Members Present:  MSteere, JFletcher, GMorris, MBorden, BMarshall, JAdams, JFletcher, BMarshall is sitting in for KO’Connell.  

7:06pm Start of Meeting

7:07pm  MBorden reads the minutes from January 12, 2009 meeting.  Correction to line 75 change, ‘are’ to ‘be’, and line 76 to ‘is to be’.  Line 32 add ‘request information for public access to waterways’.  BMarshall suggests a copy of the ordinances be attached to the minutes, the PB is in agreement.  MSteere moves that minutes be approved as amended.  MBorden seconds, no discussion, all in favor, the motion passes.

JHalper would like to reschedule the CIP presentation due to the lack of an overhead projector.  The PB is in agreement.  The CIP presentation is rescheduled for February 9, 2009, time TBD.

Preliminary Conceptual Consultation for Carbee.  Earl Sanford and Paul Silvernail from Sanford Surveying and Engineering, Peter Bennett laywer from Weinger and Bennet, property owners Mr and Mrs. Sheldon Carbee and Scott Carbee are present.  GMorris reads the procedures for the PCC meeting.  ESanford addresses the PB with a draft plan for proposed lot merger.  This would include a merger of parcels B and C which contains the Longblock Apartments and Store building.  PBennett addresses the PB regarding the title search going back to 1951.    674:39-a states that a public hearing is not necessary if it doesn’t violate the zoning ordinances. It does need to be approved by the PB.   There is a standard form “Notice of Voluntary Merger: 674:39-a” provided to the PB by PBennett.  Lot D is under the name ‘Greenfield Industries’ but is owned by various members of the Carbee family.  PSilvernail, the deed for parcel D shows a larger piece than is actually there.  GMorris reads the ordinance 674:39-a.  JAdams would like to make the property owners the designee to record the changes.  MSteere moves that PCC is adjourned.  MBorden seconds.  No discussion, all in favor, at 7:43pm the PCC for Carbee is adjourned.  7:44pm the PB takes up the Application for Voluntary Merger.  JAdams states that the Town’s Attorney has been consulted and somewhat involved in the process.  There is a question of how taxes would be figured.  JAdams states that the BOS has reviewed this and supports the plan.  JFletcher moves to appoint MSteere as assistant recording secretary, MBorden seconds, no discussion, MSteere abstains, all in favor, the motion passes.  JFletcher moves that the PB approve the Notice of Voluntary Merger regarding Carbee merger of parcels B and C.  GMorris requests that the owners consult with the town regarding lot numbers.  MBorden seconds.  No discussion, all in favor, the motion passes at 7:50pm.  GMorris and MSteere sign the application showing PB approval.

8:00pm
Public Hearing for proposed changes to the Zoning Ordinances.  Gene Mitchell is present.  8:05pm KO’Connell arrives.  GMorris presents the PB and public with copies containing the proposed changes. 8:05pm GMorris calls the public hearing to order and reads the procedures.  KO’Connell states that the hearing has been properly noticed.  The PB discusses the proposed changes.  BMarshall moves that the proposed changes for the current planned section XV: Building Construction omitting sections F.2 and F.4, MSteere seconds, there is no discussion, all in favor, the motion passes.  The PB discusses the proposed changes to the Zoning Ordinance.  BMarshall notes a small formatting (non-substantive) change.  MBorden reads through the recent changes proposed by the PB at the January 16, 2009 public hearing.  MSteere moves that the proposed changes to the Zoning Ordinance be approved by the PB and presented to the town as a warrant article with the non-substantive changes as discussed, MBorden seconds, no discussion, all in favor, the motion passes.

MSteere moved to adjourn, MBorden seconds, no discussion, all in favor, the meeting is adjourned.
