MINUTES


Present:  Paula Johnson, Chairwoman, Margaret Chapple, Charles Kraiza, Paul Lambert, James Sansone and Linda Spevacek.  Francis Armentano, Director of Community Development was also in attendance.

The meeting opened at 7:02 p.m.

Public session:  There was no public comment.

ON A MOTION by Paul Lambert, seconded by Margaret Chapple, the Commission voted to approve the minutes of January 25, 2011 with the following addition:  Page 1, paragraph 6, sentence 7 should read; Other members of the public agreed with Mrs. Monty and commented that we need to make the public aware of the ordinance. The public should also be aware that tree cutting in the Town right-of-way is prohibited on all Town roads.  All approved.  Charles Kraiza and James Sansone abstained.

New Application:

The Commission held a discussion concerning an application seeking approval for a one lot subdivision for property located at 101 East Street, File P-1-11.  Carol Evonsion, speaking on behalf of her family, presented the proposal of a 2 acre lot in a R30 zone.  The purpose of the subdivision is to separate from the 128 acre property, known as the Evonsion farm, a parcel of property that contains an existing single family home, which was formerly the home of Ray and Sophie Evonsion, who are now deceased.  The proposed lot has an existing curb cut, septic system and well. No new construction is proposed for the new lot and no construction is proposed for the remaining acreage of the farm.  Ms. Evonsion explained that her son Dale intends to acquire and restore the home.  Because the subdivided property will be transferred to an immediate family member, the applicant is eligible for a waiver of the fee in lieu of open space (for the usable open space).  The applicant also requests a waiver of the open space requirements for the non-usable open space requirement under Section 3.1.3.5.4 and 3.1.3.5.5. These Sections permit the waiver where less then six (6) lots are proposed and where no new road construction is proposed. The Commission discussed the visual streetscape buffer requirement and agreed that this requirement should not be applied as the property is already developed with a single family home and the location is consistent with other homes within the general area of the proposal.  Fran also noted that the remaining acreage is not a buildable lot without going back to the Planning and Zoning Commission for approval.  There was no public comment.

ON A MOTION by James Sansone, seconded by Linda Spevacek, the Commission voted to approve an application seeking approval for a one lot subdivision for property located at 101 East Street, File P-1-11, as outlined on a map titled Subdivision Plan – Hidden Acres Farm, prepared for Raymond C. Jr. & Steven Evonsion Trustees, prepared by Messier and Associates, Inc and dated 01/11, project# 07-053.  All approved.

Old Business:

The Commission held a discussion on a proposed Special Permit under Section 3.4.2.7 of the Zoning Regulations for the use of property located at 59 Meadow Brook Road by a non-profit organization, Bandit’s Place, Inc., File Z-01-11. The public hearing was closed on this matter on January 11, 2011.  Fran Armentano had prepared conditions of approval for the Commissions’ review, as directed by the Commission. The Commission went through each of the conditions and suggested modifications.

ON A MOTION Paul Lambert, seconded by Margaret Chapple, the Commission voted to approve an application seeking a Special Permit under Section 3.4.2.7 of the Zoning Regulations for the use of property located at 59 Meadow Brook Road by a non-profit organization, Bandit’s Place, Inc., File Z-01-11, with the following conditions:

  • The animal shelter building can have a footprint that is no larger than 1200 square feet.
  • The building shall be placed on the site in conformance with the Zoning Regulations.
  • The building may have no more than 6 animal pens and no more than 6 adult animals may be sheltered on the property at any one time.  All animal pens shall be connected to the septic system and all animal waste shall be directed to the septic system.  For the purpose of this condition, an adult animal is any animal that is older then 6 months.  Animals do not include birds or small animals such as rabbits, guinea pigs and hamsters.
  • Animals will only be permitted outside between the hours of 9:00 am to 5:00 pm. and whenever animals are outside they shall be fully supervised by personnel who shall remain on the premises while the animals are outside.  The property shall have no outside runs or outside cages for the animals unless they are specifically approved by the Commission. The property may be fenced.
  • The shelter building shall be designed in a manner which will limit the noise (barking dogs) that emanates from the building.  The applicant shall use acoustical materials in the construction of the building and shall seek recommendations from the Granby Building Official in this regard. Should the Granby Building Official disagree with the proposed acoustical modifications then he shall not issue the building permit and the applicant shall return to the Commission with a specific building design for the consideration of the Commission.
  • The building shall be air conditioned and heated.
  • There shall be no penetrations on the south side of the building.  Penetrations shall include all windows, doors, fans and other such openings cut into the walls of the building.  Building penetrations shall primarily face the school bus parking property to the north and Salmon Brook Street to the east.
  • It is understood that the site activity will be minimal and that the property will be accessed primarily by volunteers who care for the animals.  No special events, fundraisers or similar activities, are permitted.  The applicant is advised to consult with the Granby Traffic Authority in placing the building on the site to allow for any relocation of the curb cut.
All approved.   Charles Kraiza and James Sansone abstained.

Receive Application:
The Commission received an application seeking a Special Permit for personal services for the use of property located at 9 Bank Street, aka Geisslers Plaza for a nail salon, File Z-2-11.  The public hearing will be scheduled for February 22, 2011.

Staff Reports and Correspondence:
Fran noted that the Town continues to work on the appeal of the ZBA decision regarding dirt bikes.  He anticipates the trial will be in the Fall 2011.
