Minutes of the September 8, 2003 Meeting of the Greenfield Planning Board
The meeting opened at 7:00 p.m. with members Cernota, Fletcher, Hopkins, Kavenagh, Marshall, Rainier and Winslow in attendance. Minutes of the August 25th meeting were read and approved.
Marilyn passed out a revised draft of the Greenfield Open Space Bylaw prepared by Sheldon as well as a copy of Article VIII describing the Agricultural and Rural District in Hancock. Of special interest is #9 on Flexible Lot Sizes prepared by the Town of Hancock. We also received a copy of the new revised Zoning Ordinance.
Marilyn reported that she had contacted Southwest to discuss the request of Cathy Raciot to board and train horses at her property on Slip Road. Southwest said that she should go through non-residential site plan review because of the size of the operation which may have an impact on the neighborhood. Marilyn also reported that she had spoken with Eric on the question about bonding for subdivisions. He is researching this but feels that requiring a bond to complete work on subdivision is probably not going to fly. We are still waiting to hear from him on the first paragraph of the Zoning Ordinance.
Marilyn also reported that Steve Robertson reported he has gotten 1988 aerial photos of his property as well as a 1981 tracing done by Dennis McKenney. Steve is in contact with Ridge Mauck trying to settle site specific questions. Steve will then be submitting applications and plans to meet with us at 9:00 p.m. on September 22.
At our next meeting we will be holding a hearing on the Strickland subdivision as well as a preliminary conceptual consultation with John Doherty on the proposed Kennedy subdivision of 200 acres on Cavender Road and Old Bennington Road.
The board discussed RSA 155E. Southwest has advised that we can have our own Excavation Ordinance but we should delete any wording that is duplicated in RSA 155E and the beginning paragraph in the ordinance should have the wording “per 155E as amended” so that we can keep it up-to-date. A public hearing will be necessary to adopt this. Marilyn complimented Bob on the work he has done on comparing 155E to our regulations. He will mark up the present regulations to strike out material to be deleted. When we have agreed on these deletions, he will make up a draft.
The board went over the following mail:
A copy of a 2 page letter from Peter Hopkins to Vic Mangini addressing code violations at the Greenfield Inn. He does not have a building permit for work being done, there are questions about the septic system and a question about the number of occupants. We pulled the file on the Inn to check the ruling from 8/15/89 when the ZBA granted Vic the right to have 9 bedrooms only.
The ZBA sent two applications for appeals for us to look at. One came from David Staiti on Slip Road requesting a variance on the setback of 28 feet for his deck. The Planning Board had no input on this. The second appeal is from C&M Family Homes of Hollis NH for property on Cavender Road (R3 lot 29) where a house is being built 60 feet from the road. If the builder used the correct setback of 100 feet, the house would be in the flood plain. The Planning Board feels that purchaser of a property should be aware of the town regulations on zoning before he completes a transaction and therefore they should comply with the regulations.
We received a copy of the Minimum Impact Expedited Application filed by David O’Hara for Pratt Family Homes to build a driveway through wetlands. The Conservation Commission has signed off on this.
We have received an application from Brian Hall for an 8-lot subdivision on Route 31. He has submitted 4 paper copies, a mylar, list of abutters, septic and driveway permits. A hearing will be held on October 13 at 7:30 p.m.
There was a notice of a Wetland Classification and Mapping Seminar.
Deb sent a memo on flu shots.
We received a copy of the budget.
Approval from NHDES on the subdivision for Pratt Family Homes.
Notice from Lyndeborough for a hearing for AT&T for 9/11.
Copy of a letter from the selectmen to Southwest asking that they finish the maps.
Invoice from the Registry – this is for the Fleck Trust lot line adjustment.
Notice from the Office of State Planning & Energy Programs memo on a conference at Plymouth State on 10/25.
Municipal Law Lectures from 7 – 9 at the Jaffrey Fire Station. George will go on 9/17 and 10/1. Don will go on 9/24 and 10/1. Bob will go on 9/24. Marilyn will go to all.
Peter Hopkins came in to explain the letter to Mr. Mangini. Vic would like to build a garage with an apartment. Peter advised him that this could not stand alone but would have to be attached to the present building. Peter said that he had looked at the Inn with Vic and felt that the fire chief should make a visit. Peter and Loren then came for a check and both felt that there were questions that they would like the State Fire Marshall to answer. A meeting with the Fire Marshall is being set up for this week or next week. Peter will keep us informed about the findings.
Questions for Southwest came up on two subjects. One was on an existing lot with no frontage but a deeded right of way. Can the owner of the lot build on it? Another question was on temporary buildings. If a temporary building is hard wired, is it then considered a permanent building and must it meet specifications?
The board voted to keep the meeting dates in October as usual rather than change because of Columbus Day.
The board read over Hancock’s Open Space Regulations. The majority of members preferred our proposed bylaw rather than this. The board looked over the revised draft and changed multi-family units to duplex units. We decided to contact Southwest to see if they would be willing to look at our proposed ordinance and work up a plan for 20 acres as well as a plan using Hancock’s Open Space Regulations.
