’Connell seconds, no discussion, all in favor, the motion passes.

JHalper presents the draft CIP to the PB. JFletcher moves to accept the CIP as amended, MBorden seconds, no discussion, all in favor and the motion passes.

Mitchell Major Sub-Division Map R2-17
CBranon from Meridian is presenting the Mitchell’s proposed subdivision application. Mrs. Mitchell (property owner, Albert Burt are present. GMorris calls the meeting to order. JAdams will abstain from voting, he is an abutter. GMorris reads the procedures. KO’Connell states that the hearing has been properly noticed. CBranon presents the major sub-division plan for Map R2-17, a large 96 acre lot on Sawmill Road to be sub-divided into two lots. This is completely separate from the previous sub-division. GMorris reads letter from Carol Ogilvie.
CBranon discusses the discrepancies noted by Carol Ogilvie. Meridian did not receive Ogilvie’s review in time to provide written waivers. GMorris goes over the checklist.
The following are noted from COgilvie’s review:
- Item 10, proposed driveway is not noted, the PB will requires an access point for this to be a legal lot. CBranon states that there is a curb cut. The PB will need the curb cut to be shown on the plat.
- Item 12, Watercourses, ponds, etc.
- Item 14, USGS contour lines need to be shown.
- Item 15, soil data including wetland designation is not shown.
- Item 17, perk testing.
- Item 19, location and profiles of existing and proposed water mains, sewers, etc is not shown.
- Item 23, a copy of driveway permit has not been submitted.
A discussion ensues resulting in BMarshall moving that the PB accepts the application is sufficient to invoke jurisdiction subject to the receipt of written waiver requests for open issues before final approval. MBorden seconds, no discussion, all in favor, the motion passes and the application is accepted. The PB discusses the discrepancies listed.
- Item 10: CBranon will add the access to the plat,
- Item 12: There is a watercourse along the frontage of the new lot should be shown, CBranon would like to request a waiver of this requirement. The PB discusses the merits of this request. The PB would like to request the watercourse along the full frontage of both proposed lots.
- Item 14: The contour lines need to be shown; CBranon will add USGS contour lines.
- Item 15: Soil data for the entire property may be pulled of the USGS maps. The PB is not requiring a high intensity soil survey. CBranon requests a waiver of this request.
- Item 17: there is a waiver requested for perk test being shown
- Item 19: There is an existing culvert that needs to be shown
- Item 23: a copy of the driveway permit will be provided once access is determined.
At 8:55pm the public hearing is opened. One concerned citizen offers their comments to the PB regarding the procedure being followed. There are no further comments from the public. At 8:58pm the public hearing is closed and the PB enters a deliberative session.
Waiver #1. The owner is requesting that all items required in number 12 be waived. BMarhsall moves that the waiver be accepted except watercourses along the frontage of both lots. MBorden seconds. No discussion, all in favor, JAdams abstains, the motion passes.
Waiver #2. The owner is requesting that the items in number 14 be waived. BMarshall moves that the PB does NOT waive the addition of contour lines, JFletcher seconds, there is no discussion, JAdams abstains, all in favor, the motion passes.
Waiver #3: BMarshall moves that the PB does NOT grant the waiver request for wetlands delineation and soils data along the frontage of both lots. MBorden seconds, no discussion, JAdams abstains, all in favor, the motion passes.
Waiver #4: BMarshall moves that the PB approve the waiver for item #17, second MBorden, no further discussion, JAdams abstains, all in favor, the motion passes.
Waiver #5: BMarshall moves that the PB approves waiver for item 19 with the exception of existing culverts, MBorden seconds, there is some discussion regarding a similar situation on County Rd and how this information provides a record of the physical layout at the time of division, no further discussion, JAdams abstains, all in favor.
No further action can be taken by the PB at this time. A continuation is scheduled for February 23, 2009 at 7:30pm.

Preliminary Concept Consultation for Trosky possible subdivision.
Bob Trosky (owner) and Steve Carey (representative) are present.
GMorris reads the guidelines for a PCC. SCarey provides the PB with an overview of a possible sub-division for the Trosky property. The PB enters into discussion.

MBorden moves that the meeting is adjourned, KO’Connell seconds, no discussion, all in favor, the meeting is adjourned.
