Greenfield Planning Board Minutes
October 23, 2006

Members Present: Chairman Carrara, members Halper, Morris, Borden, Fletcher, Rainier, O’Connell and alternate Steere.

The meeting opened at 7:03 pm.


Minutes of 10-16-2006:
Minutes were read and accepted at 7:10 pm with the following changes:

“CPI” should read “CIP”
“Quick Claim” should read “Quitclaim”
Section regarding time 8:56 “off of a to be built (by the developer) town road” should read “off a town road to be built by the developer”

7:10 Mail:
Two Faxes from C. Shaw re: Tax Maps
Letter from Office of Energy & Planning re: FEMA Issues
Letter from C. Ogilvie re: Landmark/O’Brien Subdivision
Approval for Subdivision from State of NH regarding York River LLC subdivision on Old Bennington Road.

7:14 CIP – Capital Improvement Plan
Member Halper requested a motion to approve the CIP for presentation to the Board of Selectmen.  Motion was made, seconded and approved. Member Halper will present the CIP to the Board of Selectmen and Budget Advisory Board on 11/2/06.

7:30 Deliberation of major subdivision on Old Bennington Road by York LLC
Scott Gauthier of York River LLC and Bill Davidson of Meridian Land Services were in attendance. The minutes from September 11, 2006 regarding the subdivision were re-read. The deficiencies noted in the minutes of September 11, 2006 were reviewed and found to be sufficiently addressed. A site walkthrough will be held on Sunday, October 29, 2006 at 8:00 am EST. Deliberation will continue at the October 30, 2006 meeting.


8:09 Minor Subdivision Application by Landmark Planning & Development – Gulf Road
Representing the Landmark Planning and Development are Chris Stewart (VP, Landmark Planning and Development), Ronald Bourcier (Engineer, H.L. Turner Group, Inc), Darren Hardy (Survey Manager, Chas. H. Sells, Inc), Rolf Goodwin (Attorney, McLane, Graf, Raulerson & Middleton).

Member O’Connell stated that notification was properly made.

Member O’Connell disqualified himself from the deliberation due to his position on the Zoning Board and Alternate Steere took his place.

Darren Hardy presented the application to the board.

Member Carrara requested payment of the fees. Chris Stewart stated the fees paid from the first two applications should be applied to this application. Carrara read the cover letter for the application regarding Landmark’s opinion of the fees. Discussion of the fees took place among the board. It was moved and seconded that the Board collect the application fees for this application prior to voting on whether or not to accept the application. The motion was approved. The board did agree to allow Landmark Planning and Development to submit the check for the amount of $282.60 on October 24, 2006. An invoice of the monies due was given to Landmark Planning and Development.

Chairman Carrara read a letter from McLane, Graf, Raulerson & Middleton regarding the application.

Chairman Carrara read Carol Ogilvie’s review of the application dated October 16, 2006.

Discussion ensued on the Class VI frontage on Gulf Road.  RSA 231:22-a was read. It stated that it takes a warrant article and a vote by the legislative body (voters at Town meeting) to accept the reclassification, of the portion of class VI Gulf road, in question. Town attorney Teague presented his opinion of the road reclassification process. He referenced the court case Beck vs. Auburn (1981). Attorney Goodwin for Landmark Planning and Development offered his opinion of the road reclassification process.

It was moved and seconded that the Board not accept this application, because one of the proposed lots would not have sufficient frontage on a Class V or better highway, as required in the Greenfield Zoning Ordinance. The motion was unanimously approved and the application was not accepted.

Chairman Carrara stated, that according to Member Rainier, the Board of Selectmen had not been approached by anyone about reclassifying the portion of Gulf Road in question.  Also, the Planning Board had not been approached by anyone about reclassifying the portion of Gulf Road in question. He also stated that the Board is trying to provide the applicant with direction about the process of reclassifying a class VI road.

9:30 Hall Common Driveway Discussion
Peter Hopkins, code enforcement officer stated that before any decision is made, the Board should obtain a statement from the State of NH DOT regarding the safety of the driveway. Carrara will request the statement from the DOT.

9:45 Discussion of Items for Working Meeting to be Held on October 30, 2006
Member Halper read a list of possible topics for the meeting.
