PLANNING BOARD MINUTES

LOCATION: Gorham High School Cafeteria, 41 Morrill Avenue, Gorham, Maine

The Chairman opened the meeting at 7:00 p.m. and read the three-item Agenda.  The Clerk called the roll, noting that all Board members were present.


1.      APPROVAL OF MINUTES:  OCTOBER 4, 2004.

Michael Parker MOVED and Mark Stelmack SECONDED a motion to approve the minutes of October 4, 2004, as written and distributed.  Motion CARRIED, 7 ayes.  [7:04 p.m.]



2.      STREET ACCEPTANCE REPORTS – “DISTANT PINES SUBDIVISION” – off 200 BURNHAM ROAD – RISBARA BROS. CONSTRUCTION CO., INC.
“Distant Pines Drive” and “Harriman Way” in the Distant Pines Subdivision as offered by Risbara Bros. Construction Co., Inc.  Zoned R-MH; M1/L6.201-6.217.

Ms. Fossum presented the street acceptance report, stating that the applicant is requesting acceptance of the roads prior to the placement of the final paving and that the applicant is offering to post the required 150% of the estimated cost of the final paving, set at $19,118 by the Public Works Director.  She said that the legal documents involving these roads (offer of cession, proposed roadway deed, drainage easement, fire pond maintenance easement, snow plow storage easement and required transfer tax form) have been reviewed by the Town Attorney and staff, and with the exception of some minor typographic corrections the documents are satisfactory for acceptance.  Ms. Fossum said that the developer will provide a one-year road maintenance guarantee of $5000 in addition to the Road Improvement Account to cover the cost of the final surface paving.  She said that an inspection by the Public Works Director has indicated some of the monumentation is missing, which the developer has agreed to replace.

PUBLIC COMMENT PERIOD OPENED:   None offered.
PUBLIC COMMENT PERIOD ENDED.

        Douglas Boyce MOVED and Clark Neily SECONDED a motion to recommend acceptance of Distant Pines Drive and Harriman Way in the Distant Pines Subdivision, prior to placement of final paving, as offered by Risbara Brothers.
        Mr. Neily agreed to withdraw his second so that Mr. Boyce could amend the motion as follows:
        
Douglas Boyce MOVED and Clark Neily SECONDED a motion to recommend acceptance of Distant Pines Drive and Harriman Way in the Distant Pines Subdivision, prior to placement of final paving, as offered by Risbara Brothers, with the following conditions of approval:
1.      Replacement of missing granite monuments,
2.      Correction of minor typos in the deed, date revisions to the developer’s letter of session and letter of certification, revisions to the transfer tax form, and
3.      Provision of the required road maintenance guarantee and road improvement account in the amounts recommended by the Public Works Department.
Motion as amended SECONDED by Clark Neily.  Motion CARRIED, 7 ayes.  [7:10 p.m.]



3.      STREET ACCEPTANCE REPORT – “TALL PINES PHASE I SUBDIVISION”  - off SPILLER ROAD – GILBERT HOMES, INC.
“Boulder Drive” in the Tall Pines Phase I Subdivision as offered by or Gilbert Homes, Inc .  Zoned SR-MH; M77/L48.201-48.205.

Ms. Fossum presented the street acceptance report, saying that the inspecting engineer on the project, Peter Tubbs of SYTDesign, has reported that all improvements have been made as required by the approved plans.  She said that minor revisions will be required to the offer of cession, proposed roadway deed, a drainage easement and the transfer tax form before being placed on a Town Council agenda for street acceptance.  She reported that the developer is required to provide a one-year road maintenance guarantee of $5000.  In response to a question from Mr. Parker, Ms. Fossum said that the road was built to the rural access standards

        Michael Parker MOVED and Thomas Hughes SECONDED a motion to recommend acceptance of Boulder Drive in the Tall Pines Subdivision, as offered by Gilbert Homes, Inc., with the following condition of approval:
1.      Correction of minor typos in the deed, transfer tax forms, and offer of cession.
        Motion CARRIED, 7 ayes.  [7:14 p.m.]


4.      ADJOURNMENT

Michael Parker MOVED and Clark Neily SECONDED a motion to adjourn.  [7:15 p.m.]
